The meeting began at 7:20 p.m. with four LPC members present. Adoption of Meeting Minutes: ?? ACCEPTANCE OF MEETING MINUTES FROM JULY 20, 2010 HOLD – not prepared in time for meeting Land Preservation Applications and Inquiries: ?? SCTM #1000-14-2-29.2; 29.3; 29.4 & 1000-19-2-2; 3; 12.2 (Orient Point, LLC / Pappas) Review new PDR application Melissa Spiro met with Pappas family members and Pat Moore, their attorney, and Planning staff. The family is agreeable to a conservation subdivision with possibly 5 residential lots. MOTION made by Eric Keil, seconded by Lillian Ball, to direct Melissa Spiro to commission an appraisal on the Pappas properties with no additional agricultural structure restrictions subject to Planning Board approval of a Conservation Subdivision Concept Plan re-subdividing the combined parcel acreage into 4 lots with a reserve area. Motion carried: 4/0 ?? SCTM #1000-108-4-1.1 (Damianos, Mattituck property) Review landowner’s offer for purchase [executive session] Dr. Damianos has expressed interest in selling fee title of this parcel to the Town. LPC has no interest in fee title purchase at this time. LPC is interested in pursuing a development rights easement purchase on this property if seller is willing to accept present day appraised values. Melissa directed to send Dr. Damianos a letter of interest in a price range of $59,000 to $65,000 per buildable acre with a 30 day response time. If landowner is agreeable and willing to accept this price range, an appraisal will be authorized. ?? SCTM #1000-107-10-10.1 (Girards) Status Update re: contract status [executive session] Contract has been signed by landowners. Town Board public hearing is being set for August 31, 2010. ?? SCTM #1000-84-1-11 & 12.1 (Demchak) Review survey and Conservation Subdivision design Subdivision concept plan as prepared by Young & Young was received by Planning Dept and reviewed by LPC. Comment was made that the irrigation well should be included within the farm parcel, not within a residential lot as proposed on the concept plan. Melissa noted that although the map was received by the Planning Dept., no application or application fee was submitted with the concept plan. Melissa and Tamara Sadoo (Planning Staff) are to meet with Peter Danowski, landowners’ attorney. Applications & Inquiries for Uses or Structures on Preserved Property: ?? SCTM #1000-58-1-1.1 (Town Open Space: Bittner) Discuss Eagle Scout project presented at 7/27/10 Town Board meeting The adopted Town Board resolution regarding this Eagle Scout project requires approval from the Land Preservation Committee. Maureen has been working on a DRAFT planting plan to regrade and restore pre-existing dune line/face and re-vegetate with bayberry, beach plum and American beach grass in accordance with NYSDEC permit approved 3/11/2009, and due to expire on 3/10/2014. HOLD for further discussion until Maureen’s plan is complete. ?? Town Open Space: Laurel Lake Preserve RFP for dock, building and debris removal Non-disturbance clause as requested by LPC was added to the RFP. DPW crew may be able to remove the concrete block foundation with minimal work or damage to surrounding area. John Sepenoski and Eric Keil will meet at Laurel Lake Preserve to access the site to see if there is an easier way to remove the concrete block foundation without having to take down mature trees. RFP language was further discussed by LPC who felt that contract information should be included within the RFP, payment is due upon completion of the work, start time of project should begin within 2 weeks of awarding the RFP with 30 days to complete with an option to renew for an additional 30 days, if necessary. ADDITION TO AGENDA: ?? SCTM #1000-102-4-5.3 (Reinhardt) Request from Itzkowitz/Meltzer (potential purchasers) for LPC approval of horse barn, 2 paddocks and tack room within Reserve Area that is within PDR lands. Potential purchasers want to have horses within the PDR easement area for patient therapy purposes. LPC denied request without prejudice. This matter can be brought back to the committee for future consideration if potential purchaser can show that horses within the easement area are being used for agricultural production and not as part of a business. ?? SCTM #1000-63-1-25 (PLT/Charnews Farm) Request for parking within easement area. Stephen Searl of Peconic Land Trust, has made a written request for permission to allow parking on the grass field between the Fisher and Amara houses (off Youngs Ave) for the PLT Family Fun Day event at Charnews Farm on Saturday, August 7, 2010 between the hours of 11am and 3pm. LPC reviewed his request and found that the agricultural event supports the Trust’s mission to conserve LI working farms and is consistent with the property’s agricultural production activities and purposes of the easement. Melissa directed to send letter to Peconic Land Trust approving the parking request and supporting this event. Stewardship and Management: ?? MONITORING (PROPERTY CONDITION) REPORTS: SCTM #1000-96-3-2 Starkie (per Ray Huntington) o Ray gave update on encroachment in which he had used Jamie Richter’s (Town Engineering Dept) measuring wheel to find that pesticide mixing pad is partially located within the easement area. Ray will provide Mr. Starkie with the LPC Request for Structures within PDR form and submit application to LPC for formal approval, “as built”. Approval letter is to stipulate that any future structures within this PDR easement area will require approval from the LPC. SCTM #1000-54-5-55.1 Rozakis (per John Sepenoski) o No issues or violations found within easement area. No restoration work to remove invasive plant species has begun although landowner has contacted Chris Pickerell of Cornell Cooperative Extension for further information on phragmites removal. SCTM #1000-55-1-11.1 & 11.3 Thomas Hubbard (John Sepenoski) o SCTM #1000-55-1-11.2 & 11.4 Anne Hubbard (John Sepenoski) o No issues or easement violations found. It was noted on the monitoring report that a line of trees was planted, and re-grading was done along northerly boundary line. This landscaping work has resulted in causing an erosion issue along Town PDR on adjacent property. Jamie Richter (Town Engineering Dept) is aware of the farm run-off issue at this location. John Sepenoski to meet with Jamie concerning this erosion problem and to give Tim Caufield as a contact person to Jamie should Jamie wish to investigate this matter further. General Land Preservation Items: ?? DEVELOPMENT RIGHTS EASEMENT LANGUAGE Continue discussion from last meeting. Not discussed due to time constraints. Informational: ?? SUFFOLK COUNTY FARMLAND COMMITTEE MEETING July 27, 2010 @ 6:00 p.m. in Riverhead Update re: meeting (Melissa Spiro) Melissa attended County meeting. Several violation of County owned farmland easements were discussed. ?? ZIP PECONIC WELLS, LLC closing held on Tuesday, August 3, 2010 Part of SCTM #1000-86-1-10.9 29.0427 acre development rights easement located at southwest corner of Wells Rd & NYS Rte 25 Purchase price = $2,410,535.80 ($83,000/buildable acre) Federal grant award = $990,000 (reimbursement anticipated) ?? FISHERS ISLAND ANNUAL TOWN BOARD MEETING – August 4, 2010 Melissa, Melanie, John, Maureen and Lillian to attend. Plans are to monitor Nielsen easement and inspect FITF, LLC former property (now Town open space), Parade Grounds/Airport Property, and Dock Beach, if time permits. Next Regular Meeting: ?? The next regular meeting will be held on August 31, 2010, at 7:00 p.m., in the Annex Executive Board Room. No meeting on August 17, 2010. Adjournment: ??
