Box 1179 Southold, New York 11971-0959 Telephone (631) 765-1892 Fax(631)765-6641 The Board of Town Trustees took the following action during its regular meeting held on Wed., September 22, 2010 regarding the above matter: WHEREAS, Costello Marine Contracting Corp. on behalf of KENNETH & ELIZABETH LESTRANGE applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance, application dated August 25, 2010, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator recommended that the proposed application be found Inconsistent with the LWRP, and, WHEREAS, the Board of Trustees has furthered Policy 4.1 of the Local Waterfront Revitalization Program to the greatest extent practical through the imposition of the following Best Management Practice requirements: the wetland area will be planted with spartina alterniflora 12" on center and the low sill bulkhead will increase the size of the wetland area, and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on September 22, 2010, at which time all interested persons were given an opportunity to be heard, and, 0 0 WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, and, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that for the mitigating factors and based upon the Best Management Practice requirements imposed above, the Board of Trustees deems the action to be Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5 of the Southold Town Code, and, RESOLVED, that the Board of Trustees approves the application of KENNETH & ELIZABETH LESTRANGE to construct 138' of low -sill bulkhead with 1-10' and 1-12' end return and 80' of retaining wall with 1-10' end return. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with the following Policy Standards and therefore is INCONSISTENT with the LWRP. 0 • Policy Standards 4.1 Minimize losses of human life and structures from flooding and erosion hazards. The following management measures to minimize losses of human life and structures from flooding and erosion hazards are suggested: D. Use hard structural erosion protection measures for control of erosion only where: 4. Construction of a hard structure is the only practical design consideration and is essential to protecting the principal use. The principal use is residential. A single family dwelling is located approximately 72+ feet from the landward limit of the tidal wetland. The low sill bulkheads are proposed to be located within the high and intertidal marsh areas where the rate of erosion appears to be low. File photos indicate that the shoreline is relatively stable except in two areas; around the dock pilings and under the existing stairs. The areas lack vegetation. It is recommended that the Board require alternative erosion control methods (re -planting of vegetation, fiber controls and/or selective stone armoring) in areas where erosion has occurred. 5. The proposed hard structural erosion protection measures are: a. limited to the minimum scale necessary As indicated above, it is recommended that the Board consider requiring that the applicant retain existing vegetation and where 0 • practical, restore vegetation (sparfina atternitlora) within the intertidal zone to control erosion. Additionally, in areas where erosion has occurred selective stone armoring could be integrated in the design. 6. Practical vegetative methods have been included in the project design and implementation. The low sill bulkhead proposal includes replanting of disturbed areas, however, the species, specifications and spacing of vegetation have not been identified. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. This property has no significant historic resources. Policy 3 Enhance visual quality and protect scenic resources throughout the Town of Southold. The proposed bulkhead will have no significant impact on the visual quality or scenic resources within the Town of Southold.
