Pursuant to the provisions of Chapter 275 and/or Chapter 111 of the Town Code of the Town of
Southold and in accordance with the Resolution of the Board of Trustees adopted atthe meeting h~ld on

TERMS AND CONDITIONS
The Permittee, Matt-A-Marina, LLC, 2255 Wickham Ave., Mattituck~ NY, as part of the
consideration for the issuance of the Permit does understand and prescribe to the following:
That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for ~da:mages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Pennittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto, to the complete exclusion of the Board of
Trustees of the Town of Southold.
That this Permit is valid for a period of 24 months, which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved, to provide evidence to anyone concerned that
authorization was originally obtained.
That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
That if future operations of the Town of Southold require the removal and/or alterations in
the location of the work herein authorized, or if, in the opinion of the Board of Trustees,
the work ~l~all cause unreasonable obstruction to free navigation, the said Permittee will be
requi~red, upon due notice, to remove or alter this work project herein stated without
expenses to the Town of Southold.
That the said Bo~yd will be notified by the Permittee of the completion of the work
authorized.
That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit, which may be subject to revoke upon failure to obtain same.

The Board of Town Trustees took the following action during its regular meeting held on
Wed., August 18, 2010 regarding the above matter:
WHEREAS, Patricia C. Moore, Esq. on behalf of MATT-A-MAR MARINA, LLC applied
to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the
Southold Town Code, the Wetland Ordinance, application dated July 26, 2010, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Watedront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator issued a recommendation that the application be
found Consistent with the Local Waterfront Revitalization Program policy standards,
and,
WHEREAS, a Public Headng was held by the Town Trustees with respect to said
application on August 18, 2010, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
conceming this application, and,
WHEREAS, the structure complies with the standards set for[h in Chapter 275 of the
Southold Town Code, and,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town, and,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees has found the application to be Consistent with
the Local Waterfront Revitalization Program, and,
RESOLVED, that the Board of Trustees APPROVES the application of MATT-A-MAR
MARINA, LLC to expand the existing boat storage building, demolish the existing office
and relocate office, replace the sanitary system and install a drainage system, and as
depicted on the site plan prepared by East End Design Assoc., LLC last dated January
25, 2006.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of $50~00 per inspection. (See attached schedule.)

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code
and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the
LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my
recommendation that the proposed action is CONSISTENT with the following LWRP Policies and therefore is
CONSISTENT with the LWRP.
The proposed action is located in Mattituck Creelq recognized by the State as a Regional Maritime Center and zoned as
Marine Zone H in the Town of Southold. The intent of policy 10 as referenced below is to protect existing water-
dependent commercial~ industrial~ and recreational uses and to enhance the economic viability of water-dependent
by ensuring adequate provision of infrastructure for water-dependent uses and their efficient operation.
Policy 10 Protect Southold's water-dependent uses and promote siting of new waterdependent uses in suitable locations.
Policy Standards
10.1 (b) Improve the economic viability of water-dependent uses by allowing for non-water dependent accessory and
multiple uses, particularly water enhanced and maritime support services where sufficient upland exists.
The term water-enhanced use means a use or activity which does not require a location adjacent to coastal waters, but whose
location on the waterfront adds to the public use and enjoyment of the waters edge. Water-enhanced uses are primarily
recreational, cultural, retail, or entertainment in nature. These uses may be necessary for the successful financial operation and
viability of water-dependent uses.
(Table # 1) The following water-dependent is permitted.

use: office for the sale of marine equipment or products, dockside facilities for dispensing of fuel and where pumpout stations
are provided, restroom and laundry facilities to serve overnight patrons.

Maritime activity in Southold traumunaily has been e arbors, inlc,s and creeks. As noted earlier in
Policy 10, Policy I promotes a continuation of this traditional pattern of maritime activity, supporting the economic
basen maintaining the maritime character of the Town, and avoiding disturbance of the remaining natural shoreline and
water areas. It also recognized that Mattituck Inlet and Creelq identified by the state as a regional Maritime Center,
Mill Creek and the Village of Grecnport are the primary focus of maritime activity within the Town of Southold.
Policy 1 Foster a pattern of development in the Town of Southoid that enhances community character, preserves open
space, makes efficient use of infrastructure, makes beneficial use of a coastal location, and minimizes adverse effects of
development.
The policy is intended to foster a development pattern that provides for beneficial use of the environmental, historical, and
cultural coastal resources of the Town of Southold while maintaining and building on its traditional economic base. The
primary components of the desired development pattern are: strengthening the hamlets as centers of activity, maintaining a clear
sense of separation between hamlet centers and the countryside, encouraging waterdependent uses to concentrate in existing
locations of maritime activity, enhancing stable residential areas, and preserving agriculture, open space and environmentally
sensitive coastal resources. Development that does not reinforce the traditional land use pattern of the Town of Southold would
result in a loss of the community and landscape character of Southold.
If the action is approved the following best management practices (BMP's) are recommended:
1. Maximize a permeable buffer landward of the existing retaining wall, running parallel to the entire seaward side
of the existing and proposed boat storage building.
Currently there is a gravel road structure between the existing boat storage building and adiacent wetlands (the
adiacent wetlands are approximately within 65 feet of the existin~ and proposed boat storage building).
2. The placement of erosion control structures during construction such as silt fence and hay bales.
The site plan provided does not include any such erosion control measures.
The BMP's as reference above will further advance Policy 5~ Protect and Improve water quality in the Town Southold
and sub-policy 6.3 D and E as outlined below.
6.3 Protect and restore tidal and freshwater wetlands.
In addition to protecting and improving the Town's wetlands, adjacent lands that provide buffers to wetlands must be
maintained and enhanced, and where appropriate, reestablished. These buffers are necessary to ensure the long term viability of
the Town's wetlands. Where these lands are in private ownership, educating residential owners as to the long-term benefits of
compatible land use and landscaping techniques will be essential to maintaining the ecological health of wetland areas.
D. Provide adequate buffers between wetlands and adjacent or nearby uses and activities in order to ensure protection of the
wetland's character, quality, values, and functions.
E. Maintain buffers to ensure that adverse effects of adjacent or nearby development are avoided.

LWRP CONSISTENCY ASSESSMENT FORM
A. INSTRUCTIONS
1. All applicants for permits* including Town of Southold agencies, shall
complete this CCAF for proposed actions that are subject to the Town of
southold waterfront consistency Review Law. This assessment is intended to
supplement other information used by a Town of southold agency in making a
determination of consistency. *Except minor exempt actions including
Building Permits and other ministerial permits not located within'the
Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of this form
should review the exempt minor action list, policies and explanations of
each policy contained in the Town of Southold Local waterfront
Revitalization Program. A proposed action will be evaluated as to its
significant beneficial and adverse effects upon the coastal area (which
includes all of Southold Town).
3. If any question in Section C on this form is answered "yes", then the
proposed action may affect the achievement of the LWRP policy standards and
conditions contained in the consistency review law. Thus, the action should
be analyzed in more detail and, if necessary, modified prior to making a
determination that it is consistent to the maximum extent practicable with
the LWRP policy standards and conditions. If an action cannot be certified
as consistent with the LWRP policy standards and conditions, it shall not be
undertaken.
