Environmental Consulting, Inc., last dated September 9, 2010, and stamped approved on September 15, 2010. TERMS AND CONDITIONS The Permittee Martha Paul, residing at 930 West Cove Road, Cutcho~Ue, New York as part of the consideration for the issuance of the Permit does understand and prescribe to the following: That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Pennittee assumes full liability with respect thereto, to the complete exclusion of the Board of Trustees of the Town of Southold. That this Permit is valid for a period of 24 months, which is considered to be the estimated time required to complete the work involved, but should circumstances warrant, request for an extension may be made to the Board at a later date. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to maintain the structure or project involved, to provide evidence to anyone concerned that authorization was originally obtained. That the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application may be cause for revocation of this Permit by resolution of the said Board. That there will be no unreasonable interference with navigation as a result of the work herein authorized. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. That if future operations of the Town of Southold require the removal and/or alterations in. the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation, the said Permittee will be required, upon due notice, to remove or alter this work project herein stated without expenses to the Town of Southold. Environmental Consulting on behalf of MARTHA PAUL (NASSAU POINT CLUB PROPERTIES, INC.) applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated July 27, 2010, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator issued a recommendation that the application to resheath on the landward side 119' of timber bulkhead utilizing vinyl sheathing and replace wales as needed; to reconstruct in place 82' of retaining wall; construct 35' of new retaining wall; reconstruct an existing 3'x3' landing and 3~x5' stairs; and to remove existing 4'x4' platform, 3'x7' stairs and decks from the northem end of the preperbj be found Consistent with the Local Waterfront Revitalization Program policy standards, and, WHEREAS, the LWRP Coordinator recommended that the proposed application to reconstruct in-place a 14' timber groin be found Inconsistent with the LWRP, and, WHEREAS, the Board of Trustees has furthered the Local Waterfront Revitalization Program policies to the greatest extent possible through the imposition of the following Best Management Practice requirements: the existing 14' non-functioning timber groin is to be removed, that the existing lean-to is reconstructed no larger than 10'x15', the existing non-turf buffer is to remain non-turf, and any disturbed areas are to be replanted, and WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on August 18, 2010, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that for the mitigating factors and based upon the Best Management Practice requirement imposed above, the Board of Trustees deems the action to be Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5 of the Southold Town Code, and, RESOLVED, that the Board of Trustees APPROVES the application of MARTHA PAUL (NASSAU POINT CLUB PROPERTIES, INC.) to resheath on the landward side 119' of timber bulkhead utilizing vinyl sheathing and replace wales as needed; to reconstruct in place 82' of retaining wall; construct 35' of new retaining wall; reconstruct an existing 3'x3' landing and 3'x5' stairs; and to remove existing 4'x4' platform, 3'x7' stairs and decks from the northern end of the property; with the conditions that the existing 14' non-functioning timber groin is to be removed, that the existing lean-to is reconstructed no larger than 10'x15', the existing non-turf buffer is to remain non-turf, and any areas disturbed dudng construction are to be replanted; and as depicted on the site plan prepared by J.M.O. SCTM#111-2-12 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP. The applicant also proposes to reconstruct in-place a 14' timber groin located on the north section of the property's beach, it is my recommendation that the proposed action is INCONSISTENT with the below Policy Standard and therefore is INCONSISTENT with the LWRP. Aerial photo interpretation indicates that the beach has suffered erosion (scouring) as a result of the bulkhead and the function of the groin is unknown. An engineers report is absent validating that the replacement of the groin would contribute to the re-nourishment and/or stabilization of the beach in the area. Use hard structural erosion protection measures for control of erosion only where: 4. Construction of a hard structure is the only practical design consideration and is essential to protecting the principal use. 5. The proposed hard structural erosion protection measures are: a. limited to the minimum scale necessary b. based on sound engineering practices 'It is recommended that if the applicant would like to proceed with the replacement of the groin, an engineers report addressing the groin field be submitted to the Board. In the event the action is approved (in part) the following best management practice is recommended. § 275-11. Construction and operation standards. A. General. The following standards are required for all operations within the jurisdiction of the Trustees: (2) Erosion control. Installation of an erosion control structure is necessary during any building, grading, landscaping or site work activity within Trustee jurisdiction. This structure may include, but is not limited to, installation of a silt fence, hay bales, wood chip berm and silt booms. The placement of the erosion control structure(s) shall be determined by the Trustees or their designee. All intertidal construction and excavation requires the installation of ~ silt boom that will retain all suspended sediments within the immediate proiect area. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. The project will not result in any negative impacts upon the desired development pattern of the Town of Southold. It is felt that this project is consistent with this policy. Policy #2 The project as proposed involves a minor mount of excavation in an area which was previously excavated when the existing bulkhead, tie-rod and deadmen were installed. This excavation shall not impact upon any existing archeological resource. The project will not negatively impact upon the preservation and retention of historic resources nor will it have any impacts upon resources that are significant to the coastal culture of the Long Island Sound. It is felt that this project is consistent with this policy. Policy #3 The resheathed structure Shall be built at the height of the existing structure and therefore there shall be no changes to the existing visual quality of the site. There shall be no impacts on the scenic resources of the Town of Southold. It is felt that this project is consistent with this policy. Policy #4 The project involves the resheathing of an existing bulkhead where adjacent properties are bulkheaded as well and the reconstruction of two timber groins The proposed reconstructed groins and the resheathed bulkhead has been designed using practical design consideration, it is based on sound engineering practices and has been limited to the minimum scale necessary. It is felt that this project is consistent with this policy. Policy #5 It is felt that this project is consistent with this policy for a number of reasons. The project does not involve any direct or indirect discharges that would cause any negative impacts upon water quality standards. There shall be no increase or decrease in the pi-l, dissolved oxygen or nutrients in Corey Creek and there shall be no increase in noxious odors at the site. There shall be no increase in negative health impacts such as pathogens, chemical contaminants or toxicity nor shall there be any negative aesthetic factors involved with the project. The project does not involve watershed development or the quantity or quality of potable water. Policy #6 The project as proposed should not have any negative impact upon the ecological quality of Southold Town. There shall be no negative impacts upon the adjacent areas of tidal wetlands by the destruction of habitat or significant impairment to the tolerance range of any species of fish or wildlife. The project should have no impact upon any vulnerable fish, wildlife, plant species or rare ecological communities. It is felt that this project is consistent with this policy. Policy #7 It is felt that this policy is not applicable to the project since the project does not involve any atmospheric deposition of pollutants. Policy #8 The project does involve the disposal of solid waste and debris (existing bulkhead and tierod/deadmen system) which will be tracked off site and properly disposed. There are no hazardous waste or toxic pollutants involved with the project. It is felt that this project is consistent with this policy. Policy #9 The project will have no impact upon adequate physical public access to coastal resources, shall not impact any public visual access to any lands or waters, involve the public interest in and use of lands and waters held in public trust or access of such areas. It is felt that this project is consistent with this policy. Policy # 10 The project as proposed shall have no impacts upon any existing water- dependent commercial, industrial or recreational uses of the Peconic Bays. It is felt that this project is consistent with this policy.
