Dear Ms. Denson:
The following action was taken by the Southold Town Board of Trustees on Wednesday
February 16, 2005:
RESOLVED, that the Southold Town Board of Trustees APPROVE the Amendment to
Permit # 5964 as follows:
The turf area along the Main Road will remain; it will be required to be a non-fertilization, non-
chemical area, within 100' of the water. No other turf on site.
The French drains around the building will capture all runoff and replace the original
requirement of gutters into drywells.
French drains will be installed along the west side of the property to capture runoff from the
parking lot, instead of regrading the parking lot.
And all else as required on the addendum to Permit # 5964, and as depicted on the site plan
approved by the Planning Department as surveyed by Joseph Fischetti and last dated February
18, 2005.
This is not a determination from any other agency.

The Board of Town Trustees took the following action during its regular meeting held on
Wednesday July 21,2004 regarding the above matter:
WHEREAS, John Costello on behalf of CAROL R. DENSON applied to the Southold
Town Trustees for a permit under the provisions of Chapter 97 of the Southold Town
Code, the Wetland Ordinance of the Town of Southold, application dated June 30, 2004
and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council for their findings and recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on July 21,2004, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 97 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approve the application of Costello Marine
Contracting Corp. on behalf of CAROL R. DENSON to construct an upper level on the
existing barge restaurant building with the following conditions:
1. No turf on site
2. Grade the parking lot away from the water
3. Gutters and drywells on the structure; keep all runoff out of the water

CONSERVATION ADVISORY COUNCIL

At the meeting of the Southold Town Conservation Advisory Council held Tuesday, July
13, 2004, the following recommendation was made:
Moved by Don Wilder, seconded by Bill Cook, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH

Request to reissue Permit # 5964
The Old Barge Restaurant, 750 Old Main Road, Southold
SCTM#56-6-8.7
This letter is to request that Permit # 5964 issued by the Board of Town Trustees on July
21, 2004, and amended February 16, 2005, be considered for reissue. The permit expired
July 2008.
In the interim, we were unable to obtain the requisite permits from the NYSDEC before
the Board of Town Trustees permit expired, because of drainage issues with the DEC.
(DEC required a drainage strategy that was different than the one approved by the
Planning Board).
The issues have been resolved and the NYSDEC approved our revised drainage plan and
issued a permit on January 19, 2010, (# 1-4738-01665/00003).
As a result, the site plan initially submitted to the Board of Town Trustees has been
modified in two important, environmentally enhanced ways, as noted below. The plans
for the second floor addition to the building have not been changed and remain the same
as those approved in Permit #5964
1. A French drain system will be installed throughout the existing parking lot.
2. Revegetation plan will be introduced along the upland side of the retaining wall.
The Board's advice is appreciated on how to proceed with obtaining a reissued permit.

The following resolution was adopted at a meeting of the Southold Town Planning
Board on Monday, March 14, 2005:
The final public hearing was closed.
WHEREAS, the applicant, Carol R. Denson, proposes the amended site plan for a
new second floor addition of 1,397 sq. ft. and an alteration to 3,923 sq. ft. of existing
building space on a 1.4438 acre parcel in the M-II Zone; and
WHEREAS, The C.D. Reiter Partnership is the owner of the property known as SCTM#
1000-56-6-8.7 located on the s/s/o Old Main Road, approximately 1,953' w/o Dolphin
Drive, known as 750 Old Main Road, in Southold; and
WHEREAS, on November 7, 2003, a formal site plan application was submitted for
approval; and
WHEREAS, on January 13, 2004, the Southold Town Planning Board, acting under the
State Environmental Quality Review Act (6 NYCRR), Part 617.6, performed a review of
this unlisted action, and as lead agency, made a determination of non-significance and
granted a Negative Declaration; and
WHEREAS, on May 12, 2004, the Suffolk County Department of Health Services
approved the site plan prepared and certified by Robert Brown, dated November 5,
2003 and last revised April 9, 2004, under Reference Number C10-04-001; and

WHEREAS, on May 14, 2004, the New York State Department of Transportation
reviewed the site plan and assigned the Case Number 04-123PP and indicated no
Highway Work Permit is required and the Planning Board has accepted this
recommendation; and
WHEREAS, on August 3, 2004, the Architectural Review Committee reviewed and
approved the architectural drawings, associated site plan materials and the Planning
Board has accepted this approval and determined it to be satisfactory; and
WHEREAS, on February 3, 2005, the Southold Town Zoning Board of Appeals granted
Special Exception approval as described under Appeal Number 5626 and the Planning
Board has accepted this approval; and
WHEREAS, on February 18, 2005, the Southold Town Building Inspector reviewed and
certified the site plan for "Restaurant" use by Special Exception; and
WHEREAS, on March 7, 2005, the Southold Town Trustees approved an amendment to
Permit Number 5964, issued on July 21,2004, and the Planning Board has accepted
this approval; and
WHEREAS, on March 8, 2005, the Southold Town Engineering Inspector reviewed and
approved the proposed drainage with conditions and the Planning Board has accepted
his recommendation; and
WHEREAS, on March 11,2005, the Southold Fire District recommended that fire
protection is adequate and the Planning Board has accepted this recommendation; and
WHEREAS, the Southold Town Planning Board, pursuant to Chapter 58, Notice of
Public Hearing, has received affidavits that the applicant has complied with the
notification provisions; and
WHEREAS, the following two items are incorporated and included in the site plan:
1. All outdoor lighting shall be shielded so that the light source is not visible from
adjacent properties and roadways. Lighting fixtures shall focus and direct the
light in such a manner as to contain the light and glare within property
boundaries. The lighting must meet the Town Code requirements.
2. All signs shall meet Southold Town Zoning Codes and shall be subject to
approval of the Southold Town Building Inspector; and
WHEREAS, all the requirements of the Site Plan Regulations of the Town of Southold
have been met; be it therefore

RESOLVED, that the Southold Town Planning Board grant final approval on the site
plan prepared and certified by Robert I. Brown, Licensed Architect, dated November 5,

permit.

This is in response to your letter addressed to Bruno Semon, Senior Site Plan Reviewer,
dated April 19, 2004, and to request an extension for the wavier granted in your letter
dated April 23, 1998 for the subject site plan.
In 1998 the Southold Town Board of Trustecs issued a waiver to add a mezzanine (upper
level) to the existing Old Barge Restaurant. A copy of that letter is enclosed. I have been
actively working since that time to obtain a building permit to proceed with the project.
Regrettably, I have encountered a number of delays and have not been able to move
forward in a timely manner.
When I began working on this project, I worked with an architect from Delaware whose
work I know well, and who is also licensed in New York. I am now working with a local
North Fork architect, a local structural engineer, and a local marine contractor to develop
a building plan that is in compliance with the new codes. Consequently, an amended site
plan has been submitted to the Southold Town Planning Department that includes a
modification to the shape of the upper level. Also the seating capacity of the structure
has been reduced by one (1) seat, a small retail space has been created in the lower level,
and two (2) parking spaces have been added. All proposed changes remain within the
same footprint of the existing structure.
Permits obtained from the Suffolk County Department of Health Services and the DEC
are current.

FULL ENVIRONMENTAL ASSESSMENT FORM
Purpose: The full EAF is designed to he(p applicants and agencies determine, in an orderly manner, whether a project or action may
be significant. The question of whether an action may be significant is not always easy to answer. Frequently, there are aspects of
a project that are subjective or unmeasurable. It is also understood that those who determine significance may have little or no formal
knowledge of the environment or may not be technically expert in environmental analysis. In addition, many who have knowledge

The New York State Department of Environmental Conservation responded on
November 14, 2003 and has no objection to the Town of Southoid Planning Board
Office assuming lead agency status for this action.
The New York State Department of Transportation responded on November 17, 2003
and has no objection to the Planning Board's wishes to assume SEQR lead agency
status.
The Suffolk County Planning Commission responded on November 28, 2003 and has
no objection to the Town of Southold assuming lead agency.
The Departmer~t'of Health Services Office responded on December 9, 2003 and has no
objection to the Town's designation as lead agency. The department wishes, however,
to reserve its right to provide more detailed information within the comment period(s)

The following action was taken by the Southold Town Trustees on
Wednesday, April 22, 1998, at their Regular Meeting:
RESOLVED, that the Southold Town Board of Trustees grant a
Waiver to add a mezzanine area on top of existing Barge
Restaurant, changing roof line, but staying in the same foot
print. Runoff will be directed to existing drywells. Plans dated
as received April 10, 1998. Located Rt. 25, Southold.
However, this approval does not constitute approvals from any
other agency.
