Approved site plans are valid for three years from the date of approval, within which time all proposed work must be completed, unless the Planning Board grants an extension. 4. Any changes from the approved site plan shall require Planning Board approval. 5. Prior to the issuance of a Certificate of Occupancy, the Planning Board or its representative must inspect the site to ensure it is in conformity with the approved site plan and issue a final site inspection approval letter. Should the site be found not in conformance with the approved site plan, no Certificate of Occupancy may be issued unless the Planning Board approves the changes to the plan. A copy of the approved site plan is enclosed for your records. One copy will also be sent to the Building Department and the Town Engineer. Please consider the following: 1. In a letter from the applicant, it has been noted that the original drainage design did not meet the minimum requirements necessary for DEC approval. The current drainage design that has been submitted for review has been revised to meet these additional DEC requirements. At this time, I do not have a copy of this DEC permit to review. However,this current plan submitted by the applicant meets the minimum requirements of Town Code Chapter 236 for Storm Water Management. I would recommend that a copy of the DEC Permit be obtained an incorporated into the permanent record and/or Planning Board file. 2. The applicant should be instructed to notify the Town when the proposed regarding, drainage and/or Site Work is under construction. Visual inspections by the Town or a certified Engineering report will be the only verification that the work has been completed satisfactorily. 3. The Applicants letter also referenced Planning Board Approval of the proposed second floor addition to the facility. This approval for the construction of a new second story must come from a Building Department review based on the Building Code of the State of New York. This application is for a permit to construct an upper level addition to the existing restaurant building located at 750 Old Main Road, Southold. On July 21, 2004, the Board of Town Trustees had issued a permit, # 5964, for this upper level construction. That permit expired July 2008. In the interim, we were unable to obtain the requisite permits from the NYSDEC before the Board of Town Trustees permit expired, because of drainage issues with the NYDEC. NYDEC required a drainage strategy that was different than the one approved by the Planning Board. The issues have been resolved. The NYSDEC approved our revised drainage plan and issued a permit on January 19, 2010, (#1-4738-01665/00003). 0 0 As a result, the site plan initially submitted to the Board of Town Trustees has been modified in two important, environmentally enhanced ways, as noted below. 1. A Grading and Drainage plan that includes a French drain system will be installed throughout the existing parking lot. 2. Revegetation plan that consists of a 25 foot buffer zone created with plantings of native grasses and shrubs along the landward side of the retaining wall.
