(631) 765-1809 Fax(631) 765-9064 FINDINGS, DELIBERATIONS AND DETERMINATION MEETING DATE: OCTOBER 22, 2009 ZBA#6322: RICHARD EHRLICH, Applicant Property Location: 64755 Main Road, Greenport CTM Parcel: 1000-56-4-22 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Unlisted Action category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated July 31, 2009 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. PROPERTY FACTS/DESCRIPTION: The applicant's property is situated in the Marine M-II Zone District with +/- 300 feet fronting along the Main Road and is improved with a single-story framed tavern building shown on the November 19, 1986 survey by Roderick Van Tuyl, P.C. BASIS OF APPLICATION: Request for a Special Exception for Restaurant Use in an existing builtfing under Town Zoning Code Section 280-55-B(1). ADDITIONAL. INFORMATION: The existing building has been a restaurant since 1969 and describer) on the 1986 survey by Roderick VanTuyl and the Building Department records as a tavern. In 1985 the building was renovated and expanded and received a site plan reylew and approval from the Planning Board on May 10, 1985 and a Certificate ofiOccupancy (No. Z14501) from the Town Building Department and approval by the Suffolk County Department of Health. In 1994 the zoning map was amended and the propertyovas re-zoned from B General Business to Marine M-ll. A Restaurant is a permitted use by Special Exception in the Marine M-ll Zone. Because the restaurant operations were discontinued and the building vacated, the pre-existing, as of right restaurant us.$ was discontinued and the building fell into disrepair. A special exception permit is required to re-open the restaurant. Written comments were received by the Board of Apoeals on August 18, 2009 from Martin Sidor, Chairman of the Planning Board regarding this application and confirming the 1985 site plan approval for the use `i . Page 2—Octdber 221,99 • ZBA#6322- RICHARD EHRLICH Property Location: 64755 Main Road, Greenport CTM Parcel: 1000-56-4-22 as a restaurant. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on October 1, 2009 at which time written and oral evidence was presented. Based upon all testimony, documentation, personal inspection of the property and the area, and other evidence, the Zoning Board finds the following facts to be true and relevant REASONS FOR BOARD ACTION: After review of the requirements set forth pursuant to Chapter 280 -55-B1 governing restaurant uses by Special Exception review, and on the basis of testimony presented and personal inspection, the Board finds: 1. A restaurant is a permitted use in this Marine M-ll Zone under Section 280-55-B(1) of the Town Zoning Code, subject to special exception authorization of the Zoning Board of Appeals. lh this review the Board determines that a restaurant use is in harmony with the zoning ordinance and will not adversely affect the neighborhood when meeting the code requirements. 2. In addition, the Board has reviewed the General Standards governing Special Exception uses set forth in Section 280-142 and finds that: €r, A) The use of the property as a restaurant in the proposed renovated building will not prevent the orderly and reasonable use in this zone district and adjacent districts. B) This use will not prevent orderly and reasonable use of permitted or legally established Uses in this zone district or adjacent use district. c C) The safety, health, welfare, comfort, convenience, and the order of the town will not be adversely affected by the proposed use and its location. D) Thi use will be in harmony with and will promote the general purposes and intent of the bode. E) The use is compatible with its surroundings and with the character of the neighborhood and of the community in general, particularly with regarding to visibility, scale and ovdrall appearance. F) The structures, equipment and material will be accessible for emergency protection. ie: r RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Weisman, sexonded by Chairman Goehringer, and duly carried, to i. ,t o, Page 3—Octdber 22*9 ZBA#6322-RICHARD EHRLICH Property Location: 64755 Main Road, Greenport CTM Parcel: 1000-56-4-22 GRANT the Special Exception for a Restaurant Use, as applied for, SUBJECT TO THE FOLLOWING CONDITIONS: 1.
