Penney, III PROPERTY LOCATION: 46520 CR 48 and Youngs Ave., Southold, NY ou o dTown Clerk SCTM 1000-55-5-2.2 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated August 10, 2010 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP: This application is not subject to review under Chapter 268 because the variance relief requested does not involve features that relate to a regulated natural feature or a bulkhead or other shoreline. PROPERTY FACTS/DESCRIPTION: The Applicant's property is a conforming 65,179 sq. ft. parcel in the General Business B Zone. The northerly lot line measures 211.75 feet along CR 48 with an additional 162.01 feet continuing as an arch shape road frontage along the intersection of CR 48 and Youngs Ave. The easterly lot line measures 136.39 feet along Youngs Ave. The southerly lot line measures 285.17 feet along adjacent property within the Residential Office Zone, and the westerly lot line measures 208.10 feet along adjacent property within the Limited Business Zone. The property is currently improved with the Applicant's 3,870 sq. ft. commercial building, and also a 500+/- sq. ft. "as-built" shed as shown on the site survey drawn by S. L. Maresca Associates dated Dec 21, 2005, and last revised July 24, 2009. The property is currently used for the business known as Tidy Car. BASIS OF APPLICATION: The applicant is requesting an area variance based on the Building Inspector's revised August 5, 2009 Notice of Disapproval concerning an as-built accessory shed building in a location other than the code required rear yard. RELIEF REQUESTED: The applicant requests an area variance for an "as-built" shed located in a side yard, rather than in the rear yard as is required by Town Code. ADDITIONAL INFORMATION: The Applicant's site plan is subject to approval by the Southold Town Planning Board. In a Memo dated August 24, 2010 from Martin H. Sidor, Chairman of the Southold Town Planning Board, the Board recommends the following conditions on the variance applied for: 1. Products shall only be displayed within the designated areas described as "Display Area" & "Staging Area" shown on the approved site plan and Page 2 - October 7, 2010 ZBA File#6336 - Penney, III 2. That the ZBA reserves the right to hold a public hearing on due notice to consider rescinding the special exception, if it is determined the property owner is in violation of the above conditions. FIND1NGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held public hearings on this application on October 1, 2009, December 3, 2009, and August 26, 2010, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law l~267-b(31(b)(l). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The accessory structure is inconspicuously situated, in close proximity to rear half of the principal commercial building, creating a profile that is not particularly noticeable. 2. Town Law §267-b(3}(b~f2L The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The Applicant's property has two front yards, and this creates a major hardship when attempting to locate an accessory structure in the rear yard, which is the only location that would not require a variance. 3. Town Law §267-b(3)(b)(3). The variance granted herein is substantial considering that Town Code requires an accessory structure to be located in a rear yard. 4. Town Law §267-bl'3}(b'}(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The Applicant has submitted a landscape plan which, when completed, will improve the physical appearance of the site. 5. Town Law l~267-b(3}(b){5}. The difficulty has been self-created because the shed was built without a building permit or prior ZBA approval. 6. Town Law §267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a storage shed in its current location, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test u~der New York Town Law 267-B, motion was offered by Member Weisman (Chairperson), seconded by Member Schneider, and duly carried, to GRANT, the variance as applied for, as shown on the site survey drawn by S. L. Maresca Associates dated Dec. 21, 2005, last revised October 30, 2009 as per Southold Planning Board, and as shown on the landscape plan details submitted on Sept. 14, 2010, Conditions: 1. A certificate of occupancy for this as built shed shall not be granted until the applicant has complied with all requirements of the site plan and landscape plan approved by the Planning Board 2. Should the applicant fail to comply with the TOWN OF SOUTHOLD PLANNING BOARD conditions as stated in a Memo dated August 24, 2010 from Martin H. Sidor, Chairman of the Planning Board (see additional information in this decision), the ZBA reserves the right to hold a public hearing on due notice to consider rescinding the variance granted herein for the as built shed That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Please include how the inventory on site will diminish and provide the number of vehicles / trailers to be stored overall on-site and for proposed display and staging areas. Potential obstruction to vision shall not exceed a height of 2 ½ feet above the average street level with in an isosceles triangle having thirty-foot sides along each street to preserve sight lines for traffic.
