I am putting together the paperwork for the Sanger House Certificate of Occupancy - Permit #36390-Z I contacted the Town of Trustees to get the Trustees Certificate of Compliance and they told me that we needed to amend the permit to include at grade bluestone patio that was not included in the original plans. The patio was built by the owner without our knowledge or approval. Attached please find the amended site plan dwg. and photo to be submitted to the Board of Town of Trustees showing the new patio. I would like to verify with you if we need to amend the Building Dept. permit to reflect the new patio. The patio is a bluestone patio at grade on a stone dust bed. Please let me know how to proceed, so I can help the owner finalize the Certificate of Occupancy Application as soon as possible. Thanks so much for your assistance on this. That the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application may be cause for revocation of this Permit by resolution of the said Board. 5. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation, the said Permittee will be required, upon due notice, to remove or alter this work project herein stated without expenses to the Town of Southold. 8. That the said Board will be notified by the Permittee of the completion of the work authorized. 9. SCTM#10-3-19&20 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the LWRP review provided the following best management practices are required: Figure 1. If the action is approved, to further Policy 5: Protect and Improve Water Quality in the Town of Southold and Policy 6; Protect and Restore the Quality and Function of the Town of Southold Ecosystem it is recommended that a the existing "planted area" be extended to SCTM #1000.-10-3-19 to create a landscaped buffer landward from the edge of the bulkhead. A sample definition of a landscaped buffer is provided below for your use. LANDSCAPED BUFFER A land area of a certain length and width which is planted with indigenous, drought-tolerant vegetation (excluding turf) similar to that found within the immediate proximity of the parcel. Vegetation shall be installed in sufficient densities to achieve 95% ground cover within two years of installation. Survival of planted vegetation shall be 90% for a period of three years. Maintenance activities within the buffer are limited to removing vegetation which is hazardous to life and property, trimming tree limbs up to a height of 15 feet to maintain viewsheds, replanting of vegetation and establishing a four-foot-wide access path constructed of pervious material for access to the water body. Box 1179 Southold, NY 11971 Re: Application of Penn duPont Sanger and HOUSE57 LLC Dear Lauren: Further to and elaborating upon our telephone conference earlier today, I am writing to request that the Board of Trustees entertain a joint application from two adjoining property owners at the Peninsula on Fishers Island. In that regard, I have enclosed a Site Development Plan prepared by CME Associates Engineering. Land Surveying & Architecture, PLLC under date of February 10, 2010. As disclosed on the Plan and as your office is aware from prior correspondence and conferences with Kinlin Rutherfurd Architects, the proposed project involves the owner of SUM No. 1000-10-3-20 ("Lot 20"), Penn duPont Sanger, acquiring title to an adjoining parcel designated SCTM No. 1000-10-3-19 ("Lot 19") from the current owner of that parcel, HOUSE57 LLC. He would then merge the two parcels so as to form a single building site, demolish the existing house on Lot 19, remodel the existing house on Lot 20 and construct an addition to the remodeled house, part of which would be located on former Lot 19 in the area of the existing house on that Lot. A previous application for this project was returned to Kinlin Rutherfurd Architects by your office with the explanation that such application was premature in that the owner of Lot 20 did not then own and would not be the owner of Lot 19 during the application process. Your office and subsequently (I believe) the Town Attorney's office recommended that Mr. Sanger (the owner of Lot 20) acquire title to Lot 19 and effect the merger of the two parcels prior to proceeding with his application. Neitherthe prospective applicant nor his architectswere comfortablewith this Ms. Lauren Standish Page 2 June 1, 2010 recommendation because it required him to bear the risk of purchasing a property that would be of no use to him if his application were denied or approved but burdened with unsatisfactory conditions. Moreover, it would have entailed the merger into a single building site of two lawful preexisting nonconforming lots and dwellings which could not have subsequently been re-separated without relief from the Zoning Board and perhaps the Planning Board, a result that would be acceptable only if a satisfactory permit was granted. When your office was asked to consider the application upon delivery of a written consent from the owner of Lot 19, the Town Attorney apparently still advised you that it would be premature for it to be processed. In my more than twenty-five years of experience in dealing with zoning and planning matters, I have often assisted clients in applying for permits, variances and the like before they were owners of the property for which they were seeking approval or relief. For example, a contract vendee would have standing to apply for a variance affecting the property he or she had agreed to purchase, typically with the current owner having to give consent. With that premise stated, I would propose the following solution which should address the Trustees' concerns about entertaining applications from parties with no standing while at the same time protecting the owner of Lot 20 from undue risk in the event of an unsatisfactory outcome. The owner of Lot 20 will enter into a contract with the owner of Lot 19 to purchase Lot 19 from that owner. The contract will be subject to the issuance by the Board of Trustees of a permit approving the project substantially (but not precisely) as proposed on the enclosed plan. Pursuant to that contract, the parties would make a joint application to the Board of Trustees for the requisite approval. If the project is approved by your Board, it could impose a condition to the effect that no work could commence unless and until title to Lot 19 was transferred to common ownership with Lot 20 and the two parcels were merged by deed and by action of the Town Assessors Office. If necessary, those conditions could even be presented as part of the application as well as the resolution of approval. Please ask your Board (and the Town Attorney if deemed advisable) to consider this solution or to recommend other or further proposals for addressing the concerns of my client as well as those of your Board.
