Hello,
We have a house in Mattituck. We pay for the annual Town of Southold parking permit.
We go to the Third Beach (The Bluffs) at the end of Sound Beach. Dr.
We are asking for your help. Following are a few facts that you should be aware of:
There are at least 2 houses whose residents (renters?) drive ATVs on the beach
. I
was told other residents have already notified the Trustees of the people's names in order
to be informed and, if permitted, fined. I understand nothing has happened so far.
Aside from the fact that it is inconsiderate to slalom among people lying in the sun in
order to drive the ATV and leave a plume of exhaust fumes behind you, it is also
dangerous: this past weekend, 3 very young girls were driving a yellow ATV and, in the
middle of giggling and laughing, they veered toward a beach chair and an umbrella.
There was a person sitting in the chair. Luckily, they stopped before ramming into the
chair. I looked for a licence plate on the ATV but there was none.
It seems that Mondays are the worst: ATVs coming from as far as Riverhead race on this
beach.
Please inform me as to what the rules are regarding ATVs or driving anything on the
beach. Keep in mind that (some of) these are unregistered/ unlicensed vehicles.
Since it is a private beach, can signs be posted on the beach? Who can post them? Can a
fence be drawn on the private portion of the beach?
On the same note, please let me know what the rules are regarding driving jet skis close
to the bathers. Can signs be posted? Who can post them?
There still is (or was) a sign banning beach fires
, posted in the beach parking lot.
Needless to say, beach fires go on every night. Aside from burnt wood which, sometimes,
comes from fences and still has rusty nails in it, we find beer bottles, beer cans, soda
cans, various food wrappings and worse.

Is there any way of enforcing the sign? Who is supposed to enforce it?
There are cars without the permit sticker, that stay parked in the beach parking lot.
The law-abiding residents must park in the street. When we draw their attention on the
fact that you need a permit to park there, they laugh in our faces.

The sign has been removed, so there is no technical ground for
fining the no-sticker cars.

Who is supposed to replace the sign?
Unless the authorities intervene, there is no way we can stop the ATVs zooming past us
while we try to relax after a work week and breathe fresh air. The houses of the persons
who have/ drive the ATVs are NOT located on the 'bluff' portion of the Third Beach.
They have quite a good strip they can use for ATV driving, if they want.
We kindly ask they be restricted to their portion of the beach and leave us all in peace.
We kindly ask to be informed of what the authorities can do and of what we, as residents,
can do to prevent erosion and destruction of this beach, and preserve our relaxation spot
for which we pay. Together with residents of the houses on the bluffs, we are willing to
pay for signage or fences, if such actions are within our rights. Please confirm.
We kindly ask for more frequent police or boat patrols to remind everyone that there are
rules that can and will be enforced.
