Dear Mr. Catera:
The Board of Trustees reviewed your request dated September 7, 2010 and determined
the installation of new or replacement windows, roof shingles, doors, dormers and siding
on existing structures does not require a permit in accordance with Chapter 275-4
Exceptions of the Town Wetland Code.
Please be advised, however, that no construction, sedimentation, or disturbance of any
kind may take place seaward of the tidal and/or freshwater wetlands jurisdictional
boundary or seaward of the coastal erosion hazard ama as indicated above, or within
100' landward from the top of the bluff and/or wetlands jurisdictional boundary, without
further authorization from the Southold Town Board of Trustees pursuant to Chapter 275
and/or Chapter 111 of the Town Code. It is your responsibility to ensure that all
necessary best management practices are taken to prevent any sedimentation or other
alteration or disturbance to the ground surface or vegetation within Tidal Wetlands
jurisdiction and Coastal Erosion Hazard Area, which may result from your project.
This determination is not a determination from any other agency.

Letter of Non-Jurisdiction
To Whom It May Concern,
I am writing to request a letter of Non-Jurisdiction for an 'in-kind' window replacement
at the above referenced property. Based on my conversations with both the building
department and your office, I believe that the scope of work that we are proposing falls
outside of the jurisdiction of the Town Trustees.
At the said residence we are proposing to replace twenty six (26) existing Pella
windows and six (6) Pella exterior doors in like size, style and configuration with new
impact resistant windows manufactured by Marvin Integrity. Many of the existing Pella
windows are currently failing and leak water into the residence whenever the
combination of windy/rainy conditions exists.
Given the change in manufacturer, the replacement sizes are not exact. We have
proposed the closest sized unit to the existing unit size, where in there is not more than
two (2) inches of deviation in either direction from existing to proposed. I have
attached a copy of the survey as well as elevations of the existing house identifying the
units for which we are proposing replacement.
