BETWEEN
KENNETH P. CHILDS, JR. residing at 605 Old Dutch Road, Bedminster, New Jersey,
07921, as Executor of the Last Will and Testament of the late KATHRYN B. CHILDS,
late of Suffolk County, New York, who died on March 28, 2009, party of the first part, and
KATHRYN P. CHILDS, individually, residing at 530 Valley Road, Apt. M 1, Montclair,
New Jersey, 07043, and KENNETH P. CHILDS, JR., as Trustee of The Laurel
Property Trust dated June 24, 2010, residing at 605 Old Dutch Road, Bedminster, New
Jersey, 07921, as Tenants in Common, party of the second part
Witnesseth, that the party of the first part, to whom Letters Testamentary
were issued by the Surrogate's Court, Suffolk County, New York on June 1,2009
under File # 764 P 2009, and by virtue of the power and authority given in and by
said Last Will and Testament, and/or by Article 11 of Estates, Powers and Trusts
Law, and in consideration of $10.00 (Ten Dollars), paid by the party of the second
part, does hereby grant and release unto the party of the second part, the
distributees or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with buildings and improvements thereon
erected, situate, lying and being at Laurel, in the Town of Southold, County of Suffolk and
State of New York, known and designated as and by the Lot Numbers 3 and 4 on a certain
Map entitled "Map of Laurel Park, property of Ravatone Realty Corporation, Laurel, L.I.,
N.Y.", surveyed and subdivided by Daniel R. Young, Engineer and Land Surveyor,
Riverhead, L.I., N.Y., August 17~h, 1925, and filed in the Office of the Clerk of the County
of Suffolk on ihe 5o' day of October, 1925, as Map No. 212, together with all the right,
title and interest of the party of the first part in and to that .portion of the road shown on
said Map in front of and adjacent to said premises to the center line thereof, subject to the
right of other owners of lots on said map to pass over and use the same, and expressly
reserving to the party of the first part the right to the use of the streets, avenues or roads
shown on said Map for the purposes of laying and maintaining gas or electric lights and
water mains, stringing electric lights, telegraph and telephone wires or to make any
improvements on said streets, avenues or roads.
BEING AND INTENDED TO BE the same premises conveyed to Kathryn Childs by
deed dated February 23, 2005 and recorded in the Suffolk County Clerk's Office on April
25,2005 in Liher D00012383 at page 941.
PREMISES also known as 530 South Oakwood Drive, Laurel, New York.
Together with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above-described premises to the center lines thereof;
Together with the appurtenances and all the estate and rights of the party of the first part in
and to said premises;
To have and to hold the premises herein granted unto the party of the second part, the heirs
or successors and assigns of the party of the second part forever.
And the party of the first part covenants that the party of the first part has not done or
suffered anything whereby the said premises have been encumbered in any way whatever,
except as aforesaid.
And the party of the first part, in compliance with Section 13 of the Lien Law, covenants
that the party of the first part will receive the consideration for this conveyance and will
hold the right to receive such consideration as a trust fund to be applied first for the
purpose of paying the cost of improvement and will apply the same first to the payment of
the cost of the improvement before using any part of the total of the same for any other
purpose. The word "party" shall be construed as if it read "parties" whenever the sense of
this indenture so requires.
