QUITCLAIM DEED
This Indenture, made the 7th day of January, Two
Thousand and Ten,
BETWEEN
ROBERT JOSEPH KAR, residing at 3806 Tarawood Court,
Spring, Texas 77388,
party of the first part; and
THE ROBERT J. KAR IRREVOCABLE TRUST, under agreement
dated January 7, 2010, Robert J. Kar, Jr., residing at
34 Plum Court, Islip, New York 11751, and Matthew P.
Kar, residing at 750 Little Peconic Bay Road, Cutchogue,
New York 11935, as Trustee;
party of the second part,
WITNESSETH, that the party of the first part, in
consideration of Ten Dollars and other valuable
consideration paid by the party of the second part, does
hereby grant and release quitclaim unto the party of the
second part, the heirs or successors and assigns of the
party of the second part forever, all of the party of
the first part's interest in
ALL that certain plot, piece or parcel of land, with
buildings and improvements thereon erected, situate,
lying and being at Laurel, in the Town of Southold,
County of Suffolk and State of New York, bounded and
described as follows:
BEGINNING at a point on the westerly line of land now or
formerly of Andrea B. Northington and George P. Busch,
distant 271 fee southerly, measured along said line,
from the southerly side of Peconic Bay Boulevard, and
adjoining land now or formerly of Emily T. Talmadge;
RUNNING THENCE in an easterly direction on a line at
right angles to the last mentioned course, 75 feet;
RUNNING THENCE southerly along the westerly line of a
strip of land reserved for a right of way and parallel
to the first described line, 90 feet;
RUNNING THENCE in a westerly direction on a line at
right angles to the last described course, 75 feet to
said land nor or formerly of Emily T. Talmadge;
RUNNING THENCE along said last described land, North 16
degrees 46 minutes 00 seconds West, 90 feet to the point
or place of BEGINNING.
TOGETHER with all right, title and interest of the party
of the first part of, in and to the westerly half of a
right of way lying immediately in front of and adjacent
to said premises on the easterly side thereof.
TOGETHER WITH AND SUBJECT TO an easement and right of
way as more particularly set forth and described in the
Deed to Gardner Fox and Lynda C. Fox, dated May 22,
1945, and recorded in the office of the Clerk of the
County of Suffolk on June 1945 in Liber 2459 of Deeds,
Page 25.
BEING AND INTENDED TO BE the same premises conveyed to
the Grantor by Deed dated December 7, 1990 and recorded
in the Suffolk County Clerk's Office on December 19,
1990 in Liber 11192 page 343, the Grantor being the same
person described as the Grantee in said Deed.
Together with all right, title and interest, if any, of
the party of the first part in and to any streets and
roads abutting the above-described premises to the
center lines thereof;
Together with the appurtenances and all the estate and
rights of the party of the first part in and to said
premises;
To have and to hold the premises herein granted unto the
party of the second part, the heirs or successors and
assigns of the party of the second part forever.
And the party of the first part covenants that the party
of the first part has not done or suffered anything
whereby the said premises have been encumbered in any
way whatever, except as aforesaid.
And the party of the first part, in compliance with
Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this
conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for
the purpose of paying the cost of improvement and will
apply the same first to the payment of the cost of the
improvement before using any part of the total of the
same for any other purpose. The word "party" shall be
construed as if it read "parties" whenever the sense of
this indenture so requires.
In Witness Whereof, the party of the first part has duly
executed this Deed the day and year first above written.
