THIS INDENTURE, made the 24m day of June, Two Thousand Ten
BETWEEN
VICTORIA HEANEY, as surviving tenant by the entirety, residing at 43 Washington Avenue,
Greenport, New York 11944,
party of the first part, and
MICHAEL A. HEXNEY, residing at 10 Tracy Terrace, Brockport, New York 14420,
JOANNE E. HEANEY, residing at 814 Plum Street S.W., Vienna, Virginia 22180, and
BERNADETTE M. CRIMI, residing at 90 North Green Dolphin Drive, Cape Haze, Florida
33946,
party of the second part,
WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable
consideration 'paid by the party of the second part, does hereby grant and release unto the party of
the second part, the heirs or successors and assigns of the party of the second part forever,
ALL THAT CERTAIN plot, piece or parcel of land, with the buildings thereon erected, situate,
lying and being in the Village of Greenport, Town of Southold, County of Suffolk and State of
New York, known and designated as Lot No. 59 on "Map of Washington Heights, situate at
Greenport, N.Y.", which said map is made by Otto W. Van Tuyl, dated December 29, 1927, and
is on file in the Office of the Clerk of Suffolk County as Map No. 651.
Said lot is bounded on the north by Washington Avenue, easterly by Lot No. 60, westerly by Lot
No. 58, and southerly partly by land now or formerly of Irving C. Wells and partly by land now
or formerly of the Village of Gmenport.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part and
Joseph Heaney by deed dated June 10, 1960 and recorded on June 27, 1960 in the Office of the
Suffolk County Clerk in Liber 4831, Page 141, by deed dated June 17, 1960 and recorded on
June 27, 1960 in the Office of the Suffolk County Clerk in Liber 4831, Page 143, and by ~e'~d
dated June 21, 1960 and recorded on June 27, 1960 in the Office of the Suffolk County Clerk in
Liber 4831, Page 190.
RESERVING, HOWEVER, a legal life estate in the above-described premises with the buildings
and improvements thereon erected, in and to the party of the first part.
THE PARTY OF THE FIRST PART HEREBY RESERVES A SPECIAL POWER OF
APPOINTMENT, exercisable as often as they may choose, to change their remainderman as
follows:
TO or among any one or more members of a class consisting of the party of the first part's
descendants, in any degree, whether presently living or born hereafter, in such proportions and
amounts, without regard to equality, outright or in trust, as the party of the first part may direct
and appoint during her lifetime by properly written and acknowledged instrument, and recorded
prior to death, making specific reference to this power of appointment. The party of the first part
may not appoint themselves, their estate, their creditors or the creditors of their estate, under any
cimumstances.
THIS DEED IS AN EXERCISE OF THE SPECIAL POWER OF APPOINTMENT
contained in a certain prior deed in respect to the above-described premises dated May 24,
2007, recorded in the Suffolk County Clerk's Office on August 20, 2007, in Liber 12518,
Page 831; and it is further stated that the party of the first part continues to reserve a
special power of appointment as hereinabove set forth.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof; TOGETHER
with the appurtenances and all the estate and rights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that
the party of the first part will receive the consideration for this conveyance and will hold the right
to receive such consideration as a trust fund to be applied first for the purpose of paying the cost
of the improvement and will apply the same first to the payment of the cost of the improvement
before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
