the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and
assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and
being in the

TOGETHER with all right, title and interest, if any, of the party of the first part, in and to any streets and roads
abutting the above-described premises to the center lines thereof; TOGETHER with the appurtenances and all the
estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein
granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby
the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part. in compliance with Section 13 of the Lien Law, covenants that the party of the
first part will receive the consideration for this conveyance and will hold the right to receive such consider-
ation as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.

SCHEDULE 'A'
ALL that certain plot, piece or parcel of land, with the buildings and
improvements thereon erected, situate, lying and being at Mattituck, in the Town
of Southold, County of Suffolk, State of New York, bounded and described as
follows:
BEGINNING at a concrete monument set on the southerly line of a certain 30
foot right of way running easterly and westerly at a point on said line 302.0 feet
westerly from the westerly line of a 25 foot right of way established by an
agreement between Reeve, Tilly and Hollister, and recorded in the Office of the
Clerk of Suffolk County in Liber 629 of Deeds at Page 168 on the 5th day of
September 1907 (Reeve Avenue), said point of beginning being the northwesterly
comer of land of Peter Gray;
RUNNING THENCE along said land of Peter Gray, south 3 degrees 40 minutes
30 seconds east, 151.0 feet to a bulkhead line at ordinary high water line of Great
Peconic Bay;
THENCE westerly along said ordinary high water line south 75 degrees 03
minutes west, 59.64 feet to land of Brookfield Home Improvement Corp.;
THENCE along said land of Brookfield Home Improvement Corp., north 3
degrees 19 minutes 10 seconds west, 145.6 feet to a concrete monument set on the
southerly line of said 30 feet right of way;
THENCE along said line of said 30 foot right of way, north 70 degrees 00
minutes east 60.0 feet to the point of BEGINNING
TOGETHER with a right of way over a strip of land thirty (30) feet wide, the
southerly line of which beginning at the northwest comer of the land herein
described runs on a course north 70 degrees 00 minutes east to the northeasterly
corner of the land heretofore mentioned as conveyed to Bryant S. Conklin and;
THENCE northward over another right of way twenty-five (25) feet wide
extending northerly from the southerly side of the first right of way to New
Suffolk Avenue, hereinbefore described;
-continued-
TOGETHER with all the land lying between the east and west boundary lines
extended from the bulkhead line to the high water mark of Peconic Bay.
It is understood and agreed that the rights herein given under the last mentioned
right of way shall not extend south of the southerly line of the first described right
of way.
BEING AND INTENDED to be the same premises conveyed to the party of the
first part by deed dated 11/13/2003, recorded in the Office of the Clerk of the
County of Suffolk on 12/10/2003 in liber D00012289, page 061.
