BETWEEN
LYNNE WENTWORTH, as Executrix of the Last Will and Testament of Mildred Boyce who died
a resident of Suffolk County, New York on March 2, 2009 (File No. 629P2009 P 67161),
residing at 1135 Oaklawn Avenue, Southold, New York 11971, party of the first part, and
EMMANUEL ARETAKIS,
residing at 473 74t~ Street, Brooklyn, New York 11209, party of the second part, and
WITNESSETH, that the party of the first part, in consideration of Three Hundred Thirty Thousand and 00/100-
($330,000.00)-Dollars, and other good and valuable consideration paid by the party of the second part, does
hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of
the second part forever,
ALL that certain plot, piece or parcel of land, situate, lying and being in the Town of Southold, County of
Suffolk and State of New York, bounded and described as follows:
BEGINNING at a point located the following two courses and distances from the corner formed by the
intersection of the northerly side of Hortons Lane and the westerly side of Old North Road;
1. North 33 degrees 23 minutes 00 seconds East along the westerly side of Old North Road, 837.74 feet to
the northerly line or land now or formerly of the Village of Greenport;
2. North 42 degrees 46 minutes 40 seconds West along said last mentioned land, 1640.20 feet to the point or
place of Beginning;
RUNNING THENCE North 42 degrees 00 minutes 50 seconds West, along land now or formerly of Village of
Greenport, 890.61 feet to "Map of Northwood Estates", Map No. 5675;
THENCE along said last mentioned land the following two courses and distances:
1. North 45 degrees 47 minutes 50 seconds East, 222.71 feet;
2. North 39 degrees 47 minutes 10 seconds East, 47.97 feet to land now or formerly of A. Sepenoski;
THENCE along said last mentioned land the following two courses and distances:
1. South 42 degrees 00 minutes 50 seconds East, 887.37 feet;
2. South 44 degrees 02 minutes 50 seconds West, 270.(~4' feet to the point or place of BEGINNING.
TOGETHER with a right of way to said premises over and along the west side of landformerly of Michael
McCabe; -'
SUBJECT, however, to a right of way along the southerly line of the premises hereby conveyed for the owners
of the remaining two-thirds of said woodland formerly belonging to said Lucrettia Glover.
TOGETHER with a twenty-five (25') foot wide right of way for ingress and egress along the easterly tine of Lot
8 of "Map of Northwood Estates at Southold" to Soundview Avenue, including installation of underground
utilities.
TOGETHER with all right, title and interest of the mortgagor in and to the land lying in the streets and roads in front
of and adjoining said premises;
BEING AND INTENDED TO BE the same premises as described in deed made by Mildred Bitses recorded
12/5/84 in Liber 9690 page 31.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all
the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the
premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of
the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the
first part will receive the consideration for this conveyance and will hold the right to receive such consideration
as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same
first to the payment of the cost of the improvement before using any part of the total of the same for any other
purpose. The word "party" shall be construed as if it read "parties" when ever the sense of this indenture so
requires.
