This Indenture, made the 24th day of February, Two
Thousand and Ten,
BETWEEN
GEORGE WESSELS and CAROL WESSELS, both residing
Hiawatha's Path, Southold, New York 11971;
party of the first part, and
at 1615
THE GEORGE H. WESSELS IRREVOCABLE TRUST, under agreement
dated February 24, 2010, Debora Nugent, residing at 4
Marsh Pond Lane, Monroe Connecticut 06468, as Trustee;
and THE CAROL M. WESSELS IRREVOCABLE TRUST, under
agreement dated February 24, 2010, Debora Nugent,
residing at 4 Marsh Pond Lane, Monroe Connecticut 06468,
as Trustee, to each a one-half interest in the premises;
party of the second part,
WITNESSETH, that the party of the first part, in
consideration of Ten Dollars and other valuable
consideration paid by the party of the second part, does
hereby grant and release quitclaim unto the party of the
second part, the heirs or successors and assigns of the
party of the second part forever, all of the party of
the first part's interest in
ALL that certain plot, piece or parcel of land, with
buildings and improvements thereon erected, situate,
lying and being in Laughing Waters, near Southold, Town
of Southold, County of Suffolk and State of New York,
bounded and described as follows:
BEGINNING at a point in the easterly line of
Hiawatha's Path 455 feet North from the point of
intersection of the northerly line of Nokomis Road and
the easterly line of Hiawatha's Path;
THENCE North 2 degrees 09 minutes West 76 feet by
and along the easterly line of Hiawatha's path to a
monument;
THENCE North 8 degrees 47 minutes West 29 feet to a
point;
THENCE easterly 132.93 feet more or less by and
along property now or formerly of Cedric H. Wickham to a
point;
THENCE South 6 degrees 28 minutes East 105 feet. by
and along property of St. Patrick Cemetery to a point,
THENCE South 86 degrees 18 minutes West by and
along property now or formerly of Cedric H. Wickham
137.73 feet to the point or place of BEGINNING.
TOGETHER WITH all the grantors right, title and
interest, if any, to the rights set forth in Liber 5418
cp 222.
BEING AND INTENDED TO BE the same premises conveyed to
the Grantor by Deed dated October 15, 2002 and recorded
in the Suffolk County Clerk's Office on October 28, 2002
in Liber D00012217 page 024, the Grantor being the same
person described as the Grantee in said Deed.
ITogether with all right, title and interest, if any, of
the party of the first part in and to any streets and
roads abutting the above-described premises to the
center lines thereof;
Together with the appurtenances and all the estate and
rights of the party of the first part in and to said
premises;
To have and to hold the premises herein granted unto the
party of the second part, the heirs or successors and
assigns of the party of the second part forever.
And the party of the first part covenants that the party
of the first part has not done or suffered anything
whereby the said premises have been encumbered in any
way whatever, except as aforesaid.
And the party of the first part, in compliance with
Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this
conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for
the purpose of paying the cost of improvement and will
apply the same first to the payment of the cost of the
improvement before using any part of the total of the
same for any other purpose. The word "party" shall be
construed as if it read "parties" whenever the sense of
this indenture so requires.
In Witness Whereof, the party of the first part has duly
executed this Deed the day and year first above written.
