¥~HEREA~, application has been made to the
undersigned by the town board of the town of Southold,
Suffolk County, New York, through its duly authorized
supervisor, pursuant to the prowielons of Chapter ~83
of the Laws of 195~, as last amended by Chapter ~91 of
the Laws of 1937, for permission to create a fire district
on Fishers Island to be known as Fishers Island Fire
District, the description of which is fully set forth on
the map which is attached hereto end made a part hereof.
WPIEREAS, no application has been received
from the board of supervisors of Suffolk County asking
that notice be given to such board of all appliceti~'.ns
for permission to erect or extend districts in towns in
Suffolk County.
NOW, upon reading and filing the report
of Robert B. Haner, Esq., Assistant Director of the
Bureau of Municipal Accounts, and the petition of the
town board datei October 21,,~ 19~8, and it appearing to
me that the creation of a firs district on Fishers Island
to be known as Fishers Island Fire District, is desirable,
that public interest will be served by the creation of such

fire dlstrtct, and that the cent of the same will not
be an undue burden upon the property ~lthin such proposed
dis triet.
I, MORRIS $. TREMAINE, Comptroller of the

fire district.

Petition contains the signatures of more than fifty
per centum of the o~ners and resident owners of
taxable real property in said proposed district,

the same, which are embraced in the l~Oposed district,
attached hereto and made a part hereof as 'Schedule A",
sho~lng all of said Special Districts. together with
the assessed valuation of each District and the sJnount
of taxes levied in each of said districts for all
purpose~ during the year ending December 31, 1.938.
Attached hereto ~uld made ~:, part thereof, ls
a certificate of the County Treasurer of the County
of Suffolk, State of New York, marked "Schedule B",
showing the payment of taxes in the area to be tn-
eluded in thc proposed district, during the three
years last past.
It is proposed to establish the Flmhers Isl~ud Fire
District in order to furnish protection a~alnst fire
to residents of the entire Island. The Island is
isolated so that in the event of ser~ou~ fire, it
would be almost impossible to secure aid fr~m the
mainland. The only boat connection with the mainland
m~kes a run of about nine miles to ~4ew London, and it
would be a difficult task to transport apparatus by
bo~t for such aid. The ffishers Inland Farms now
mlntalns fire apparatus for the protection of the
extensive properties of that corporation. It is now
proposed to extend the work of the fire department to
cover the entire Is]~nd. Yater under pressure
already carried to every part of the Island, so that
the district would have no hea~y initial cost in order
to extend protection to the entire Island..

The bonded indebtedness of the To~n of Southold
at the present time is ~25,600, which is represented
Iry bonds maturing at the rate of one $5,000 per year,
which bonds were t~sued and the indebtedness incurred
for the purpose of finanoin~ the To~n's portion of the
expense of a Grate lllgh=ay, Houte #25, and there is
a further indebtedness of the Town, due and owin~ by
said To~n of $~,600. evidenced by certificate of in-
debtedness issued for l~om~ Hellef in the Town of
Southold. ~at the total indebtedness of said
of $outhold at the d~te hereof, is the sum of~8,100.

I, the undersigned, being an owner of taxable real property of the proposed fire district here-
inafter described, do hereby petition your Honorable Board and aver as follows:
1. Your petitioner desires and proposes that the Town Board of the Town of Southold
establish a tiro district pursuant to the provisions of Section 171 of the Town Law of the State of
New York, embracing that portion of the Town of Southold which is contained within the follow-
lng boundaries:
All that real property on Fishers Island in the Town of Southold, County of Suffolk snd
State of New York, including the whole of Fishers Island, with the exception of certain parcels
which are the property of the United States Government, these tracts being known as the "Fort
H.G. Wright", "North Hill", "Prospect Hill" and the "United States Coast Guard Station No. 59"
reservations, all as shown on map accompanying this petition, said territory being bounded and
described as follows, viz: On the North by Fishers Island Sound; on the East and South by
Block Island Sound; on the West by "Fort H. G. Wright" reservation and Fishers Island Sound.
2. No part of the proposed fire district aforesaid is situated within an incorporated village
or city.
3. The territory embraced within the proposed fire district is without necessary fire pro-
tection excepting that provided and maintained by one property owner. Most of the buildings
and dwellings within the boundaries of said district are frame buildings, many of them near
together, and many of the buildings are large and very valuable so that without necessary fire
protection groat losses may be sustained by the inhabitants of said district in the event of fire.
4. The assessed valuation of all of the taxable real property of the proposed district, as
such valuations appear upon the latest complete assessment roll of the Town of Southold, is the

On formal Resolution of this Board, adopted
on October 4, 19~9, a Public Rearing, as required by

Article 11, Par. 171 of the Town Law, was duly
authorized and advertised; and
Whereas, Said Public Hearing was duly held at the Fishers
Island School Auditorium on October 19, o938, at 2 o'clock
P. M.; and
Whereas, At said Hearing there appeared only unanimous
demand for the erection of said proposed Fire District;
and
Whereas, A forlaal Petition was duly prepared and pre-
sented to the Comptroller of the State of New York,
pursuant to Section t, Chapter 683, of the La~s of
19~, as amended by Chapter ~91 of the Laws of
said Petition praying that the said Comptroller grant
his permission for the erection of the said Fishers
Island Fire District; and
Whereas, On January 28, 1939, said Comptroller of the
State of New York caused to be filed with the Town Clerk
of the Town of Southold his formal Order permitting the
erection of said Fishers Island Fire District; and
Whereas, The Southold Town Board, after due considera-
tion, believes that the erection of the said Dtstrlct
is in the public interest;
Therefore Be It Resolved: That pursuant to Article ll,
Paragraph l?l of the aTown Law, the Southold Town

Board hereby establishes and erects the Fishers Island
Fire District, as bounded and described above.
Be It Further Resolved: That pursuant to Article 11,
Paragraph 173 of the Town Law, the Town Clerk be and
hereby is authorized and empowered to file with the
Clerk of the County of Suffolk a certified copy of
this Resolution, together with a map of the Fishers
Island Fire District.
