Dear Mr. Cuddy:
We are in the process of deadfiling all applications on
file in our office which are no longer necessary under the new
Master Plan and which have been for some time inactive.
As you may know, the Marine I Zoning Regulations, Article
XII, Section 100-121A, as adopted by the Town Board on Janu-
ary 10, 1989 under Local Law No. 1-1989, does list boatyards,
boat and marine engine repair, sales and display as permitted
uses.
Therefore, your application for an interpretation under the
prior zoning code provisions has been withdrawn (as requested by
your February 28, 1989 correspondence). If you find it
necessary to reactivate the same at any time in the future by
amendment or substitution, requiring action by the Board of
Appeals, please do so in writing, stating your reasons therefor
and furnishing proof of re-notification to abutting property
owners.

Gentlemen:
Under date of August 8th, 1988, we submitted an application for
David S. Strong requesting an interpretation of the Zoning
Ordinance in connection with the number of boats which could be
stored at Strong's Marina at James Creek in Mattituck. As a
result of the adoption of the Master Plan, and the corresponding
amendment to the Town Cod~ placing Strong's Marina in
District~boats may now be stored at the site and this
is moot. Therefore, we respectfully request that you
the application has been withdrawn.

Telephone conversation with Mr. Dennis Kraft today concerning
property now of David Strong (Marina) and status of ZBA file.
Confirmed that the file is being held in abeyance for a minimum
of approximately three weeks due to the recent adoption of the
Master Plan (January 10). Mr. Kraft requested a copy of the
list of permitted uses under the "Marine I" designation for this

Board of Trustees,
It is our understanding that the Board of Trustees is looking
into the possibility of mandating pump out s~ations in the Town of
Southold, as a concerned member of the Association of Marine Industries,
a group comprised of your local Eastern businesses we would like to
be invo£ed in and kept informed of any and all descissions pertaining
to this issue. We recognize the need to address the pump out question
but feel quite strongly that to suggest that the financial burden
that would be placed on our members by even considering free facilities
would be unfair.
We have already done some research in~o this and would welcome
all information to be at their disposal, we would like to work in
conjunction with you to make this a better town for all. Thank You.

Dear Mr. Cuddy:
This letter will acknowledge receipt of your recent
application pending before the Board of Appeals. Upon receipt of
the additional, updated site-plan maps, the Board me~ers will
conduct environmental and other reviews as may be necessary
prior to advertising your application for a public hearing.
In reviewing the application, we understand that you are
requesting an Interpretation (or Interpretations) to ascer-
tain the extent of the nun~ber and length of boats permitted to be
stored in the marina and upland areas, and, if necessaryr an
expansion of the nonconforming limitation to permit storage of
150 boats if the interpretation limits the total number of boats
to 100.
If our understanding is not correct and you would like to
request alternative relief to expand and/or to otherwise alter
the nonconforming storage use, a separate application would be
necessary for different relief.

WHERE DO THE BOATS GO? ~.
I've been told by the Town of Southold that the only place in the town to store
boats is in industrial zone.
Does this make sense? Are we trying to create a constant flow of heavy traffic
to and from Marina's?
I can't wait.
I have been told that the town wan~s to encourage access both for our local
taxpayers and tourists, the opposite is going to happen.
Because of the high cost of Industrial Land and it's distance from water sites it
is both financially and physical£y impratical to'use the dumps to store boats.
If the same law that was applied to St~ong's Marineland is applied through-out
the town there will be a mass exodus of boats from this area. I don't think that this
is your intent.
Prior to 1971, our exception read, the "Storage and Service of Boats" without
a qualifing number except for the number of boat slips.
After a ~¢hearing that was not requested by myself a qualifing number of boats
in total appears to have been placed.
It is ~,,w and has been my contention tha~ my p~operty i~ id~a~f simulated for
the dockage, s~orage and service of boat~.
The increase in the publd~'s u~ ,~ boats has caused the need for mor~ ~¢rvices.
The board has recognized this need but has done nothing to date to ~e it possible.
No longer can you get and retain qualified professional personnel without year

You have placed me in a position where I have no choice but to ~ransf~r boats

I. STRICT APPLICATION DF THE ORDINANCE would produce practical difficulties or unneces-
sar HARDSHiP because the operation of applicant'~ business requires that more
than 100 boats be serviled and stored.
2. The hardship created is UNIQUE and is not shored by oil ~roperties alike in the immediate
v~c,mty of th~s property and ~p this use district because appticant's marina business
is non-conforming and its continuance and expansion,is dependant on determination
of the Zoning Board of [ppeals and the action of the Town Board.
