Article XXII Section 280-116 B, which states;
"All buildings located on lots upon which a bulkhead, concrete wall, riprap or similar structure

than seventy-five (75) feet from the bulkhead."
The new construction is noted as being +/- 36.7 feet from the existing bulkhead.

FINDINGS, DELIBERATIONS AND DETERMINATION
MEETING OF NOVEMBER 18, 2008

SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property
under consideration in this application and determines that this review falls under the
Type II category of the State's List of Actions, without further steps under SEQRA.
SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as
required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the
Suffolk County Department of Planning issued its reply dated June 24, 2008 stating
that this application is considered a matter for local determination as there appears to
be no significant county-wide or inter-community impact.
FINDINGS OF FACT
PROPERTY FACTS/DESCRIPTION: The applicant's property contains 46,516 square
feet with 91.22 linear feet along Pine Neck Road, 476.99 feet in depth and 100+/- feet
along the wood .bulkhead adjacent to Jockey Creek. The property is improved with
buildings as shown on the survey prepared by John C. Ehlers, L.S. dated April 1, 2008.
BASIS OF APPLICATION: This request for a Variance under Section 280-116B is
based on the Building Inspector's May 13, 2008 Notice of Disapproval concerning a deck
addition to the existing single-family dwelling at less than 75 feet from the existing
bulkhead.
LWRP: TOWN CODE CHAPTER 268: A July 21, 2008 letter from the Town LWRP
Coordinator was. received, in reply to the Zoning Board of Appeals' request for
recommendations under this Code provision. The Coordinator confirmed the project to
be inconsistent for the deck addition to dwelling.

During the July 24, 2008 public hearing held on July 24, 2008, the applicant's architect
was requested to bring the plan into more conformity with the code requirements.
During the September 25, 2008 public hearing, the architect's amended 9/10/08 site
map submitted to the Zoning Board of Appeals was accepted and found to be consistent
with the LWRP standards and policies, with an increase of the setback for the open,
unroofed deck to a minimum of 45'6".
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials
submitted and personal inspections, the Board makes the following findings:
1. Town Law §267-b(3)(b)(3)(1). Grant of the variance will produce an undesirable
change in the character of the neighborhood or a detriment to nearby properties. The
deck is open to the sky with virtually no mass (no walls) and constructed on piers, and
will not be easily visible from adjacent properties. The design is proposed at the
northwest side of the structure which creates less loading of the structure at the water
(south) side of thd property.
2. Town Law §267-b(3)(b)(2). The benefit sought.by the applicant cannot be achieved
by some method, feasible for the applicant to pursue, other than an areh variance. The
house is existing at 55'3" from the bulkhead; any additions to this nonconforming
building will require a variance from the 75 ft. minimum required setback to the
bulkhead.
3. Town Law §267-b(3)(b)(3). The variance requested herein is substantial. The deck is
proposed with an increase of the nonconformance of the setback by 13.3%, from the
existing setback of 55'3" to a proposed setback of 45'6".
4. Town Law §267-b(3)(b)(5). The difficulty has not been self created. The house is
already nonconfor~aing on the northerly setback to the bulkhead.
5. Town Law ~267-b(3)(b)(4). No evidence has been submitted to suggest that a
variance in this r~sidential community will have an adverse impact on the physical or
environmental conditions in the neighborhood.
6. Town Law §267-b. Grant of the relief requested is the minimum action necessary
and adequate to enable the applicant to enjoy the benefit enjoy the benefit, of an open
deck addition, while preserving and protecting the character of the neighborhood and
the health, safety and welfare of the community. The deck Will not require extensive
excavation for an in-ground foundation since it will be elevated on footings at the base
of the deck construction.

RESOLUTION OF THE BOARD: In considering all of the above factors and applying
the balancing test under New York Town Law 267-B, motion was offered by Member
Oliva, seconded by Chairman Goehringer, and 'duly carried, to
GRANT the variance as amended, as shown on the site map (Sheet I dated
9/10/08) prepared by Thomas C. Samuels, Architect, subject to the following
ondit~on: :'The deck addition shall be open to the sky
That the above condition be written into the Building Inspector's Certificate of
Occupancy, when issued.
Any deviation from the variance given such as extensions, or demolitions which are not
shown on the applicant's diagrams or survey site maps, are not authorized under this
application when involving nonconformities under the zoning code. This action does not
authorize or condone any current or future use, setback or other feature of the subject
property that may violate the Zoning Code, other than such uses, setbacks and other
features as are expressly addressed in this action.
The Board reserves the right to substitute a similar design that is de minimis in nature
for an alteration ~hat does not increase the degree of nonconformity.

Southold and in accordance with the Resolution of the Board of Trustees adopted at the meeting held on

To Whom It May Concern:
As requested, a final inspection was performed on the above referenced property
as required for the issuance of a Certificate of Compliance.
Upon inspection it was determined that not all of the permitted activities were
conducted as described in the permits.
In accordance with Wetland Permit #6953, an approval was made to construct a
528 square foot deck attached to the dwelling, a 4'x53' catwalk with a 4'x9'
seasonal ramp and a 6'x20' float, with conditions of a 10' wide non-turf buffer
landward of the bulkhead, and the installation of gutters to leaders to drywells on
the dwelling. At this time, the attached deck was constructed, the 10' buffer area
is installed, and gutters to leaders to drywells are installed. The fixed catwalk,
ramp, and float have not been constructed. This permit expired on August 20,
2010.
In accordance with Wetland Permit #7026, an approval was made to replace the
siding and windows, raise a portion of the rear roof 9", replace existing screen
porch, construct a retaining wall at the rear of the dwelling, and install an outdoor
shower attached to the deck. At this time, the retaining wall and the outdoor
shower have been completed. The siding, windows, raising of rear roof,
replacement of the screened porch have not been constructed.
Please be advised that the attached Certiflcate's of Compliance are being issued
for the completed activities as described in the permits. Therefore Wetland
Permit #'s 6953 & 7026 are now closed.
Any other activity within 100' of the wetland boundary requires a permit from this
office.

INSULATION
Existing wall cavity insulation to remain; at wall cavities exposed by new construction,
provide new bart insulation sized appropriately. Insulation to meet all requirements of NYS
Energy Code, installed by a qualified subcontractor. Provide kraft-faced fiberglass batt
insulation of R-values noted. Comply with manufacturer's instructions for each type of

Per our phone conversation yesterday, please re-consider the following: our proposal to
alter the. roof line of the above referenced existing, non-conforming residence is so..irf:'-
su.~sta"~ial that it should not be seen as an increase in the non-conformity. Basically
we propose to flatten an existing shed roof over a heated space in order to increase the
interior headroom from 6'-9" to 7'-6", the minimum established by code. We are not
proposing to increase the floor area or usable space. We are proposing to merely
increase a small part of the roof height by 9". Attached you will find ELEVATIONS and
SECTION showing this change. I appeal to your sense of fairness and proportion. The
