ALFRED R. GREBE, GORDON W. AHMAN, LAWRENCE S. BALDWIN
ERNEST MIDDLETON, all residing at Fishers Island in the Town of Southold,
Suffolk County, New York, being all of the Commissioners of the Fire District
situate at Fishers Island in the Town of Southold, Suffolk County, New York,
known as the Fishers Island Fire District, do hereby consent that the said
District be extended to embrace the following territory in addition to the
territory already contained in and embraced by the said District, to wit:

Suffolk County, New York, upon its own motion, that a Public Hearing be held
by the Town Board of the Town of Southold in the matter of the extension of
the Fire District ~t Fishers Island, in the Town of Southold, Suffolk County,
New York, known as the Fishers Island Fire District to embrace the followin
territory in addition to the territory already contained in and embraced by
the District, to wit:

BE IT FURTHER RESOLVED that such Pablic Hearing be held at
the school building of the Union Free School District No. 4 at Fishers Island
in the Town of Southold, Suffolk County, New York, on the 25th day of
August, 1959, at 1:30 o~clock P.M. of said day at which time and place all
persons interested in the matter will be heard.
BE IT FURTHER RESOLVED, that the Town Clerk of the Town of
Southold be and he hereby is authorized and directed to cause a notice of such
hearing to be published at least once in the New London Day, a newspaper

hav~g general circulalion in the territory effected, such publication to be not
less than 10 days or more than 20 days before the day designated therein for
the hearing, and the said Town Clerk is further authorized and directed to
cause five (5) copies of such notice of hearing to be posted conspicuously
in different places within the territory effected, not less than 10 or more than
20 days before the day designated for the hearing. Such notice shall contain
a description of the proposed extension and shall specify the time when and
the place where the Town Board will meet to hear all persons interested in
the subject concerning the same.
The question of the adoption of the foregoing resolution was duly put
to a vote on roll call which resulted as follows:

is over 21 years of age; that he is Chairman of the Board of Commissioners
of the Fishers Island Fire District, Fishers Island, New York; that he
resides at Fishers Island, New York; and that on the 13th day of August,
1959, he posted printed copies of the Notice of Hearing which is hereto
annexed conspicuously in the five (5) public places within the territory
proposed to be annexed to the existing Fishers Island Fire District in the
Town of Southold, Suffolk County, New York, which are respectively des-
cribed as follows:
1. On the bulletin board in building at Fishers Island airfield.
2. On the bulletin board in Fishers Island Ferry District office.
3. On the bulletin board in Community Theatre on south side
of Whisller Avenue.
4. On the front door of building No. 36 (old officers row) on
north side of Whistler Avenue.
5. On the outside of building No. 36 near old hospital.

31st day of August 1959,
W?IEREAS, the Town Board of the Town of Southold, Suffolk County,
New York, by resolution thereof adopted on the llth day of August, 1959,
upon its own motion, determined to hold a Public Hearing in the matter of the
extension of the Fire District at Fishers Island, in the Town of Southold,
Suffolk County, New York, known as the Fishers Island Fire District, by
annexing thereto the territory hereinafter described, and
WI:IEREAS, a notice in due form, was duly published and posted as
required by law, containing a description of the territory proposed to be
annexed to the said Fire District and specifying the time when and the place
where the said Town Board would meet to consider the said matter and to
hear all persons interested therein, and
WHEREAS, pursuant to such notice a Public Hearing was duly held
by said Town Board on the 25th day of August, 1959, at 1:30 o~clock P. M.
of said day at the school building of the Union Free School District No. 4 at
Fishers Island, in the Town of Southold, Suffolk County, New York, and
WI-IEREAS, all persons interested, who desired to be heard, were
duly heard, and due deliberation having been had, NOW, upon the evidence
given at said Public Hearing, it is
RESOLVED AND DETERMINED, pursuant to Article 11 of the Town
Law of the State of New York, as follows:
(a) That all the property and property owners within the
proposed extension of said district are benefited thereby;
(b) That all the property and property owners benefited
are included within the limits of the proposed extension of

Town Law of the State of New York; and that such application be executed and
verified by and on behalf of the Town Board by the Supervisor of the Town of
Southold.

County, New York, for permission of the State Comptroller to
extend Fishers Island Fire District in said town.
t~REREAS, application has been duly made to the undersigned
by the town board of the Town of Southold, Suffolk County, New
York, by its Supervisor, pursuant to section 173 of the Town
Law, for the permission of the State Comptroller to extend
Fishers Island Fire District in such town in accordance with
such application and a resolution of such board adopted on
August 31, 1959, and
RiiEREAS, notice of such application to the State Comptroller
has been duly given to the Board of Supervisors of Suffolk County,
New York, by the State Comptroller in the manner prescribed by
section 173 of the Town Law, and
WHEREAS, the undersigned has duly examined such application,
NOW, THEREFORE, pursuant to such examination and upon such
application of the town board of the Town of Southold, the
undersigned does hereby find and determine, after due deliberationl
(1) That the public interest will be served by the
extension of Fishers Island Fire District in the
Town of Southold in accordance with such application.
(2) That the cost of the proposed extension will not
be an undue burden upon the property of the extension.

trict, by annexing thereto the territory hereinafter described;
and a public hearing, pursuant to due notice thereof, having
been held on the 25th day of August, 1959 at the school buildin
of the Union Free School District No. 4 at Fishers Island, in
the Town of Southold, Suffolk County, New York, at which time
and place said Town Board considered said matter and heard all
persons interested therein; and said Town Board having by reso-
lution duly adopted on the 31st day of August, 1959, following
the said hearing and upon the evidence given thereat, duly deter-
mined that all the property and property owners within the pro-
posed extension of said district are benefited thereby; that all
the property and property owners benefited are included within the
limits of the proposed extension of said district, and that it is
in the public interest to grant in whole the relief sought and
duly resolved to extend such fire district to embrace the addi-
tional territory hereinafter described, subject, however, to the
approval of the State Comptroller; and within ten days after the
adoption of said resolution, the Town Clerk of the Town of
Southold having caused to be filed a certified copy of such resol~
tion, in duplicate, in the office of the State Department of Audit
and Control at Albany, New York, together with an application in
due form and duly executed in duplicate, for permission to extend
such district; and the State Comptroller having made an order in
duplicate, under date the 6th day of October, 1959, granting per-
mission for the extension of such district, one copy thereof hav-
ing heretofore been filed in the office of the State Department of
Audit and Control at Albany, New York, and the other copy thereof
having been filed in the Office of the Town Clerk of this Town on
the ~th day of October, 19§9; and the said Town Clerk having pre-
sented such order to the Town Board at the next meeting thereof,
to wit, at a meeting held at the above captioned time and place;

ORDERED, that the said existing fire district known as the
Fishers Island Fire District be and it hereby is extended to em-
brace the territory described in and containing the following
boundaries, to wit:
