Dear Mrs. Grudman,
In response to your letter regarding the construction site at the above-referenced
location, the barber that was installed was the result of a meeting between our office and
counsel for the homeowner, who immediately dispatched a contractor to perform the
work you described.
While our office was able to address your concerns in this instance, the Town of
Southold is not responsible for your costs associated with work done by a hired
contractor on your property. The Town will not authorize reimbursment for same.
Please be assured that the construction site in question has been inspected by the
Town. The work at that location is with valid permits from the Building Department and
Board of Trustees. If you have additional concerns regarding this matter, please do not
hesitate to contact me.

Honorable Trustees:
Regarding the construction at 700 North Drive., Mattituck, New York.
Since my last correspondence July 3, 2008 the project has commenced at 700 North Drive. My request for
information about lack of notification, potential increase of water flow to my properly, installation of 10 fi
retaining walls within 20 feet of my house and the location and height of a swimming pool 30 feet fi.om the
cliff contour has been largely ignored. The answer was a copy of a permit and minutes of a meeting. As the
elected officials responsible for the roles and best interest of the residents of our town, that reply lacking
any personal attention was disappointing.
Almost 7 weeks have passed and the project at 700 is well underway. My worst fears are coming true.
No one has addressed nor contacted me about a forged signature on an official document.
The additional flow of water has created floods due to the increased water ami mud created by construction
that has clogged my double set of French drains through the flow pipes to my dry well. I now have zero
drainage with mud filling the 10 inch drain pan and I have water intrusion into my garage. I was assured that
would be remedied and it has not. There is no containment of water/mud fi.om the sight as there are no
barriers on the sight containing that flow.
The pool is situated 10 feet high over land fill. It sits above my roof line 20 feet from my bedroom
window. Ultimately, there will be a 10 foot wall to ~place that horrific image with a Sing Sing look only
missing barbed wire at the top.
You have authorized a structure that does not fit the community. You have allowed the owner to clear cut
within the property lines including set backs and allowed a pool that is inconsistent with the other homes
overlooking the inlet. Your decisions seemed to be based on the word and promises of a professional
builder rather than the best interests of the town of Matfituck. "THEY WILL TRY TO KEEP THE WALL
LOW." The minutes indicate that was an acceptable response. It has deslroyed my peace and quiet and has
diminished the value of my propeaXy in a significant way. Aside from quotes of '~nat~ing we can do" to it
will "add value" I have heard nothing.
As elected officials, I believed that the interests of the residents were your responsibility. I hope someone
can explain how this pristine property can be so dramatically altered with detrimental affects on the
neighbors.

The concerns you raise are valid, however at this time, it is the Board's position
that your concerns were addressed during the Public Hearing which was held on
October 17, 2007, and a permit was issued.

Honorable Trustees:
Regarding new construction north of 620 North Drive. We believe it is 700 North ddve.
We did not receive notification of a Board Of Trustee meeting regarding this project. The return
receipt for same is not a signature we recognize, nor name of anyone in our family. We can
understand the possibility of error and do not want to belabor the issue. The plans were, however,
approved without our knowlege or input until after the fact. The point is, we did not have an
opportunity to attend any meetings pertaining to, nor address any issues that might impact our
property from this new construction.
There are some issues that are of concern to us. After viewing the plans yesterday at Town Hall, it
appears that there might be a potential for increased water flow to our property. Currently, we can
barely keep up with heavy rains using the two drains at the top and bottom of the driveway. They
empty into my dry wells on my property.
The installation of retaining walls for the new construction, as well as levelling of the sloping
property that currently exists may not allow the waters natural flow, and may cause our property to
have a more significant flow of water. The new land contour has the potential to divert the added
flow to my house.
The other concern we have is the location and utility of the pool. There are no other pools on our
slope as far as we know. We all have our own wells for fresh water. We are concerned that any
potential leakage would leach into the ground and affect our water supply. Additionally, It might
drain chemical waters into the inlet.
We do not want to be a hindrance to the construction of a new house that adds tax revenue to the
town and improves the value of all our homes. We do not however, want to incur problems that
can be avoided prior to allowing this project to go forward.

Pursuant to the provisions of Chapter 275 and/or Chapter 111 of the Town Code of the Town of
Southold and in accordance with the Resolution of the Board of Trustees adopted at the meeting held on
October 17, 2007, and in consideration of application fee in the sum of $250.00 paid by Nick Andreadis and
subject to the Terms and Conditions as stated in the Resolution, the Southold Town Board of Trustees
authorizes and permits the following:
Wetland Permit to construct a two-story dwelling, sanitary system, swimming
pool and concrete retaining walls along north and south sides of property, with the
condition the installation of gutters and drywells to contain roof and pool runoff and in
accordance with Chapter 236 of the Town Code-Storm Water Runoff, a line of staked
hay bales to be installed prior to construction approximately located at the 20' contour
line, the area seaward of the 18' contour line remains non-disturbance, the driveway is
constructed using pervious materials, the retaining walls are to be shortened and as Iow
as possible, and, and as depicted on the site plan prepared by Burton, Behrendt, Smith
Architecture & Engineering, last dated November 8, 2007, and received on November
13, 2007.

TERMS AND CONDITIONS
The Permittee Nick Andreadis, residin~ at 2 Sycamore Avenue, Glen Head, New York, as part
of the consideration for the issuance of the Permit does understand and prescribe to the
following:
That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto, to the complete exclusion of the Board of
Trustees of the Town of Southold.
That this Permit is valid for a period of 24 months, which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved, to provide evidence to anyone concerned that
authorization was originally obtained.
That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
That if future operations of the Town of Southold require the removal and/or alterations in
the location of the work herein authorized, or if, in the opinion of the Board of Trustees,
the work shall cause unreasonable obstruction to free navigation, the said Permittee will be
required, upon due notice, to remove or alter this work project herein stated without
expenses to the Town of Southold.
The Permittee is required to provide evidence that a copy of this Trustee permit has been
recorded with the Suffolk County Department of Real Properties Office as a notice
covenant and deed restriction to the deed of the subject parcel. Such evidence shall be
provided within ninety (90) calendar days of issuance of this permit.
That the said Board will be notified by the Permittee of the completion of the work
authorized.
That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit, which may be subject to revoke upon failure to obtain same.

Dear Ms. Moore:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, October 17, 2007 regarding the above matter:
WHEREAS, Patricia C. Moore, Esq. on behalf of NICK ANDREADIS applied to the
Southold Town Trustees for a permit under the provisions of Chapter 275 of the
Southold Town Code, the Wetland Ordinance of the Town of Southold, application
dated September 24, 2007, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator recommended that the proposed application be
found Inconsistent with the LWRP, and,
WHEREAS, the Board of Trustees has furthered Policy 5 & 6 of the Local Waterfront
Revitalization Program to the greatest extent possible through the imposition of the
following Best Management Practice requirements: installation of gutters and drywells to
contain roof and pool runoff and in accordance with Chapter 236 of the Town Code-
Storm Water Runoff, a line of staked hay bales to be installed prior to construction
approximately located at the 20' contour line, the area seaward of the 18' contour line
remains non-disturbance, the driveway is constructed using pervious materials, the
retaining walls are to be shortened and as Iow as possible, and

WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on October 17, 2007, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that for the mitigating factors and based upon the Best Management
Practice requirement imposed above, the Board of Trustees deems the action to be
Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5
of the Southold Town Code, and,
RESOLVED, that the Board of Trustees approve the application of NICK ANDREADIS
to construct a two-story dwelling, sanitary system, swimming pool and concrete
retaining walls along north and south sides of property, with the condition the installation
of gutters and drywells to contain roof and pool runoff and in accordance with Chapter
236 of the Town Code-Storm Water Runoff, a line of staked hay bales to be installed
prior to construction approximately located at the 20' contour line, the area seaward of
the 18' contour line remains non-disturbance, the driveway is constructed using
pervious materials, the retaining walls are to be shortened and as Iow as possible, and,

Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)

At the meeting of the Southold Town Conservation Advisory Council held Wed., October
10, 2007, the following recommendation was made:

The CAC Supports the application with the Condition the bluff is maintained, as is, and no
removal of trees on the bluff, a landscape plan is submitted depicting the disposition of all
trees over 8" DBH, and a 20' non-disturbance buffer. The CAC further recommends a set
of stairs along the disturbed path on the bluff.

NICK ANDREADIS requests a Wetland Permit to construct a two-story dwelling,
sanitary system, swimming pool, and concrete retaining walls along north and south sides
of property. Located: 700 North Dr., Mattituck. SCTM#106-6-25
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review
of the Town of Southold Town Code and the Local Waterfront Revitalization Program
(LWRP) Policy Standards. Based upon the information provided on the LWRP
Consistency Assessment Form submitted to this department, as well as the records
available to me, it is my recommendation that the proposed action is INCONSISTENT
with the denoted following Policy Standards and therefore is INCONSISTENT with
the LWRP.
Policy 6. Protect and restore the quality and function of the Town of Southold
ecosystem.
6.3 Protect and restore tidal and freshwater wetlands.

The distance to the proposed house from the top of the bank is 35 feet~ a
minimum setback distance of 100 feet from the top of bank is required
pursuant to Chapter 275-3.Findings~ purpose; iurisdiction~ setbacks.
Please require that the applicant amend the application to meet the above
policy to the greatest extent practical.
To further Policy 5 "Protect and improve water quality and supply in the Town of
Southold" it is recommended that the Board require the following best management
practices:
1. Require the installation of drywells at the terminus of the gutters and
leaders, and a drywell for pool drainage.
2. Require that the driveway be constructed of pervious material.
3. Require that an undisturbed vegetative buffer be established at the 18'
contour to stabilize the slope.
4. Install hay bales at the 20 foot contour line.

preparing its written determination regarding the consistency of the proposed action.

1. All applicants for permits* including Town of Southold agencies, shall
complete this CCAF for proposed actions that are subject to the Town of
Southold Waterfront Consistency Review Law. This assessment is intended to
supplement other information used by a Town of Southold agency in making a
determination of consistency. *Except minor exempt actions including
Building Permits and other ministerial permits not located within the
Coastal Erosion Hazard Area.

DECLARATION OF COVENANTS AND RESTRICTIONS
DECLARATION made this/~--'~day of January, 2008, by NICOLAS ANDREADIS
now residing at 2 Sycamore Ave., Glen Head, New York, as owner, hereinafter referred
to as the "Declarant".
WITNESSETH:
WHEREAS, the Declarant has title to certain land situate, lying and being at 700
North Drive, Mattituck, Town of Southold, Suffolk County, New York, SCTM #1000-106-6-
25 said land being more particularly described in Schedule A which is attached hereto;
and
WHEREAS, the Property is situated in or adjacent to lands activities upon which are
regulated by the Town of Southold Board of Trustees pursuant to Chapter 275 of the Town
Code of the Town of Southold, as may be amended, and various activities conducted upon
the property are subject to the jurisdiction, regulation and approval or disapproval of the
Trustees prior to being conducted;
WHEREAS, the Declarant has applied to the Town of Southold Board of Trustees
for a Wetland Permit for approval to construct a two-story dwelling, sanitary system,
swimming pool and concrete retaining walls along north and south sides of property, on the
property as described in Schedule A and known as SCTM #1000-106-6-25, and as
depicted on the plans prepared by Burton Behrendt Smith last dated 11-8-07; and
WHEREAS, the Town of Southold Board of Trustees, as conditions for the issuance
of such Wetland Permit, required certain covenants and restrictions be placed on the
property as shown on the aforesaid plans.
NOW, THEREFORE, this Declarant witnesseth:
That Declarant, for the purpose of carrying out the intentions expressed above does
hereby make known, admit, publish, covenant and agree that the said property herein
described shall hereafter be subject to the following covenants which shall run with the land
and shall be binding on all purchasers and holders of said premises, their heirs,
successors, and assigns, to wit:
1. The grant of a Wetland Permit for the construction of a two-story dwelling,
sanitary system and swimming pool and concrete walls shall be conditioned
upon the installation of gutters and drywells to contain roof and pool run-off
on the property as depicted on the site plan prepared by Burton Behrendt
Smith last dated 11-8-07, within perpetuity.
2. The grant of a Wetland Permit for the construction of a two-story dwelling,
sanitary system and swimming pool and concrete walls shall be conditioned
upon the installation of a continuous line of hay bales, maintained throughout
the period of construction on the property located at the 20 foot contour line,
the area seaward of the 18 foot contour line remains non-disturbance, the
driveway is constructed using pervious materials, the retaining walls have
been shortened and made as Iow as possible as depicted on the site plan
prepared by Burton Behrendt Smith last dated 11-8-07, within perpetuity.
3. These covenants and restrictions can be modified only at the request of
the then owner of the premises with the approval of the Town of Southold
Board of Trustees after a duly noticed public meeting. Adjoining property
owners shall be entitled to notice of such public meeting by publication or as
otherwise deemed sufficient by the Board of Trustees but their consent to
such modification shall not be required.
4. It is the responsibility of any party having any right, title or interest in the
Property to consult Chapter 275 of the Town Code of the Town of Southold,
as may be amended, and to obtain from the Town of Southold Board of
Trustees review and such approvals as may be required by Chapter 275 for
activities regulated therein on the Property.
5. Declarant grants the continuing right in perpetuity to the Town of Southold
or any of its designated representatives to enforce the conditions and
restrictions of the covenants.
THE FOREGOING covenants and restrictions shall bind the Declarant, its heirs,
successors and assigns, and any and all person or persons who shall succeed to the
ownership of said premises of any part thereof by transfer or otherwise.

and year first above written.
