between the TOWN BOARD OF THE TOWN OF SOUTHOLD, Suffolk County, '
New York, hereinafter called the "Town" and the BOARD OF COMMISSIONERS
OF THE EAST MARION ~ FIRE DISTRICT,
in the Town of Southold, Suffolk County, New York, hereinafter called the
"District".
WITNESSETH:
WHEREAS, pursuant to Section 139 of the Town Law and Chapter 36
of the Code of the Town of Southold. the Town is authorized to enter into an
agreement with the District for the purpose of utilizing the services of the
Chief and Assistant Chiefs of the fire departments in the District in the
issuance of Town fire permits to burn grass, leaves, brush, rubbish, refuse.
buildings or other materials within the District and in the making, of'~ '~
preliminary investigations in relation thereto, and
WHEREAS, Subdivision 24 of Section 176 of the Town Law
authorizes the District to enter into an agreement with the Town to issue
fire permits for the purposes hereinbefore set forth, and
WHEREAS, in the judgment of the Town it is advisable for the
safety and welfare of the inhabitants of and property within the District that
the issuance of Town fire permits to burn grass, leaves, brush, rubbish,
refuse, buildings or other materials within the District including the
preliminary investigations in relation thereto should be performed by the
Chief and Assistant Chiefs of the fire departments in the District, who are
the persons most familiar with fire hazard conditions in the District and the
availability of fire fighting vehicles and firemen, and therefor desires to
enter into this agreement for the aforesaid purposes, and
WHEREAS, in the judgment of the DistFict, it is advisable for the
safety and welfare of the inhabitants of and the property within the District
that the Chief and Assistant Chiefs of the fire departments of the District
render the services herein set forth,
NOW, THEREFORE, IT IS AGREED AS FOLLOWS:
1. That all Town fire permits to burn grass, leaves, brush, rubbist
refuse, buildings or other materials within the District shall be issued by the
Chief and Assistant Chiefs of the fire departments in the District.
2. That all necessary preliminary investigations in relation to the
issuance of Town fire permits shall be performed by the Chief and Assistant
Chiefs of the fire departments in the District.
3. That no Town fire permits shall be issued unless the person
issuing the same is satisfied that the burning authorized thereby will be
accomplished in such manner as to minimize the danger to persons or property
or the annoyance of the inhabitants of the Dist~ct.
4. Thai no Town fire permit shall permit burning on any street,
aighway, sidewalk or other public place if such burning would cause damage
or injury to the same.
5. That the person issuing a Town burning permit shall impose
such conditions as may be deemed necessary for the safety of the inhabitants
and property within the District.
6. That all Town burning permits shall provide that the person
authorized to burn pursuant thereto shall comply with all applicable laws
rules and regulations.
7. That this agreement may be terminated as follows:
(a) By the Town after written notice to the District.
(b) By the Town after a change in its fire protection law
which provides a different procedure for the issuance of Town burning permits.
(c) By the District upon sixty (60) days written notice to the
Town.

IN WITNESS WHEREOF, this agreement has been executed by the
parties hereto on the day and year first above written.
