APPLICATION FOR BUILDING PERMIT
a. This application MUST be completely filled in by typewriter or in ink and submitted to the Building Inspector with 4
sets of plans, accurate plot plan to scale. Fee according to schedule.
b. Plot plan showing location of lot and of buildings on premises, relationship to adjoining premises or public streets or
areas, and waterways.
c. The work covered by this application may not be commenced before issuance of Building Permit.
d. Upon approval of this application,'the Building Inspector will issue a Building Permit to the applicant. Such a permit
shall be kept on the premises available for inspection throughout the work.
e. No building shall be occupied or used in whole or in part for any purpose what so ever until the Building Inspector
issues a Certificate of Occupancy.
f. Every building permit shall expire if the work authorized has not commenced within 12 months afier the date of
issuance or has not been completed within 18 months from such date. If no zoning amendments or other regulations affecting the
property have been enacted in the interim, the Building Inspector may authorize, in writing, the extension of the permit for an
addition six months. Thereafter, a new permit shall be required.

Pursuant to the provisions of Chapter 275 and/or Chapter 111 of thc Town Code of the Town of
Southold and in accordance with the Resolution of the Board of Trnstees adopted at the meeting held on
December 12, 2007, and in consideration of application fee in the sum of $250.00 paid by Daniel & Pasquallna

Dear Mr. Berkowitz:
Based on the information you have submitted, the Department of Environmental Conservation
(DEC) has determined that the property landward of the 10' elevation contour line, as shown on
the survey prepared by Nathan Taft Corwin dated 3/12/07, last revised on 10/30/07, is beyond
Tidal Wetlands Act (Article 25) jurisdiction. Therefore, in accordance with the current Tidal
Wetlands Land Use Regulations (6NYCRR Part 661) no permit is require.
Be advised, no construction, sedimentation, or disturbance of any kind may take place
seaward of the tidal wetlands jurisdictional boundary, as indicated above, without a permit.
It is your responsibility to ensure that all precautions are taken to prevent any sedimentation or
other alteration or disturbance to the ground surface or vegetation within Article 25 jurisdiction
which may result from your project. Such precautions may include maintaining adequate work
area between the tidal wetland jurisdictional boundary and your project (i.e. a 15, to 20' wide
construction area) or erecting a temporary fence, barrier, or hale bay berm.
Please note that this letter does not relieve you 'of the responsibility of obtaining any necessary
permits or approvals from other agencies or local municipalities.

consideration in thru application and determines that this review falls under the Type H category
of the State's List of Actions, without further steps u~.der SEQRA.
PROPERTY FACTSfDESCRIPTION; The subject property is a non-conforming 28,191 square
foot parcel in the R40 District, measuring 122.83 ft. along Jockey Creek to the north, 130.94
wide along the southern boundary, 232.34 feet along the western boundary, and 222.99 feet along
the eastern boundary, and improved with a single family dwelling as shown on the survey by
Nathan Taft Corwin III, L. S., dated March 12, 2007.
BASIS OF APPLICATION_: Request for a Variance under Section 280-116B, based on the
Building Inspector's April 11, 2008 amended Notice of Disapproval concerning a proposed
swimming pool with patio at grade and a proposed rear porch addition to the dwelling, beth
proposed at less than 75 feet from the code~requlred minimum setback.
LWRP DETRIqMINATION: The Seuthold Town LWRP Coordinator has determined that the
proposed action is inconsistent with LWRP Policy standards regoxcting the protection and
restoration of the Town of Southold ecosystem for the following reasons:
The distance from the proposed patio to the wetland boundary (bx,1]rhead) is 45 feet; the distance
from the proposed screened porch to the wetland boundary is 78 feet [74 according to the survey],
whereas the minimum setback distance of 100 feet is required pursuant to Chapter 275-3.
The LWRP Ooordinator recommends that a olinimttm o~20 ft. non-turf, native vegetation buffer
landward of the wetland line be required.
The ZBA finds the proposed action CONSISTENT with LWRP review based on compliance of
the proposed action wi~h the Town Wetlands Law, Chapter 275-3(D)(1)(a)(5), stating that the
mi,ir, run setback from the wetland boundary for a swimming pool and related structures is 50
feet. Establishment of non-turf buffer landward of the wetland, andinstallationofa pcol drywall
landward o£the Chapter 275 jurisdiction, s,,~.ciently mitigates the setback requirement for the
pool and patio. A 49 ft. setback substantially complies with the requirements of Chapter 275-3.

FF D: The applicant seeks a variance for the addition ora screenedporch set
back 74 feet from the bulkhead, and an in-ground swimming pool, set back 49 feet from the
bulkhead, wi.th an adjacent pat/o set back 45 feet from the bulkhead. The applicant proposes to
remove an above-ground sw/mm/ug pool and replace it with an in-ground swimming pool.
~EASONS FOR BOARD~kCTION: On the basis of testimony presented, materials submitted and
personal ~nspections, the Board makes the following ~ndings:
1. Town Law §267-b(3)(b)(3)(1). Grant of the setback var/anco with respect to the pool and patio
wiI1 not have an adverse environmental effect on the character of the neighborhood or be a
detriment to nearby propert/es. The LWRP~s Coordinator's finding of/noonsietency and stated
adverse environmental effect was based on the Chapter 280~116 requ/xement that upland
structures be set back 75 feet from the bulkhead.
Grant of the setback variance with respect to the screened porch will not have an undesirable
effect on the character of the neighborhood or be a detr/ment to r~earby propert/es. A one-foot
reduction of setback for the proposed screened porch will not have an uncles/table effect and bring
it into a]l/gnment with the existing attached deck.
2. Town Law §267-b(3)(b)(2). The benefit of an expanded in-ground pool ca~uot be achieved by
some method, feasible for the applicant to pursue, other than an area var/ante. There is no more
reasonable location for an in-ground pool than the locat/on of the existing above-ground pool. The
new pool w/Il be set back more than the exist/ng pool. Only the deck, which an in-ground pool
typica]mly requires, will result in a smaller setback than the exist/ng above-ground pool requires.
A pool on this lot of any size would require a variance. With respect to the screened porch, the
on.ly alternative would be s one-foot narrower porch that would bringit out of alignment with the
exi.sting advantage without any attendant benefit to neighbors or environmental protection.
3. Town Law ~267-b(3)ib)(3). The proposed setback var/anco for the pool and pat/o is not
substantial. It would require a 2 % reduction in setback required by the code,/rom. 50 feet to 49
feet. The proposed setback var/anco for the porch is not subetantial. Appl/cants request a one-
foot reduction in setback/or that porcl~ from 75 feet te 74 feet.
