SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this
application and determines that this review falls under the Type II category of the State's List of Actions, without
further steps under SEQRA.
SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk
County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its
reply dated June 15, 2010 stating that this application is considered a matter for local determination as there
appears to be no significant county-wide or inter-community impact.
LWRP: This application was referred for reviewed under Chapter 268, Waterfront Consistency review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The
LWRP Coordinator issued his reply dated June 24, 2010,,based upon the information provided on the LWRP
Consistency Assessment Form submitted to this department, as well as the records available to us, it is our
recommendation that the proposed action is CONSISTENT with LWRP policy standards and therefore is
CONSISTENT with the LWRP.
PROPERTY FACTS/DESCRIPTION: Based on a survey dated March 31, 2010, prepared by Nathan Taft Corwin,
iii, LS, submitted with the application, subject property is an improved, non-conforming, lot consisting of 21,997
sq. ft. buildable land. It has 94.17 feet of frontage on Albacore Drive and 70 feet of frontage on Blue Marlin Drive,
176.14 feet on the western property line, 100 feet on a canal and 162.54 feet on the eastern property line.
BASIS OF APPLICATION: Request for Variance from Code Sections 280-116B, based on an application for
building permit and the Building Inspector's April 8, 2010, Notice of Disapproval concerning additions to an
existing dwelling, at: less than the code required setback to a bulkhead of 75 feet.
RELIEF REQUESTED: Applicant is requesting a deck and a modest one-story addition to the waterside of the
house. They are requesting a setback of 58 feet from the bulkhead where the code requires 75 feet.
ADDITIONAL INFORMATION: During the hearing, the applicant's agent, presented an amended survey dated
July 27, 2010 prepared by Nathan Taft Corwin III, LS, showing a slightly larger one-story addition and a reduced
deck. Agent stated that the applicants decided they would like a larger master bedroom instead of a large deck.

The revised survey shows the addition setback 58.5 feet, which moves the addition a half foot further away from
the bulkhead. A neighbor of the applicants appeared at the hearing to state he was in favor of the application.
FIND1NGS OF FACT/REASONS FOR BOARD ACTION:
The Zoning Board of Appeals held a public hearing on this application on July 29, 2010, at which time written and
oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and
other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following
findings:
On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following
findings:
Town Law §267-b(3)(b)(1). Grant of the variance of will not produce an undesirable change in the character of
the neighborhood. The entire neighborhood, on the northeasterly side of Albacore Dr., as well a Blue Marlin Dr.,
consist of similar size lots that front on a canal that leads to Southold Bay. The majority of the lots are improved
with both one story and two story one-family homes, with the same or similar front and rear yard setbacks.
Town Law §267-b(3)(b){2). The benefit sought by the applicant, cannot be achieved by some method, feasible for
the applicant to pursue, other than an area variance. The applicant cannot meet the code required setback, based
upon the "as built" placement of this ranch type home.
Town Law §267-b(3)(b}(3). The variance requested is substantial; it is a 16.5' reduction from the present Code
requirements. This represents a 22% variance from the required bulkhead setback of 75 feet. However, similarly
non-conforming setbacks fi'om the dug canal are common in this neighborhood
Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that the granting of this variance will
have an adverse impact on the physical or environmental conditions in this non-conforming neighborhood. The
majority of the existing homes have similar setbacks to the canal. The applicants will install drainage, gutters and
drywells.
Town Law §267-b{3)(b)(5). The difficulty has been self-created, the dwelling is existing and due to its location
on the lot, any additions on the rear of the dwelling would require variances from the required setback to the
bulkhead.
Town Law §267-b. Grant of this variance is the minimum action necessary and adequate to enable the applicant to
enjoy the benefit of a slightly larger master bedroom and a rear deck, while preserving and protecting the character
of the neighborhood and the health, safety and welfare of the community.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under
New York Town Law 267-B, motion was offered by Member Goehringer, and seconded by Member Dinizio,
to;
GRANT, the variance, as applied for, based upon the survey dated July 27, 2010 prepared by Nathan Taft Corwin
III, LS and architectural plans dated July 24, 2010, prepared by James A. Richter, RA, labeled P1 & P2.
Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays
and/or a possible denial by the Building Department of a building permit, and may require a new application and
public hearing before the Zoning Board of Appeals.
Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's
diagrams or survey site maps, are not authorized under this application when involving nonconformities under the
zoning code. This action does not authorize or condone any current or future use, setback or other feature of the

subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are
expressly addressed in this action.
The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of
nonconformity,

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment
Form submitted to this department, as well as the records available to me, it is my
recommendation that the proposed action is CONSISTENT with the below listed Policy
Standards and therefore is CONSISTENT with the LWRP.
In March of 201 O, the Board of Trustees issued a permit for the proposed action
requiring a 10' non-turf buffer and the installation of drainage, gutters and drywells.
Pursuant to Chapter 268, the Southold Town Zoning Board of Appeals shall consider this
recommendation in preparing its written determination regarding the consistency of the
proposed action.

Specifically, although the additions will be located 6 feet closer to the bulkhead than the existing
dwelling, the seaward edges of the dwelling and deck additions will be set behind/closer to the
road than the seaward fagade of the rest of the existing house. The scope of the addition is
limited in that only 177 square feet of additional habitable footprint is proposed, which would
increase the footprint of the existing modest sized home by less than 9 percent.
The purpose of the proposed expansion is to provide a small waterside deck off an expanded
master bedroom with an associated master bathroom and walk-in closet. As the master bathroom
is located on the waterside of the house and there is no proposal to expand the house vertically,
there is no feasible alternative location for the proposed bedroom and bathroom expansion and
deck. And because the seaward facade of the existing master bedroom is already located less
than 75 feet from the bulkhead, there is no alternative means of gaining approval to expand the
bedroom but to seek the requested relief from {}280-116(B).
The requested relief (17 feet or 22.6% of the required 75' setback) is not substantial because the
existing dwelling is already located 64 feet from the bulkhead. And although relief for an
additional 6 feet of encroachment is requested, the seaward extension of the easterly side of the
house will not extend as far seaward as the existing westerly fagade of the dwelling, as noted
above. The additional 6-foot encroachment on the bulkhead results from the fact that the angled
bulkhead encroaches further landward on the east side of the property and because the house is
also oriented at an angle to the bulkhead such that the easterly side of the dwelling is located
closer to the bulkhead than is the westerly side of the dwelling. Therefore, the minimum possible
setback between the dwelling and bulkhead occurs on the easterly side of the property where the
proposed addition is proposed.
The project will not have an adverse impact on the physical or environmental conditions because
there will not be any significant change in the developed nature of the property, and as a result of
the incorporated mitigation measures, there will be a net improvement to the ecological condition
of the site. Specifically, the proposed house and deck will add only 363 square-feet of structural
coverage or an additional 1.65 percent coverage of buildable land. More than offsetting that
increase in development will be 1) installation of a drainage system of leaders, gutters, and
drywells that will capture and recharge runoff; and 2) establishment of a nonturf buffer in place
of maintained lawn landward of the bulkhead, whose area will total more than 1,000 square feet
or three times the area of the proposed increase in coverage. Together these measures will result
in a net improvement to water quality via a net reduction of the flow rate and volume of runoff
entering the adjacent canal and of the potential concentration of fertilizers, fungicides, and other
chemicals contained therein. The project as presently proposed was granted Wetlands Permit
7255 by the Board of Town Trustees on 17 March 2010, and the project is situated beyond the
Tidal Wetlands jurisdiction of the New York State Department of Environmental Conservation.
The difficulty with locating the proposed expansion without necessitating variance relief is not
self-created due to the preexisting nonconforming location of the existing dwelling relative to the
existing bulkhead.

water runoff absorption capacity of the site will be increased not only by the establishment of the buffer but also.via installation of a
drainage system of leaders, gutters, and a drywell to capture and recharge roof runoff from the proposed addition.

because a project-limiting fence and staked haybales will be installed to contain site disturbance during construction. With respect to
compliance with Trustees and NYS DEC laws and regulations, the work has been exempted from the DEC's Tidal Wetlands Land Use
Regulations due to its location Iandward ora functional, pre-1977 bulkhead. Due to the location of the preexisting house and the
proposal to install a master bathroom to the existing master bedroom, which is on the waterside of the house, the additions cannot be
located more than 100 feet from wetlands, but the scope of the project has been limited and potential impacts will be mitigated as
described above.

Based on the information you have submitted the Department of Environmental
Conservation (DEC) has determined that:
The property landward of the bulkhead greater than 100 feet in length constructed prior
to 8/20/77, as evidenced on Aerial Image Resources photo#73-2046 dated 4/6/76 and
shown on the survey prepared by Nathan Taft Corwin III dated 10/14/08, is beyond
Article 25 (Tidal Wetland) jurisdiction. Therefore, in accordance with the current Tidal
Wetlands Land Use Regulations (6NYCRR Part 661) no permit is required.
Be advised, no construction, sedimentation, or disturbance of any kind may take
place seaward of the tidal wetlands jurisdictional boundary, as indicated above,
without a permit. It is your responsibility to ensure that all precautions are taken to
prevent any sedimentation or other alteration or disturbance to the ground surface or
vegetation within Article 25 jurisdiction which may result from your project. Such
precautions may include maintaining adequate work area between the tidal wetland
jurisdictional boundary and your project (i.e a 15' to 20' wide construction area) or
erecting a temporary fence, barder, or hale bay berm.
Please note that this letter does not relieve you of the responsibility of obtaining any
necessary permits or approvals from other agencies or local municipalities.

The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, March 17, 2010 regarding the above matter:
WHEREAS, En-Consultants, Inc. on behalf of MICHAEL & CAROLEE LEVlSON
applied to the Southold Town Trustees for a permit under the provisions of Chapter 275
of the Southold Town Code, the Wetland Ordinance of the Town of Southold,
application dated February 12, 2010, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator issued a recommendation that the application be

Dear Sir or Madam:
Please find enclosed a copy of the Legal Notice describing your recent application. The Notice
will be published in the next issue of the Times Review newspaper.
1) Before July 14th:
Please send the enclosed Legal Notice, with both a Cover Letter including your telephone
number and a copy of your Survey or Site Plan (filed with this application) which shows the
new construction area or other request, by CERTIFIED MAIL, RETURN RECEIPT
REQUESTED, to al_l owners of property (tax map with property numbers enclosed), vacant or
improved, which abuts and any property which is across from any public or private street.
Use the current owner name and addresses shown on the assessment rolls maintained by the
Town Assessors' Office located at Southold Town Hall, or Real Property Office at the County
Center, Riverhead. If you know of another address for a neighbor, you may want to send the
notice to that address as well. If any letter is returned to you undeliverable, you are requested
to make other attempts to obtain a mailing address or to deliver the letter to the current owner,
to the best of your ability, and to confirm how arrangements were made in either a written
statement, or during the hearing, providing the returned letter to us as soon as possible;
AND not later than July 21st: Please either mail or deliver to our office your Affidavit of
Mailing (form enclosed) with parcel numbers, names and addresses noted, and furnish to
our office with the green/white receipts postmarked by the Post Office. When the green
signature cards are returned to you later by the Post Office, please mail or deliver them to us
before the scheduled hearing. If any envelope is returned "undeliverable", please advise
this office as soon as possible. If any signature card is not returned, please advise the
Board during the hearing and provide the card (when available).' These will be kept in the
permanent record as proof of all Notices.
2) Not Later July 21st: Please make arrangements to place the enclosed Poster on a
signboard such as cardboard, plywood or other material, posting it at your property for seven
(7) days (or more) until the hearing is held. Securely place the sign on your property facing
the street, no more than 10 feet from the front property line bordering the street. If you border
more than one street or roadway, an extra sign is available for the additional front yard. Please
deliver or mail your Affidavit of Posting for receipt by our office before July 27, 2010.
If you are not able to meet the deadlines stated in this letter, please contact us promptly. Thank
you for your cooperation. (PLEASE DISPLAY YOUR HOUSE NUMBER ALWAYS).
