(631) 765-1809 · Fax (631) 765-9064 FINDINGS, DELIBERATIONS AND DETERMIN~ITI~f~ MEETING OF August 18, 2010 ZBA FILE: 6391 NAME OF APPLICANT: Southold Free Library PROPERTY LOCATION: 53705 Main Road and Traveler St., Southold, NY CTM 1000-61-1-15.1, 15.2, 14 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated May 14, 2010 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP: This application is not subject to review under Chapter 268 because the variance relief requested does not involve features that relate to a regulated natural feature or a bulkhead or other shoreline. PROPERTY FACTS/DESCRIPTION: The Applicant's combined 77,589 sq. fi. parcels are located in the HB Hamlet Business District within the center of Southold. The northerly lot line measures 195.83 feet along Traveler St. The easterly lot line measures 508.79 feet along several adjacent properties. The southerly lot line measures 115.03 feet along Main Road S.R. 25. The westerly lot line measures 500.32 feet along an adjacent property. The existing buildings, and the proposed relocation of one building, the proposed main building addition, and proposed parking areas are shown on the site survey drawn by Robert Stromski, Registered Architect dated Sept. 18, 2009 revised 3/23/10. BASIS OF APPLICATION: Request for Variances from Code Section 280-46, based on an application for a building permit and the Building Inspector's October 13, 2009, Notice of Disapproval concerning proposed addition to a commercial building, at: height exceeding code permitted maximum number of two stories. RELIEF REQUESTED: The applicant proposes to construct what has been determined by the Southold Town Building Department to be a three [3] story addition to the main Library building. This number of habitable stories is not allowed by Town Code and requires a variance prior to being permitted to proceed with the proposed construction. ADDITIONAL INFORMATION: The Applicant's proposed additions are subject to site plan approval by the Southold Town Planning Board. The Planning Board has submitted a memorandum dated May 24, 2010 to the Zoning Board of Appeals expressing comments favorable to the application, and recommending approval of the Page 2- August 18, 20 I0 ZBA File#6391 Southold Free Library CTM: 1000-61-1-15.l,15.2,14 variance relief requested by the Applicant. These three properties owned by the Southold Free Library have been the subject of several past decisions of this Board. In Appeal 3145 the Board rendered a decision dated Aug. 11, 1983 approving a combined single family residential use and accessory art studio use in a building located on parcel 1000-61-01-15. In Appeal 3256 the Board rendered a decision dated Aug. 14, 1984 approving the division of land which created two lots, 15.1 and 15.2, from 1000-61-01-15. In Appeal 3861 the Board rendered a decision dated Oct. 4, 1989 approving an addition to the main Library building located on lot 1000-61-0 I-14. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application July 29, 2010, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Town Law §267-b(3){b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. A public library is a permitted use in the Hamlet Business District. No variances are requested for any setbacks. The proposed addition will improve public access to the library by establishing a street level entrance and plaza along Main Street at the basement level of the existing library. The overall height of the proposed addition will be the same as the existing library and will comply with the maximum building height allowed by Town Code. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance, because a new three-story habitable structure is not allowed in Town Code except through the grant of a variance. 3. Town Law §267-b(3)(b)(3). The variance granted herein is substantial considering the fact that new three story habitable structures are not permitted under Town Code. However, the proposed addition is for an extension of an existing three story public building being used as the Southold Town Free Library, and such a public use presents a compelling reason to grant the variance for the proposed three story addition. The overall height of the proposed new addition, at 33.7 feet, will not exceed the maximum height of 35 feet allowed by Town Code. 4. Town Law §267-b(3)(b}('4) No evidence has been submitted to suggest that a variance in this Hamlet Business District will have an adverse impact on the physical or environmental conditions in the neighborhood. There will be a significant increase to the available onsite parking, including more parking spaces for vehicles used by handicapped persons. Vehicle access to the parking will be by way of Traveler St., which is a less traveled road than is Main Road S.R. 25, which will also continue to have a pedestrian only access at the front of the building. 5. Town Law ~267-b(31(b}(51. The difficulty has been self-created, and is a result of the architectural design chosen by the Applicant for the proposed addition. However, given the substantial difference between the elevation of the existing library building above street level along Main Street and the adjacent property upon which the addition is to be built, the proposed three story design is the most feasible for the applicant to pursue, since it will avoid substantial re-grading and the creation of potential drainage complications. 6. Town Law l~267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a new addition, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Goehringer, seconded by Member Weisman (Chairperson), and duly carried, to Page 3 - August 18, 2010 ZBA File#6391 - Southold Free Library CTM: 1000-61-1-15.1,15.2,14 GRANT, the variance as applied for, and shown on the site plan survey and architectural drawings prepared by Robert Stromski and dated Sept. 18, 2010. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Sidor, Chair Members of the Planning Board Date May24, 2010 Re: Request for Comments for Southold Free Library Expansion SCTM#1000-61-1-14, 15.1 & 15.2 ZBA# 6391 The Planning Board received your request for comments regarding the above referenced application in connection with a site plan application currently being reviewed by the Planning Board for site design and development under the name Southold Free Library. The request is for a 3 story addition on the east side of the existing library in excess of the 2 story requirement as per the bulk schedule for the Hamlet Business zoning district. Variances are requested for the proposed addition building and the following comments are for the Board's consideration: Section 280-46 Bulk Schedule, Maximum number of stories allowed is 2 stories, the site plan shows a 3 story proposed building. 1. The proposed library expansion is a permitted use meeting setbacks. 2. The site has been previously developed and the proposed expansion will be in keeping with the existing use of the property and nature and character of the area. 3. The South portion of the property slopes down to the east where the addition is proposed. Although the proposed addition appears to be larger in size to the existing building, the scale and visual impact will be minimized by the proposed location. 4. The current'layout of the Library has the appearance of a 2 story building however there is an improved basement area and the addition being proposed will be in keeping to the current layout however, due to the grade of the property, the addition will have an appearance of a 3-story building from the front and east elevations. ZBA# 6391, Southold Free Library Page 2 May 24, 2010 5. Last, the proposed meets the definition for Max height allowed as per the bulk schedule of 35' feet. The Planning Board recommends approval of the variance relief requested for the above reasons and would add that the location of the addition is appropriate for the building itself and overall use of the site. Also included as part of the site plan are two additional buildings on site namely the library annex 1,250 sq. ft. proposed to be re-located on site for office space and The Friends of the Library building 657 sq. ft. for retail space. The property is located in the Hamlet Business Zoning District on the north side of Main Street (through street, Traveler Street), approximately 190 feet west of Beckwith Avenue, Southold. Reasons Supporting This Determination: An Environmental Assessment Form has been submitted and reviewed. Riverhead and Haven soils are representative of outwash plains; are well drained, and medium textured. The hazard of erosion is slight. Haven Loam normally occurs on outwash plains; is well drained, medium textured soils with slight hazard for erosion. Aerial analysis indicates that the proposed library addition is located on Riverhead and Haven soils. There are no engineering concerns associated with the soil series. Potential impacts to the soil stability have been mitigated with on-site drainage system as depicted on the Grading and Drainage Plan (S-2). Soil borings indicate that groundwater levels are greater than 17 feet. Therefore, the depth to groundwater is sufficient to meet the 3' separation distance required for sanitary systems per Suffolk County Department of Health standards. No substantial impact to groundwater is expected to occur if the project is implemented as planned. Impact of Water 1. Water Supply The proposed addition will be served by public water. 2. Sanitary Disposal Sanitary disposal will be managed by on-site underground sewage leaching systems. In 1978, the Long island Regional Planning Board published the Long Island Comprehensive Waste Treatment Management Plan (208 Study). The 208 Study identified eight (8) hydrogeologic zones in Nassau and Suffolk Counties. These zones were distinguished based upon differences in underlying groundwater flow patterns and water quality. The subject site is located within SCDHS Groundwater Management Zone IV, which according to Article VI of the Suffolk County Sanitary Code, has an allowable flow of 600 gallons per day (gpd) per acre in areas served by public water. The sanitary design flow is computed using SCDHS manual Standards forApprovel of Plans and Construction for Sewage Disposal Systems for Other Than Single Family Residences. Flooding The proposed improvements are located within FEMA Flood Zone X; areas identified as areas of moderate or minimal hazard from the principal source of flood in the area, therefore, the potential impacts from threat of flooding are Iow. Impact on Air No substantial adverse change in existing air quality is expected to occur. Impact on Plants and Animals The parcel is not located within a New York State Department of Environmental Conservation Critical Environmental Area or a New York State Department of State Significant Fish and Wildlife Habitat Area. The parcel(s) are developed. The proposed location of the 7,258 sq. ft. three-story addition on the east side of the existing library is currently an unimproved parking lot where a building was razed. The proposed parking areas are also proposed to be located on improved parcels. Therefore, the potential occurrence of rare or threatened plants or animals on site or within the vicinity of the site is Iow. The parcels are in lawn or residentially landscaped. Impact on Aesthetic Resources The parcels are located adjacent to a designated New York State Scenic Byway (S.R. 25) and west of Traveler Street. Historically, the site where the proposed addition would be located had been improved with buildings. The site is now an unimproved parking area and vacant.
