SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this
application and determines that this review falls under the Type II category of the State's List of Actions, without
further steps under SEQRA.
SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk
County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its
reply dated March 2, 2010 stating that this application is considered a matter for local determination as there
appears to be no significant county-wide or inter-community impact.
LWRP: This application is not subject to review under Chapter 268 because the variance relief requested does not
involve features that relate to a regulated natural feature or a bulkhead or other shoreline.
PROPERTY FACTS/DESCRIPTION: Subject property is a conforming 43,520 sq. ft. improved lot. It has 150 feet
of frontage on Stillwater Ave., 303.98 feet along the northern property line, 154.46 feet along the eastern property
line and 272.06 feet along the western property line. It contains a one story single-family dwelling, a detached
garage and storage building, an in-ground pool and two sheds as shown on a survey dated November 10, 2009
prepared by Nathan Taft Corwin, Ill, LS.
BASIS OF APPLICATION: Request for Variance from Code Section 280-15, based on an application for building
permit for "as built" addition to accessory garage, and the Building Inspector's April 16, 2009, Updated September
9, 2009 and January 11, 2010 Notice of Disapproval concerning "as built" addition to accessory garage, 1) less
than the code required side yard setback of 15 feet, 2) square footage exceeding the code required 750 square feet.
RELIEF REQUESTED: The applicant proposes to legalize the "as built" addition to the accessory garage, and is
requesting variances for side yard setback of 11.5 feet where the code requires 15 feet and the total square footage
of the structure of 882 sq. ft., where the code requires a maximum of 750 sq. fi. for a lot this size.
ADDITIONAL INFORMATION: At the May 20, 2010 Public Hearing the applicant was asked to provide
estimates from contractors as to the cost to separate the addition from the garage and have a separate building. At
the July 29, 2010 Public Hearing, the applicant provided an estimate from MJ Construction with a cost of
$8,700.00 to move the existing addition.
An interior inspection of the as built accessory structure was conducted by the Board with the applicant present,
and confirmed the applicant's testimony at the public hearing, that the addition to the garage is used by Mr.

Abrams, who is an artist, as a ~mall gallery to display his paintings. It is unheated, finished with sheetrock, and is
fitted with skylights and track lighting. The rest of the structure is used as an unfinished garage with storage.
FINDiNGS OF FACT/REASONS FOR BOARD ACTION:
The Zoning Board of Appeals held a public hearing on this application on May 20, 2010 and July 29, 2010 at
which time written and oral evidence were presented. Based upon all testimony, documentation, personal
inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant
and makes the following findings:
On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following
findings:
1. Town Law l~267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of
the neighborhood or a detriment to nearby properties. The existing garage and addition are both structures that are
customary in residential zones. Their current use is accessory to the principal use of the property. The "as built"
addition to the garage is not visible from the road.
2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible
for the applicant to pursue, other than an area variance. The benefit the applicant seeks is relief from the code
requirement that would compel him to remove an existing structure. After reviewing the evidence the Board finds
that the addition to the garage is located in the most logical location of this property and nothing will be gained
either by the applicant, the neighborhood, or the town if the structure were to be moved to a conforming location.
3. Town Law §267-b(3)(b)(3). The variances granted herein are substantial in that the side yard setback
represents a 23.3% relaxation from the code and the size of the accessory structure represents a 17.6% relaxation of
the code requirement. However, they are not substantial in so far as the applicant could have constructed a much
larger building separate from the existing garage without the need for a variance.
4. Town Law §267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential
community will have an adverse impact on the physical or environmental conditions in the neighborhood. The
addition has existed in its present configuration without incident. The addition of gutters and leaders into drywells
will further mitigate any adverse impact.
5. Town Law §267-b(3)(b)(5). The difficulty has been self-created. To the extent that the applicant constructed
the addition to his garage without the benefit of a building permit this difficulty has been self created. However, the
fact that the existing garage setbacks conformed to the code at the time it was constructed, any addition to the
structure along the property line would be considered non-conforming by current standards.
6. Town Law §267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the
applicant to enjoy the benefit of an accessory garage and studio while preserving and protecting the character of the
neighborhood and the health, safety and welfare of the community.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under
New York Town Law 267-B, motion was offered by Member Dinizio, seconded by Member Goehringer, and duly
carried, to
GRANT, the variance as applied for, and shown on the survey dated November 10, 2009, prepared by Nathan Taft
Corwin III Land Surveyor, and the "as built" architectural plans dated April 14, 2009, sheets A-l, A-2 and A-3,
labeled Abrams House Addition, prepared by Mark K. Schwartz, Architect.
Conditions:
1. No retail sales of art work shall take place on the subject premises
2. The accessory structure shall remain unheated and without plumbing

That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued
Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays
and/or a possible denial by the Building Department of a building permit, and may require a new application and
public hearing before the Zoning Board of Appeals.
Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's
diagrams or survey site maps, are not authorized under this application when involving nonconformities under the
zoning code. This action does not authorize or condone any current or future use, setback or other feature of the
subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are
expressly addressed in this action.
The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of
nonconformity.

Due to the uniqueness of this application, I will be addressing these questions to each of the four
variance requests being made.
An undesirable change will not be produced in the CHARACTER of the neighborhood or a
detriment to nearby properties if granted, because;
As this is an application for an existing addition to an accessory structure, we feel that it will not
change the character of the neighborhood. This building has matches the existing accessory
garage in appearance and scale, and we feel that it will not produce an undesirable change in the
character of the neighborhood.
The benefit sought by the applicant CANNOT be achieved by some method feasible for the
applicant to pursue, other than an area variance, because;
Due to the location of this addition, being attached to an existing structure, there is no way to
comply with the current setback standards without a variance.
The amount of relief requested is not substantial because;
The relief of the setback that we are asking for is slightly less than the existing structure that it is
attached to. As for the amount of lot coverage, the number is far below the allowable, but above
the allowable for an accessory structure. We feel that the 132 s.f. of additional structure is not
substantial in relation to the entire lot.
The variance will NOT have an adverse effect or impact on the physical or environmental
conditions in the neighborhood or the district because;
There will be no adverse effect or impact on physical conditions or environment due to this
project since it is already an existing structure.

APPLICATION FOR BUILDING PERMIT
INSTRUCTIONS
a. This application MUST be completely filled in by typewriter or in ink and submitted to the Building Inspector with 4
sets of plans, accurate plot plan to scale. Fee according to schedule.
b. Plot plan showing location of lot and of buildings on premises, relationship to adjoining premises or public streets or
areas, and waterways.
c. The work covered by this application may not be commenced before issuance of Building Permit.
d. Upon approval of this application, the Building Inspector will issue a Building Permit to the applicant. Such a permit
shall be kept on the premises available for inspection throughout the work.
e. No building shall be occupied or used in whole or in part for any purpose what so ever until the Building Inspector
issues a Certificate of Occupancy.
f. Every building permit shall expire if the work authorized has not commenced within 12 months after the date of
issuance or has not been completed within 18 months from such date. If no zoning amendments or other regulations affecting the
property have been enacted in the interim, the Building Inspector may authorize, in writing, the extension of the permit for an
addition six months. Thereafter, a new permit shall be required.

Building Zone Ordinance of the Town of Southold, Suffolk County, New York, and other applicable Laws, Ordinances or
