Michael Ellmore Patterson and Brandywine Trust Company, as Successor Trustees of the Trust under
Article Second of the Agreement dated January 20, 1992, by Anne Hyde Choate Patterson, as Grantor,
having an address c/o Brandywine Trust Company, 7234 Lancaster Pike, Suite 300-A, Hockassin,
Delaware 19707,
party of the first part, and
Thomas Hyde Choate Patterson, an individual having an address at 3 North Salem Road, Katonah, NY
10536,
party of the second part,
WITNESSETH, that the party of the first part, in consideration of Ten Dollars ($10.00) and other
valuable consideration paid by the party of the second part, does hereby grant and release unto the part of
the second part, the heirs or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected,
situate, lying and being in the
Hamlet of Fishers Island, in the Town of Southold, County of Suffblk, and State of New York, the same
being bounded and described as follows:
Beginning at a stone monument on the westerly line of Bell Hill Avenue, said monument being located
2158.05 feet northerly and 2935.67 feet westerly from the United States Coast and Geodetic Triangulation
Station "PROS" and running south 5 degrees 1 minute 20 seconds west 185.92 feet to a stone monument
abutting easterly on Bell Hill Avenue; thence south 68 degrees 32 minutes 10 seconds west 66.90 feet to
another stone monument; thence south 50 degrees 12 minutes 30 seconds west 63.92 feet to another stone
monument; thence south 43 degrees 30 minutes 10 seconds west 20.56 feet to another stone monument
bound, the last 3 lines abutting southeasterly on Equestrian Avenue; thence running north 66 degrees 20
minutes 20 seconds west 124.68 feet to another stone bound located 1942.58 feet northerly and 3191.67
feet westerly of said Triangulation Station "PROS", the last line abutting southwesterly on land now or
formerly of W.O. Morgan; thence running northerly and northwesterly along the easterly and
northeasterly shore of Hay Harbor to a plug in a rock, said plug being located 2197.32 feet northerly and
3289.90 feet westerly from said Triangulation Station "PROS"; thence running south 83 degrees 40
minutes 30 seconds east 356.39 feet to the point of beginning, the last line abutting northerly on land now
or formerly of Marie P. Guillard.
Being the same premises conveyed to Ellmore C. Patterson, as Trustee of the Trust under Article Second
of the Agreement dated January 20, 1992, by Anne Hyde Choate Patterson, as Grantor, by deed from
EIImore C. Patterson and Anne Hyde Patterson (a/k/a Anne Hyde Choate Patterson), as Trustees of Trust
under Article First of the Agreement dated January 20, 1992, by Anue Hyde Choate Patterson, as Grantor,
dated January 21, 2002, and recorded in Office of the Clerk of Suffolk County on September 20, 2002, in
Liber D00012210, page 246.
The Trustees being the Successor Trustees to Anne Hyde Choate Patterson and Ellmore C. Patterson,
under the Trust dated January 20, 1992, by Anne Hyde Choate Patterson, as Grantor.
TOGETHER with all right, title and interest, if any, of the party of first part, in and to any streets and
roads abutting the above described pre~nises to the center line thereof; TOGETHER witb the
appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE
AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and
assigns of the party of the second part forever.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenauts that the party
first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and
will apply the same first to the payment of the cost of the improvement before using any part of the total
of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
