DONALD P. WALZ and MYRA WALZ, husband and wife, both residing at 3302 Corinna Drive,
Rancho Palos Verdes, CA, 90275
party of the second part,
WITNESSETH, that the party of the first part, in consideration ofTEN ($10.00) Dollars, lawful money of
the United States paid by the party of the second part, does hereby grant and release unto the patty of the
second part, the heirs or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected,
situate, lying and being near the Village of Greenport, Town of Southold, County of Suffolk, and State of
New York, known and designated as lot no. 1 land the easterly one-half of lot no. 10 on a certain map
entitled, "Map of property of W.H. Young and R.J. Goodale, Greenport, L.I. made by D.R. Young,
surveyor, May 1926" and filed in the Suffolk County Clerk's office September 11, 1929 under the map No.
585, said tract or parcel of land is more particularly bounded and described as follows;
BEGINNING at a stake at the southeast comer of the premises herein described on the north side of Middle
Road;
RUNNIG THENCE South 78 degrees 55 minutes 40 seconds West along the north side of Middle Road
63.56 feet to a stake;
THENCE RUNNING North 17 degrees 37 minutes 50 seconds West 424.09 feet to Long Island Sound;
THENCE RUNNING North 60 degrees 35 minutes 00 seconds East along the Long Island Sound 75 feet to
the division line between Lots 11 and 12 as shown on the aforesaid map;
THENCE RUNNING South 16 degrees 18 minutes 50 seconds East along said division line 446.79 feet to
the point or place of BEGINNING.
TOGETHER WITH all the right title and interest, if any, of the party of the first part inand to the land lying
in the bed of the North Road in front of said lands to the center lines thereof and in and to the lands lying
below high water mark of Long lsland Sound adjoining said premises on the north. SUBJECT, however, to
any rights which the County of Suffolk may have in and to the road and road bed adjacent to the said
premises and on the southerly side thereof. .
[I BEING AND INTENDED TO BE THE same premises conveyed to the party of the f~st part by deed dated
I[December 4, 1980 recorded in the Office of the Clerk of the County of Suffolk in Liber 8930 at page 248.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof.
TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said
premises.
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been incumbered in any way whatever, except as aforesaid.
AND TIlE party ofthb first part, in compliance with Section 13 of the Lien Law, covenants that the party
of the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement, and
will apply the same first to the payment of the cost of the improvement before using any part of the total of
the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the
sense of this indenture so requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and year first
above written.
