TERMS AND CONDITIONS The Permittee Constantinos Markotsis, residing at 6540 Main Bagview Road, Southold, New York as part of the consideration for the issuance of the Permit does understand and prescribe to the following: That the said Board of Trustees and the Town {~f Southold are released fi.om any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and tl~e said Permittee assumes full liability with respect ther~o, Io the complete exclusion of the Board of Trustees of the Town of Southold. That this Permit is valid for a period of 24 months, which is considered to be the estimated time required to complete the work involved, but should circumstances warrant, request for an extension may be made to the Board at a later date. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to maintain the structure or project involved, to provide evidence to anyone concerned that authorization was originally obtained. That the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application may be cause for revocation of this Permit by resolution of the said Board. That there will be no unreasonable interference with navigation as a result of the work herein authorized. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to flee navigation, the said Permittee will be required, upon due notice, to remove or alter this work project herein stated without expenses to the Town of Southold. That the said Board will be notified by the Permittee of the completion of the work authorized. Box 2124 Greenport, NY 11944 RE: CONSTANTINOS MARKOTSIS 6540 MAIN BAYVlEW ROAD, SOUTHOLD SCTM# 78-5-12 Dear Ms. Costello: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, July 21,2010 regarding the above matter: WHEREAS, Costello Marine Contracting Corp. on behalf of CONSTANTINOS MARKOTSlS applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated May 25, 2010, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator issued a recommendation that the application b.e found Consistent with the Local Waterfront Revitalization Program policy standards, and, WHEREAS, Public Hearings were held by the Town Trustees with respect to said application on June 16, 2010 and again on July 21, 2010, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees have found the application to be Consistent with the Local Waterfront Revitalization Program, and, RESOLVED, that the Board of Trustees approve the application of CONSTANTINOS MARKOTSlS to maintenance dredge a 25'x35' area to a depth of -2.5' below mean Iow water removing approximately 75 cubic yards of spoil; approximately 30 cubic yards of dredge material will be removed form a 10'x35' area that encompasses Town owned bottom; spoil to be trucked off-sit to an approved location; with the condition of the installation of a silt boom prior to and dudng all intertidal operations surrounding the immediate project area; and as depicted on the site plan prepared by Costello Marine Contracting Corp., last dated July 8, 2010, and stamped approved on August 16, 2010. SCTM#78-5-12 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to us, it is our recommendation that the proposed action is CONSISTENT with the following LWRP policy standards and therefore is CONSISTENT with the policies of the program and therefore is consistent with LWRP. In the event that the action is approved; to further Policies 5. Protect and improve water quality in the Town of Southold, 6.3 Protect and restore tidal and freshwater wet/ands and Po/icy 11. Promote sustainable use of living marine resources in Long/s/and Sound, the Peconic Estuary and Town waters. If practical, it is recommended that the Board require that the silt boom be deployed during the construction of the structure pursuant to: § 275-11 Construction and operation standards. A. General. The following standards are required for all operations within the jurisdiction of the Trustees: (2) Erosion control. Installation of an erosion control structure is necessary during any building, grading, landscaping or site work activity within Trustee jurisdiction. This structure may include, but is not limited to, installation of a silt fence, hay bales, wood chip berm and silt booms. The placement of the erosion control structure(s) shall be determined by the Trustees or their designee. All intertidal construction and excavation requires the installation of a silt boom that will retain all suspended sediments within the immediate project area. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. DEVELOPED COAST POLICIES Polio/1 Foster a pattern of development in the Town of Southold that enhances community character, preserves open space, makes efficient uso of infrastructure, makes beneficial uso of a coastal location, and minimizes adverse effects of development. Our proposal is consistent with this policy in that this canal is used by the homeowner to engage in water dependent activities. The shoaled area is preventing the owner from using this section in front of his bulkhead at Iow tide. Removing this material will allow the owner access to his entire bulkhead with a small boat. Policy 2 Preserve historic resources of the Town of Southold. This project location has no significant historic resources. Polio/3 Enhance visual quality and protect scenic resources throughout the Town of Southold. Our proposal will not have any negative impacts on the visual quality or scenic resources. There are no structural components to our proposal. This proposal is consistent with the area. Areas in this canal have been dredge normally during bulkhead reconstructions and there was no impairment to the existing vegetation. The homeowner uses this property to access larger bodies of water to engage in water-dependent activities such as beating, fishing and water sport, etc... The area to be dredged is a small in area in front of the owner's bulkhead. Afrer the proposed dredging is complete, the surrounding area will not have any long term negative effects.
