a temporary steel sheet pile coffer dam to aid with footing and seawall construction; and
as depicted on the revised site plan prepared by Docko, Inc., last dated on August 29,
2012 and stamped approved on September 19, 2012.
Any other activity within 100' of the wetland boundary requires a permit from this office.
This is not a determination from any other agency.

We are transmitting herewith one original and two copies of the signed and sealed revised
drawings for the seawall restoration permit for Mr. Leonard Orr in Barley Cove Field on Fishers
Island, Town of Southoid Permit No. 7315 and 7315C.
We have made modifications to various notes on the application drawings, which includes the
installation of a temporary steel sheet pile cofferdam to aid with footing and seawall construction.
This work appears to be covered by the US Army Corps Nationwide Permit No. 3 and 1
confirmed that yesterday. Likewise it is consistent with NYS DEC Tidal Wetlands regulatory for
"adjacent areas", with no tidal wetlands or submerged aquatic vegetation resources on the site.
Preliminary indications are that the NYS DEC will process as a minor modification and we have,
accordingly, submitted the permit modifications documems.
I have enclosed a check for $100.00 for the Coastal Erosion and Tidal Wetlands permit
modifications.
I trust that you will fred these modifications acceptable and that we look forward to completing
the process for this project.

square feet and establish a 10' wide non-turf buffer landward of the new seawall all at
and landward of the high tide line; place 35 cubic yards, 80 tons of stone shoreline
protection along the face of the new wall waterward of the apparent high tide line and
landward of mean high water; and for the existing split-tell fence; and as depicted on the
revised site plan prepared by Docko, Inc. last dated October 21,2011, and stamped
approved on June 8, 2012.

Coastal Erosion and Tidal Wetlands
Dear Mr. King:
We are transmitting herewith one original and two copies of the signed and sealed drawing
modifications for the removal and reconstruction of an existing long-standing cast-h-place
seawall. This is the configuration that the NYS DEC has indicated their willingness to approve.
We also need to extend the permit one year, two if possible. We are in the process of staff
discussions with the DEC, DOS and the U.S. Army Corps of Engineers, for which they have
indicated their intentions to approve as well.
We have made other modifications to the drawings noting the requirement for a 10-foot wide
non- turf buffer behind the seawall. This strip will be planted with bayberry, beach plums, and
rossa ragnssa in accordance with our earlier stipulations.
I trust that you will find these revisions consistent with our previous presentations and look
forward to meeting with the Board on February 22, 2012.

TERMS AND CONDITIONS
The Permittee, Leonard Orr, residing at 300 West End. Ave., NY, NY, as part of the
consideration for the issuance oftbe Permit does understand and prescribe to the following:
That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee

That if future operations of the Town of Southold require the removal and/or alterations in

The Board of Town Trustees took the following action dudng its regular meeting held on
Wed., May 19, 2010 regarding the above matter:
WHEREAS, Docko, Inc. on behalf of LEONARD ORR applied to the Southold Town
Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code,
the Wetland Ordinance, and Chapter 111 Coastal Erosion Management, applications
dated March 23, 2010, and,
WHEREAS, said applications were referred to the Southold Town Conservation
Advisory Council and to the Local Waterfront Revitalization Program Coordinator for
their findings and recommendations, and,
WHEREAS, the LWRP Coordinator issued a recommendation that the applications be
found Consistent with the Local Waterfront Revitalization Program policy standards,
and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on May 19, 2010, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 and
Chapter 111 of the Southold Town Code, and,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town, and,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees has found the applications to be Consistent
with the Local Waterfront Revitalization Program, and,
BE IT FUTHER RESOLVED, that the Board of Trustees APPROVES the applications of
LEONARD ORR to remove 25 cy. of concrete seawall over 60 If.; remove 100+/-cy. of

is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.

PHOTO 1:
This photograph shows the sea wall at the Orr property along its western most extent. The
wall is approximately 200 +/- feet long and extends in a southwest to northeasterly
direction. This photograph was taken from the pier looking to the west. Notice in the
foreground, in front of the wall, there are cat tails, spartina altemiflora, and a field of
boulders. The growth on top of the wall on the landscaped edge is a combination of
Bayberry and Rosa Rigosa. It is the Orr's intention to maintain a vegetated fringe along
this area but trina some vegetation so as to maintain a trim and orderly appearance.
PHOTO 2:
This photo shows the midsection of the wall near the pier and northeast of the pier. These
stmctural cracks indicate the weaknesses of the slxucture. The steel band, shown at the
right of the seawall, was installed to hold the comer section to the main length of the
wall. It is in this area that there is no tidal wetlands vegetation and no submerged aquatic
vegetation and the bottom sediments are l'me silty sands scattered with boulders, where
the new boulder armoring will be placed. This structural bolstering on the outside of the
seawall is considered essential to maintaining the integrity of the remaining seawall since
the strength of the comer will be removed during the course of this project.
PHOTO 3:
This photograph shows the base of the midsection of the seawall, looking in a
northeasterly direction from the pier, approximately 10 feet out from the wall. The large
chunks of concrete that are missing, in most cases, show the point where a stone has
come out of the stone foundation support for the wall. The difference between the
original grouted stone structure and the skim coat are plainly evident in the two spalls,
one at the lower left and one at the upper right center of the photograph. This spear coat
offers no strength to the wall,. It merely provides a weather proof coating to preserve
some of the long term integrity of the structure. In the upper right hand comer there is a
spartina patens fringe marsh. The section of the wall that will be removed is from the
center of this photograph and to the upper right.

PHOTO 4:
This photo shows the comer of the wall. This clearly shows the subsidence of the easterly
comer and the patch work of steel plates that have been used to holding the remaining
structure in place. The foundation of this section of the wall has failed. It is felt that
removal of this section and armoring of the grounds with stone and geo-textile fabric will
provide the most natural features and yet retain soil stability in this area.
PHOTO 5:
This last photograph shows the northeasterly face of the grouted stone and concrete and
seawall looking in a southerly direction. Barley Field Cove is to the upper left of the
photograph and the boulders between the cove and Block Island Sound are visible in the
distance. The spartina patens marsh is also evident along the base of the seawall. The
limit of work is the outer face of the wall so that, upon completion of the project, there
will be transition from the vegetated tidal wetlands through the boulders to the upland
areas. It is anticipated that vegetation will be re-established in and amongst the boulders
to hold soil in those areas.

The proposed action has been reviewed to Chapter 268, Waterfront Consistency
Review of the Town of Southold Town Code and the Local Waterfront Revitalization
Program (LWRP) Policy Standards. Based upon the information provided on the LWRP
Consistency Assessment Form submitted to this department, as well as the records
available to me, it is my recommendation that the proposed action is CONSISTENT
with the Policy Standards and therefore is CONSISTENT with the LWRP provided
that the Board require a perpetual, natural vegetated buffer landward of the
seawall.
NATURAL VEGETATED BUFFER .. A land area of a certain length and width
where existing vegetation occurs prior to the commencement of any grading or
clearing activity. Vegetation shall be maintained to achieve a minimum
percentage of ground cover of 95%. To achieve the percentage of ground cover,
indigenous, drought-tolerant vegetation shall be planted. Survival of planted
vegetation shall be 90% for a period of three years. Maintenance activities within
the buffer are limited to removing vegetation which is hazardous to life and
property, trimming tree limbs up to a height of 15 feet to maintain viewsheds,
replanting of vegetation and establishing a four-foot-wide access path
constructed of pervious material for access to the water-body. [Added 12-15-2009
by L.L. No. 15-2009]
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in
preparing its written determination regarding the consistency of the proposed action.

BARLEY FIELD COVE, FISHERS ISLAND, NY
March 5, 2010
GENERAL
Mr. Orr owns property on a private road off Oriental Avenue (also known as East End
Road) located along the shore of Barley Field Cove on Fishers Island. The exposure is to the
east and the site is subject to occasional waves and flooding conditions depending on weather
conditions and wind direction. Mr. OWs property is approximately a 7.3 acre lot with a vertical
concrete and grouted stone seawall at the shoreline. This seawall structure is more than 200 feet
long and has been a long-standing feature at this site. The seawall condition has been reviewed
during previous permit applications for dock construction and reconstruction.
At this time, the seawall is suffering from deterioration involving severe cracking and
settlement at the easterly end/comer and the loss of mortar and in isolated areas, stone. Repairs
need to be implemented immediately in order to preserve the s~xuctural integrity of the wall;
however, it is felt that the easterly comer can not be saved. The attached narrative substantiates
the scope of work and provides responses to various concerns outlined in Local Law No. 6 2004,
relating to new Chapter 97 "Wetlands and Shoreline" of the Code of the Town of Southold.
SEAWALL REPAIR AND MODIFICATIONS
This project involves the localized repair and rehabilitation of the seawall and removal of
the easterly comer, replacing the existing structure with stone shoreline protection landward of
the apparent high water line which currently follows the face of the wall as demonstrated in the
photographs, permit application, drawings attached. This represents paff~al replacement of a
functional seawall in accordance with Sub-section B (la) of the Town of Southold Local Law
No. 6. R is anticipated that all work will be done from land.
This project will involve the removal of the easterly comer of the mortared stone and
concrete seawall.
· Work will involve, first of all, excavation behind the wall to remove any soil burden
which might be pressing against the existing concrete and stone structure. The next part
of the project will be to physically remove the steel attachment straps that secure the
comer to the existing free-standing seawall sections. The concrete wall will then be
pulled back onto the excavated backfilled shoreline so as to prevent its collapse into the
waters of Barley Field Cove.
· Fine grading of the backfill will then be accomplished and a geo-textile fabric will be
placed and staked onto the re-graded grounds.
· A geo-grid fabric will then be placed over the geo-textile fabric. This geo-grid is for load
distribution of the armor stone to be placed in this area. The geo-grid will be staked into
the ground as well. - -
The next involve placement of the armot~[one in a deliberate pattern,
alternating large stone along the toe of the mmaiuing seawall foundation and backfilling
with an assortment of smaller pieces but predominantly 2 to 3 foot diameter armor stone.
These pieces will be set in an interlocking pattern that will minimize the voids and at the
same time, maximize the protection of the geo-grid, geo-textile and underlying backfill
soils.
The ends of the existing concrete and grouted stone seawall will have to be carefully
etched and demolished in order to preserve the integrity of the wall and minimize the
exposed flat face of the seawall.
Armor stone consisting of 4-ft. diameter pieces along the toe and 2 to 3-f~. nominal pieces
between the toe and the remaining seawall will then be placed on the un-vegetated inter-
tidal sediments landward of mean low water and waterward of the existing seawall.
These boulders will be built up to form a maximum of a 3 to 1 slope facing the
southeasterly fetch and have a crest of between 5 and 10 feet on the waterside of the
seawall. The stone will be built up to approximately the same elevation as the existing
backfill behind the wall but no higher than Elevation 7 (mean low water datum) as
indicated on the application drawings.
There is a drop of about five feet fi.om the yard to the highest point of the bottom
sediments along the shore at the toe of the seawall. If the seawall were to fail or not be repaired,
excessive erosion could result. The localized repairs scope of work does not appear to require
machine excavation although the seawall replacement will. It is anticipated that work will be
done with heavy land based equipment, although materials can be delivered to the site by track
or barge.
The fixed wood pile and timber pier was rebuilt most recently approximately six years
ago with appropriate State, Federal and Town Permits. A copy of the previous permits are
attached as substantiation for this project.
REQUIREMENTS OF SECTION 97-25 OF THE WETLANDS LAW
The permittee acknowledges that the validity of this permit is or may be subject to the
approval of other governmental or municipal authorities.
The pennittee does, by the acceptance of this permit, assume all responsibility for
operations undertaken pursuant to this permit, and shall take all precautions for the prevention of
injuries to persons and property resulting fi.om such operations. By such acceptance, the
permittee also agrees to indemnify and save harmless the Town and its officers.
The permittee gives consent to the Town, the NYS DEC, the NYS DOS and the US
ACOE and their officers, employees and agents to enter upon the premises where such
operations are being conducted to make such inspections to determine whether said operations
are being conducted in conformity with the permit.
The permittee will notify the Town of Southold, Board of Trustees as well as State and
Federal agencies in writing one week prior to initiation of any and all operations.

The permittee x~'notify the Trustees in writing upon c~letion of operations such that
the site can be inspected for issuance for a certificate of compliance.
Most of tiffs project relates to seawall modifications, however, in response to Sub-section
2a and the General Rules for Standards of Residential and Commercial Docks, the following
additional information is offered.
Permits for the work through the Town, US ACOE, NYS DEC and NYS DOS are
being applied for simultaneously with coordination copies of each application
going to all agencies.
There are no anticipated adverse environmental issues to overcome in order for
this seawall rehabilitation to proceed although partial disassembly of the pier, may
be required in order to properly prosecute the work.
This pier is a fixed, pile-supported timber structure and therefore does not
adversely affect the free circulation of water or reduce the effects of fluctuating
water levels in Barley Field Cove. In addition, the project does not present an
adverse modification of the shoreline. The pier's elevation is such that in extreme
high tides the deck end will be flooded.
It is believed that the replacement of piles would only involve the inner bent and
then only if required for access to the wall. The work would involve pulling
existing piles and driving new piles in the same holes to the maximum extent
necessary in order to retain the existing pier alignment and support intervals. In
the event that split clamps or cross-bracing timbers are damaged during the
process, they will be replaced as a part of this project. Otherwise, existing
materials will be re-utilized. There is no plan to replace decking on the pier. It is
respectfully requested that the use of CCA pressure-treated piles and timbers be
approved for this project if required as discussed above. The structural timber
materials are specifically grown for this purpose and represent the standard of the
industry. With the connections described above, this structure will continue to be
able to survive repeated Inundations and even incident waves at higher tide
elevations.
The pier is currently decked with CCA pressure-treated Southern PIne which was
installed approximately ten years ago. This pier / walkway provide a safe
pedestrian surface for access to the berthed boat. There is no plan to replace
decking on the existing pier at this time. The existing decking is 6 years old or
thereabouts. Any leaching of the pressure-treatment chemicals has already
occurred.
The existing pier is a long-standing structure and is approximately centered on the
property. The property line offset clearance specified in this paragraph should not
be an issue because this project does not involve any real alternation or
realignment of the pier, merely removal and replacement of components as
necessary to allow the wall to be properly and fully repaired.
Upon receipt of the permit for this project, appropriate permit numbers will bt '
affixed to the most seaward face of the pier for identification from the water.

There are no permanent structures located above the pier decking nor are any
planned at this time.
It is not possible to provide a passage way on the upland to get around
this pier without substantially altering the seawall. There is however, room to
walk under the pier at low tide. It should be noted that the shore represents a
substantial drop-off of terrain and there is very little passable foreshore in the
intertidal zone. The foot traffic in this area is rare, if at all.
This pier is a permitted structure and was rebuilt approximately 6 years ago.
LOCAL WATERFRONT REVITALIZATION PROGRAM
The Orr's home makes an appropriate use of an existing residentially zoned waterfront property
on Fishers Island, fronting on Barley Field Cove. The seawall repair and modification proposed
comply with environmental design standards published by the NYS DEC, the NYS DOS Coastal
Management Program, the Southold Local Waterfxont Revitalization program, and Town of
Southold Local Law #6, dated 2004.
The seawall will remain in its same footprint and configuration as the existing structure and will
require dismantling and removal only at the easterly comer, 60 feet back along each face.
Them are no known historic or archeologically significant features on this site that would be
jeopardized as a result of this project. The vista and view of the harboring cove will not be
adversely affected or even noticeably affected by the proposed work. In the end, the proposed
armor stone shore front protection will be more in keeping with natural features of Fishers Island
and the remaining seawall will be less visible.
Barley Cove is acknowledged to be a flood prone area, exposed to waves from the southeast in
significant storms. The grouted stone and concrete seawall is a long-standing structure, which
has demonstrated its ability to withstand climatic factors, including waves, inundation, and ice or
debris forces. The foundation of the seawall at the comer, however, has deteriorated and has
begun to subside, indicating that it is approaching a point where collapse, or partial collapse, may
be a real possibility.
The proPOsed work is to maintain and restore structural integrity of the shoreline protection
system and alter it in such a way as to be more natural in its features and be capable of
supporting new habitat while providing the much-needed protection
The seawall is at the bottom of the hydrologic gradient of the water table, which is within the
area of exchange of marine salt water and natural ground water. This project will not adversely
affect the quality of water for drinking sources for Fishers Island.
There are no hazardous substances to be generated from this project. The solid waste from the
wall removal section will include fragments of stone and concrete from the demolition. This
material will be broken down into chunks, which can be reused as unclassified fill on local
projects. The fill can be utilized in the shoreline protection will be clean boulders from existing' '

stockpiles on the Islan~hey will not generate adverse envir~ental consequences as far as
water quality in Barley Field Cove.
There is virtually no public use of the water~ont in this area and the reconstruction of the
seawall above the apparent high water line and along the shoreline or on the toe of the seawall
are not likely to influence or change this characteristic. This is Ix/vate land and pedestrian access
to the site is virtually nonexistent.
This property is not used for any non-residential purpose. There is no energy or mineral mining
or processing operation at this site and no commercial activities currently exist or are planned
here. Materials removed t~om tiffs site will be stockpiled elsewhere for reuse in other projects.
In summary, review of the Waterfront Revitalization Program for the Town of Southold indicates
that this project is consistent with LWRP policies and will not create a significant adverse impact
on the environment either temporarily or in the long term. Attached are the Essential Fish Habitat
Assessment Worksheet for Federal Agencies and the Environmental Questionnaire for the U.S
Army Corps of Engineers, which have further information directly related to this project. Also
attached is the Town of Southold LWRP Consistency Assessment form, which has been
completed for this specific scope of work.
SUMMARY
This project represents the maintenance of a long-standing, shore protection waterfront
structure for the property of Leonard Orr on Fishers Island. The seawall has existed for decades
and pre-exists local zoning and permitting, State permitting and was in all likelihood existing at
the time of the US Army Corps of Engineers "grandfather" decision effectuated on December
16, 1968. In order to repair and maintain the seawall, the inner part of the pier may have to be
disassembled.
This seawall repair project, including the partial pier dismantling / reconstruction process,
appears to meet all the criteria for US Army Corps of Engineers Nationwide General Permit No.
14; coordination of this application with the US ACPE New York Regional Office is being
accomplished as a part of this submission. This project complies with all applicable standards of
Local Law No. 6, 2004 and its approval is respectfully requested.

Dear Mr. Maraglio:
Following up on our recent conversation, we have made modifications to the
application by Mr. Leonard Orr to reduce the amount of stone shorefront projection,
limiting it to covering an area landward of the mean high water line at this site. In order
to assure that we can provide for the long-term stability of the seawall to remain as you
suggested, we have added H-Piles which will be driven immediately in front of the
seawall and will brace the seawall with a wood wale at top and intermediate elevations.
This project will still include restoration of the seawall toe in order to retain as much
structural integrity as possible. The stone armoring will extend from the wetlands
vegetation west of the pier to the previously desired extent and across the comer as
previously agreed. These revisions also reflect the design modifications requested by the
Town of Southold at the Public Hearing on May 19, 2010. Specification tables for the
amount of stone, both volume and tonnage, have been added to the detail sheet (4) as
requested by the NYS DEC.
I trust that these revisions will allow you to approve this project as consistent with
the LWRP as well as the Coastal Management policies of the State of New York. We
believe that they are compliant. I appreciate your assistance in reviewing this matter.
