CONSTANCE L. COOPER,' residing at 8524 Overbrook Road, Fairfax,
Virginia 22031, individually as to her one-third hdivided
interest, if any, in real property-passing under ARTICLE FOURTH
of the Last Will and Testament of Clara E. Lang, deceased, as
admitted to probate in Surrogate's Court, Suffolk County, New
York on January 24 , 1994, and
CONSTANCE L. COOPER and BERTRAM C. COOPER III, both residing at
8524 Overbrook Road, Fairfax, Virginia 22031, as Co-trustees
under a Deed of Trust dated July 20, 1994 , and recorded in the
Suffolk County Clerk's Office on July 21, 1994 in Liber 11686 at
Page 352 ,
party of the first part, and
CHRISTIAN F. BAIZ, III and ROSAMOND PHELPS BAIZ, husband and
wife, both residing at 5 Oval Court, Bronxville, New York 10708,
party of the second part,

tem and other valuable considerations paid by the party
of the second part, does hereby grant and release unto the party
of the second part, the heirs or successors and assigns of the

buildings and improvements thereon erected, situate, lying and
being at Southold, Town of Southold, County of Suffolk and State
of New York,

hereto and made a part hereof, together with the

PARCEL ONE
ALL that tract and parcel of land situate East of the Village of
Southold, in the Town of Southold, County of Suffolk and State of
New York, bounded Northerly by the Main South Road or Highway
leading from Southold Village to Greenport and across Mill Creek;
Easterly by the several lands of A. W. Fismer, Henry J. Ritter,
Louis Wolferz and A. W. Fismer, formerly of Ruth Augusta Horton;
Southerly by Peconic Bay; and Westerly by land of late Mary E. H.
Terry, deceased, formerly of Daniel T. Terry, deceased, and
containing by estimation seventeen and three quarters ( 17-3/4 )
acres, be the same more or less,
TOGETHER WITH the appurtenances and all the right, title and
interest of the said party of the first part in and to the said
premises and in and to the fee in the South Road or Highway
adjoining and opposite thereto to the middle line of said highway
and in and to the waters and land under the waters of Peconic
Bay, adjoining and opposite to said premises.
BEING and intended to be the same premises conveyed by Ida
Schloegel to Robert Lang by deed dated the 1st day of October,
1919, and recorded in Suffolk County Clerk's Office in Liber 984
at Page 379 on the 6th day of October, 1919.
PARCEL TWO
ALL that tract and parcel of land situate in the Town of
Southold, County of Suffolk and State of New York bounded and
described as follows: beginning at a point on the westerly side
of Bayhome Avenue distant five hundred feet northerly from the
highwater mark of the north beach of Peconic Bay running thence
northerly along Bayhome Ave. one hundred feet; thence westerly
one hundred and ninety two feet to the land of Robert Lang;
thence southerly one hundred feet parallel with the easterly line
of Robert Lang's land, and thence easterly one hundred and ninety
two feet to the point of beginning on the westerly side of
Bayhome Avenue, subject to the usual restrictions which are upon
the adjacent properties.
TOGETHER with the appurtenances and all the estate and rights of
the parties of the first part in and to the said premises.
BEING and intended to be the same premises conveyed by Henry A.
Ritter and Hannah E. Ritter, his wife, to Robert Lang by deed
dated the 13th day of July, 1923, and recorded in the Suffolk
County Clerk's Office in Liber 1073 at Page 302 on the 13th day
of July, 1923 .

PARCEL THREE
ALL that tract or parcel of land situate East of the Village of
Southold, Town of Southold, County of Suffolk and State of New
York, bounded and described as follows: Commencing at a point on
the Westerly side of Bayhome Avenue at the northeasterly corner
of land of Henry A. Ritter, running thence Westerly along the
Northerly line of land of said Henry A. Ritter, One hundred and
ninety-two (192) feet to land of Robert Lang; thence Northerly
along the land of said Robert Lang, One hundred (100) feet;
thence Easterly One hundred ninety-two (192) feet to Bayhome
Avenue, thence Southerly One hundred (100) feet along Bayhome
Avenue to the point or place of beginning.
TOGETHER with the appurtenances and all the estate and rights of
the parties of the first part in and to the said premises.
BEING and intended to be the same premises conveyed by William E.
Fey and Marguerite E. Fey, his wife, to Robert Lang by deed dated
the 7th day of July, 1923 , and recorded in the Suffolk County
Clerk's Office in Liber 1077 at Page 154 on the 20th day of
August, 1923 .
PARCEL FOUR
ALL that tract or parcel of land and premises, hereinafter
particularly described, situate, lying and being in the Town of
Southold in the County of Suffolk and State of New York bounded
and described as follows: easterly by Bayhome Avenue beginning at
a point six hundred feet south of the south side of the County
Highway, and continuing one hundred and twenty five feet, more or
less, southward to the land of Robert Lang; thence westerly one
hundred ninety two feet to the land of Robert Lang; thence
northward to the land of Robert Lang; thence eastward along the
land of Robert Lang one hundred ninety two feet to the point of
beginning.
TOGETHER with all and singular the houses, buildings, trees,
ways, waters, profits, privileges, and advantages, with the
appurtenances to the same belonging or in anywise appertaining:
ALSO, all estate, right, title, interest, property, claim and
demand whatsoever, of the said party of the first part, of, in
and to the same, and of, in and to every part and parcel thereof.
BEING and intended to be the same premises conveyed by Arnold W.
Fismer and Bertha B. Fismer, his wife, to Robert Lang by deed
dated the 31st day of May, 1924, and recorded in the Suffolk
County Clerk's Office in Liber 1098 at Page 504 on the 3rd day of
June, 1924 .

PARCELS FIVE and SIX
TWO parcels of land situate in the Easterly part of the Village
of Southold, in the Town of Southold, County of Suffolk and State
of New York, and severally bounded and described as follows:-
The first parcel bounded Northerly by the Main South Road leading
from Southold to Greenport over Mill Creek; Easterly by Bayhome
Avenue; Southerly by the land of Arnold W. Fismer on a line at
right angles to the land of Robert Lang and six hundred feet from
the Main South Road; and Westerly by land of the said Robert
Lang, estimated to contain about two and three quarters acres, be
the same more or less.
The second parcel bounded Southerly by Peconic Bay; Westerly by
land of Robert Lang; Northerly by the land of Louis Wolferz ; and
Easterly by Bayhome Avenue, estimated to contain about one and
three quarters acres, be the same more or less.
TOGETHER WITH the appurtenances and all the right, title and
interest, dower and right of dower, of the said parties of the
first part in and to the said premises and every part and parcel
thereof, and in and to the fee of the highways adjoining and
opposite to said premises to the middle line of said highways,
and in and to the waters and land under the waters of Peconic Bay
adjoining and opposite to said premises so far as such right
extends.
BEING and intended to be the same premises conveyed by Arnold W.
Fismer and Bertha B. Fismer, his wife, to Clara E. Lang by deed
dated 15th day of October, 1919, and recorded in the Suffolk
County Clerk's Office in Liber 986 at Page 124 on the 12th day of
November, 1919, and then conveyed by Clara E. Lang to Robert Lang
by deed dated the 5th day of, October, 1929, and recorded in the
Suffolk County Clerk's Office in Liber 1461 at Page 370 on the
7th day of October, 1929.
SUBJECT TO AND LESS AND EXCEPT PARCEL SEVEN
ALL that certain plot, piece or parcel of vacant land, situate,
lying and being at Southold, in the Town of Southold, County of
Suffolk and State of New York, bounded and described as follows:
BEGINNING at a point on the southerly boundary line of land of
Mary Lang Baiz distant South 52 degrees 44 minutes 00 seconds
West 110 feet from a point on the westerly line of Bay Home Road
which is the southeasterly corner of said land of Mary Lang Baiz;
running thence from said point of beginning along said land of
Mary Lang Baiz North 52 degrees 44 minutes 00 seconds East 110
feet to the said westerly line of Bay Home Road; running thence
along the said westerly line of Bay Home Road South 37 degrees 16
minutes 00 seconds East 394 . 11 feet to the ordinary high water

mark of Southold Bay; running thence along the said ordinary high
water mark of Southold Bay southwesterly then southerly along a
jetty, then southwesterly to a point which is South 37 degrees 16
minutes 00 seconds East about 394 feet from the point of begin-

Clara E. Lang North 37 degrees 16 minutes 00 seconds West about
394 feet to the point of BEGINNING.
TOGETHER with all right, title and interest, if any, of the party
of the first part in and to any streets and roads abutting the
above described premises to the centerlines thereof; TOGETHER
with the appurtenances and all the estate and rights of the party
of the first part in and to said premises.
BEING and intended to be the same premises conveyed by Clara E.
Lang, as devisee under the last will and testament of Robert
Lang, deceased, as probated in Surrogate's Court of Suffolk
County on March 20, 1959, and recorded in Will Book 217 at Page
510 in the records of the said Surrogate' s Court, to Mary Lang
Baiz and John Baiz, her husband, by deed dated 23rd day of July,
1973, and recorded in the Suffolk County Clerk' s Office in Liber
7449 at Page 17 on the 24th day of July, 1973 , and, as corrected
in a deed of correction dated 31st day of August, 1973 , and
recorded in the Suffolk County Clerk's Office in Liber 7484 at
Page 224 on the 10th day of September, 1973 .

ALL that certain plot, piece or parcel of land, with the build-
ings and improvements thereon erected, situate, lying and being
at Southold, Town of Southold, County of Suffolk, State of New
York, bounded and described as follows:
BEGINNING at a point on the westerly side of Bay Home Road at the
northeasterly corner of land of Mary Lang Baiz and husband; from
said point of beginning running along said last mentioned land
South 52 degrees 44 minutes 00 seconds West 192 . 00 feet to the
land of Clara E. Lang; running thence along said land of Clara E.
Lang, two courses as follows: 1) North 37 degrees 16 minutes 00
seconds West 209 .00 feet; 2) North 52 degrees 44 minutes 00
seconds East 192 . 00 feet to the said westerly line of Bay Home
Road; running thence along the said westerly line of Bay Home
Road, South 37 degrees 16 minutes 00 seconds East 209. 00 feet to
the point or place of BEGINNING.
TOGETHER with all right, title and interest, if any, of the party
of the first part in and to any streets and roads abutting the
above described premises to the centerlines thereof; TOGETHER
with the appurtenances and all the estate and rights of the party
of the first part in and to said premises.
BEING and intendied to be the same premises conveyed by Clara

Batterman Lang, as devisee under the last will and testament of
Robert Lang, deceased, as probated in Surrogate's Court of
Suffolk County on March 20, 1959, and recorded in Will Book 217
at Page 510 in the records of the said Surrogate' s Court, to
Robert Lang Baiz and Nancy Miller Baiz, his wife, by deed dated
22nd day of December, 1975, and recorded in the Suffolk County
Clerk's Office on the 13th day of January, 1976 in Liber 7972 at
Page 291, and later conveyed by Nancy Miller Baiz to Robert Lang
Baiz by deed dated the 4th day of April, 1989, and recorded in
Suffolk County Clerk' s Office in Liber 10924 at Page 495 on the
9th day of September, 1989.
THE AFORESAID BEING and intended to be all right, title, interest
and estate in real property which was devised, bequeathed and
given to Constance L. Cooper under ARTICLE FOURTH of the Last
Will and Testament of Clara E. Lang, deceased, as admitted to
probate by Surrogate' s Court of Suffolk County, New York, on
January 24 , 1994 , and subsequently transferred to Constance L.
Cooper and Bertram C. Cooper III as Co-trustees under the said
Deed of Trust dated July 20, 1994 , and recorded in the Suffolk
County Clerk' s Office on July 21, 1994 in Liber 11686 at Page
352 .
THE AFORESAID BEING SUBJECT TO a Quitclaim Deed, dated July 13 ,
1996, executed by the party of the first part wherein the party
of the first part withdrew with prejudice the claims and
allegations in the aforesaid Deed of Trusti,Ft' - A�th -_w
