4. Sworn statement from plumber certifying that the solder used in system contains

After an site inspection, a average ceiling height calculation was performed on the space
above the second floor, it is deemed habitable because not more tban 50% of this space
between the top of floor beams and the ceiling level is less than 7'-6' in height. Tiffs
Structure is also equipped throughout with an automatic sprinkler system installed in

Upon a site inspection made this date of the space above the second floor, although the
space is insulated, sheetrocked, heated, and contains a wet automatic sprinkler system in
accordance with NFPA 13D and meets with the criteria for habitable space in accordance
with the New York State Uniform Fire Prevention and Building Code it is deemed
uninhabitable because it is unfinished and the access to the space is through a second

sets of plans, accurate plot plan to scale. Fee according to schedule.

Dear Mr. Coggins:
Based on the information you have submitted the Department of Environmental Conservation
(DEC) has determined that the property landward of the bulkhead, as shown on an aerial
photograph dated 4/6/76, which existed prior to August 20, 1977, is more than 100' feet in length
and remains functional, is beyond Article 25 (Tidal Wetlands Act) jurisdiction.
Therefore, in accordance with the current Tidal Wetlands Regulations (6NYCRR Part 661) no
permit is required.
Be advised, no construction, sedimentation, or disturbance of any kind may take place

consideration in this application and determines that this review falls under the Type II
category of the State's List of Actions, without an adverse effect on the environment if
the project is implemented as planned.
PROPERTY FACTS/DESCRIPTION: The applicant's 41,206 sq. ft. parcel is improved
with a two-story wood frame dwelling, garage (under construction) and swimming pool
(under construction), as shown on the survey prepared by Stanley J. Isaksen, Jr. dated
October 21, 2002. The property consists of two formerly identified County Tax Map Nos.
13 and 14, which are now combined to form a single lot, identified on the County Tax
Maps as Lot 14.1.
For the record it is noted that the former Accessory Bed and Breakfast was removed and
is no longer in effect for the existing single-family dwelling.
BASIS OF APPLICATION: Building Department's May 3, 2003 Notice of Disapproval,
amended May 16, 2003, citing Section 100-30A.3 in its denial of a building permit to
construct an addition and roof repairs to the existing dwelling with a single side yard at
less than 15 feet and less than 35 feet for a combined side yard total. The applicant
voluntarily merged former County Parcel Nos. 13 and 13 and removed the Accessory
Bed and Breakfast Use. Formerly the northerly setback was a side yard, before the
parcels merged. Currently, both yards meet the definitions of the Zoning Code as front
yards as fronting along mapped streets (Jackson Street to the north and Fifth Street to
the west).
FINDINGS OF FACT
The Zoning Board of Appeals held a public hearing on this application on July 24, 2003,
at which time written and oral evidence were presented. Based upon all testimony,
documentation, personal inspection of the properly, and other evidence, the Zoning
Board finds the following facts to be true and relevant:
AREA VARIANCE RELIEF REQUESTED: Applicant wishes to redesign and reconstruct
the existing open porch facing Jackson Street, with alterations to the existing dwelling,
as shown on the plot plan and construction diagram prepared by Donald G. Feller,

Architect dated 5/6/2003. The setbacks of the dwelling are 5.9 feet and 9 ft. from the
west property line along Fifth Street, at its closest points.
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials
submitted and personal inspections, the Board makes the following findings:
1. Grant of the relief requested will not produce an undesirable change in the character
of the neighborhood or a detriment to nearby properties. Applicants propose the
reconstruction and rehabilitation of existing porch areas, along with reverse gable roof,
as shown on the plan dated/5/6/2003 prepared by Donald G. Feller, R.A. After physical
inspection, it was realized that the dwelling is a renovated 70+ year old structure which
was exposed to weather conditions on the north side of the home. The proposed new
construction measures 44' x 7', leaving a 9 ft. setback from the lot line facing Fifth Street.
The new porch construction is one-story in height and maintains the same setback as
the existing house. The renovation and rehabilitation are necessary and will create no
impact on surrounding properties.
2. The benefit sought by the applicant cannot be achieved by some method, feasible for
the applicant to pursue, other than an area variance. The dwelling has existed for more
than 50 years in its nonconforming location and the reconstruction is needed for repairs
and upgrade. The new construction is in-place, in-kind renovation of the pomhes and
construction of alternative roof design, for which a variance is needed to complete.
3. The relief requested is substantial because the code requires a minimum 50 ft. front
and the relief is for a 9 ft. setback from the lot line facing the area noted as Fifth Street.
Although the house has existed in the present location for over 70 years, the variance
will authorize a reduction of 41 feet from the setback requirement.
4. The difficulty was self-created in that this area could have been addressed in 1999-
2000, during the major renovations that took place when the applicant took title.
5. No evidence has been submitted to suggest that the relief granted herein will have an
adverse impact on the physical or environmental conditions in the neighborhood. The
construction is landward of the existing dwelling and does not affect the adjacent
waterfront areas.
6. Grant of the alternative relief is the minimum action necessary and adequate to
enable the applicant to enjoy the benefit of a new porch addition with alterations, while
preserving and protecting the character of the neighborhood and the health, safety and
welfare of the community.

dwelling to 21/= stories, and the construction constitutes a third story.

and personal Inspections, the Board makes the following findings:
1. Grant of the variance will not produce an undesirable change in the neighborhood or a
detriment to nearby properties. The applicants' home was built about 50 years ago. The
restoration of the home commenced in or about September 2003, after issuance of a building
permit (29726Z) for construction of a covered porch and roof repair. During restoration,
structural problems were found, and based on the advice of the engineer, additional work

was necessary for structural supports. In the restoration, work was undertaken to modify
the height of the ceiling in the attic.
2. The benefit sought by the applicant cannot be achieved by some method, feasible for the
applicant to pursue. During the last couple of years, similar third story variance relief has
been considered. The relief requested is for a modified ceiling/attic roof area, and the
proposed restoration included the existing third floor. The applicants in this request
indlcatad that they are not planning to use the upper third level for habitable or living area.
3. The variance is not substantial. A third-story living or habitable area does not exist and
will not be created. The requested increase of nonconformance is related to the a third level,
above 2-112 story height, and not the code restricted 35 ft. maximum building height. The
roof addition is within the footprint of the building, maintaining the same setback without
creating any new nonconformance in height or setbacks.
4. No evidence was submitted during the hearing or in the written record to indicate that this
variance will have an adverse impact on the neighborhood or district.
5. Grant of the variance is the minimum action necessary and adequate to enable applicants
to enjoy the benefit of an addition, while preserving and protecting the character of the
neighborhood and the health, safety, and welfare of the community.

construction that has occurred on your property has yet to be approved by this department
and you are occupying the property without the benefit ora certificate of occupancy.
As you know, it had come to our attention, in early 2004, that the above referenced
project had gone beyond the scope of the above referenced permit. In August 2004, you
submitted amended drawings showing the complete scope of work. On August 24, 2004,
a letter was issued by Chief Building Inspector Michael Verity, which expressed the need
for a number of approvals and items required to amend the permit.
Although you have satisfied most of those requirements and submitted most of the
information we requested, we are still not in possession of an approval from the New
York State Department of Environmental Conservation.

20 unfounded, baseless and meritless claims against us to the Depmiment of
Environmental Conservation, the Southold Town Board of Trustees, the
Southold Town Building Depmtaient and the Southold Town Police
Depafia~ent. No charges or violations have ever been issued because there
has never been a basis for, or evidence that supports, any of the COi~laint$.
The continued co,,!,laints to governmental agencies is done with the intent
to coerce us into removing a bulkhead groin, which is difficult to traverse by
beach walkers. This groin protects our land from being washed away by the
ebb and flow of the fide. We refuse to remove it. They continue to use
governmental agencies to harass ns. Shannon Simon is so obsessed with
our property that after two years of trespassing we finally had to file trespass

Dear Mr. Verity:
I submitted an application for Certificate of Occupancy and all
documentation required for the issuance of a Certificate of Occupancy. As
of today, I have not received the Certificate. Please be advised of the
following sequence of events:
On March 11, 2010, at my final inspection, the Building Inspector raised
five (5) issues:
1. A second kitchen in the basement needs approval.
2. Dryer vent must be metal.
3. Need access to attic.
4. Need access to garage.
5. Electric and Plumbing certificate required.
On March 15, 2010, the Building Inspector arrived to determine compliance
with the above issues:
1. I showed the Inspector a copy of the 1990 Certificate of
Occupancy, which is for a two (2) family dwelling with a seasonal
apartment.
2. I showed the Inspector that the dryer vent was replaced with metal.
3. I made an access area hole in the ceiling of our bathroom. I
provided the Inspector with a ladder, and I held it for him while he
climbed up to take a look. He said he saw a wall, sheetrock and a
wire.
4. Before the Inspector left the house, the Inspector said he needed
access to the garage. I informed the Inspector that I already have a
Certificate of Occupancy for the garage, and the final inspection
was for the renovations to the house as applied for not the garage. I
denied him access. The Inspector became irritable and demanded
access. I refused. With all due respect, the Building Inspector does
not have a right to access my garage.
5. I provided the Building Department with the Plumbers Certificate
and the Electrical Certificate.
The inspection report dated March 15, 2010 states:
"Dryer vent is now metal. Attic has walls, sheetrock & wiring.
Attic must be returned to non-habitable space, remove all walls,
sheetrock, wiring, etc. ZBA approval dated November 4, 2004,
#5601, states"l.The Third story shall be non-habitable space, 2.
The Board reserves the right to inspect in the future."
As of this date (6 years later), the ZBA has shown no interest to inspect my
house, and I am not sure if their reservation to inspect is permissible under
the law.
Therefore, the only reason that the Building Department is apparently
refusing to issue a Certificate of Occupancy for the renovations to my house
is because it is claimed that the wall, sheetrock and wire in the attic/third
floor makes it habitable space. Not true. The only access to the third floor
is a ceiling access opening. In order for the space to be habitable, there must
be stairs to make it accessible for habitation purposes. See, Sections 713.1
and 714.1 of the New York State Uniform Fire Prevention and Building
Code. Moreover, all attics have wire, and some have walls and sheetrock.
Such items do not arise to the level of habitable space.
Yesterday, I spoke to Code Enforcement Officer, who informed me that he
was intending to violate me for living in the house without a Certificate of
Occupancy, and that the Certificate of Occupancy for the house would not
be issued unless access was given to the garage. I do not understand where
the hostility comes from. I do not understand the reluctance in issuing a
Certificate for the renovations as applied for since I have always had a good
relationship with you and the Enforcement Officer.
I hope that this is merely a misunderstanding.

I respectfully ask that you issue the Certificate of Occupancy as applied for.
The third floor/attic is not habitable because there is no access to it other
than through a small access hole in the ceiling of the second floor.
If you decide not to issue the Certificate of Occupancy, then please send me
a letter setting forth the basis of your decision not to issue the Certificate of
Occupancy. Thank you.

Donna C. Goggins on Jackson Street, New Suffolk (TM 1000-117-I0-14), subsequent to
the issuance of Certification of Occupancy No. Z-29852 in November, 2003:
Neighbors have reported the following work being done at the Gogg/ns garage structure.
Sheetrock deliveries and spackle buckets have been seen in the garage area.
Utility company employees were seen on the site and said they were installing gas lines.
Sheetrock was seen being lifted from a truck to the upper floor above the garage.
Erection and painting of partitions on second floor of the garage structure was observed
through windows. Painting of walls in the first floor area at the side sections adjacent to
the garage bays was also observed at night.
Painting in the interior of the north and south wings was observed at nights of March 8th
and 9th 2004, respectively.
For several months prior to this complaint, the windows on the east and north side above
the garage painters' were covered by tarpaulins, apparently put to prevent neighbors
from seeing construction being carried out inside.
A truck beating the sign of Kolb's heating and air-conditioning service was observed in
the driveway on March 20, 2004.
Floor-sanding equipment was brought into the structure early in the morning of Sunday,
March 21, 2004. The sound of sanding machinery could be heard from the street as well
as from adjacent properties throughout much of the day.

not been obtained for the work currently being done on the house belonging to William Goggins
on Jackson and Fifth Streets in New Suffolk Inasmuch as there is considerable evidence that
this work has placed the property in significantly greater noncomformity with the Code, we are
asking that a Stop Work Order be granted immediately and remain in effect until all necessary
variances and permits are obtained~

I want to express our confusion and conce,_'n .,'Jout the way in which the $outhold Town
Building Department and the Board of Tro~'t~ es selectively enforce the building code.
We are referring to the new home constr,.~c, tion ?,t the southeast end of New Suffolk Road
(Fifth Street) in New Suffolk. We have cv~;~iv~ed that this new home construction is
occurring without the proper permits. Penni~, dated from 2003 encompass only a new
pool and small porch facing .rackson Street. This home has been demolished and is being
built anew. Why is this permitted? We un&:stand that the law states a builder who
knowingly conducts work of this magnitude withow, the proper permits can lose his
license. Why do these builders have immunity? What is the owner - William Goggins'
relationship with the Town and/or the Trustees which allows him to cireumvem the law?
It is disturbing that Mr. Goggins, a prominera :.~omey in the Town of Southold with
apparent connections within the building de?/,ment and the Boant of Trustees. receives
favorable treatment from the Town to cons¥~:6t an illegal rasidenee above his garage, and
build a new home (with an additional floor), without the proper permits.
Another flagrant disregard for your office ,md t?.e approval process is the initial
construction of a third floor bayside sun deck. ',Vhile plans for two other bayside decks
have been submitted for review by the Tru3te¢;s at their 8/18 meeting, this third slrneture
has not been accounted for.
The foregoing facts give thc impression that knowk~g the right people in the $outhold
Town Building Department gains privileges that the rest of the taxpayers do not enjoy.
What is known:
There is an illegal residence above the garage.
Runoff from this illegal residence is damag!.~ aeighbors' property.
Building is ongoing without proper permits.
The new home (which now has three floo:'~ as opposed to two) has now become the
tallest structure in New Suffolk.
What is unknown:
Why Mr. Ooggins is able to disregard the b~,ilding code?
Why these actions are permitted?
Why the builders have immunity?
What you are going to do about it?
Although we have chosen to remain anonymous for fear of reprisal from Mr. Ooggins,
we do not intend to drop this matter without your prompt action. We do not wish to
personally engage in any additional unpleasant confrontations with Mr. Goggins - bis
connections are evidently far r~aching.

The Building Inspector may revoke a building permit theretofore
issued and approved in the following instances:
