The following action was taken by the Southold Town Board of Trustees at their Regular
Meeting held on Wednesday, December 14, 2011:
RESOLVED, that the Southold Town Board of Trustees APPROVE the Amendment to
Wetland Permit#7330 to increase the size of the proposed first floor addition and
reconfiguration of the existing brick walkways; with the condition of a 15' wide no
mowinc, natural grass and vegetated buffer area along the water'sed�1c a which is to be
maintained; the removal of the goose fence; and as depicted on the revised site plan
prepared by Garrett A. Strang, Architect, last dated November 18, 2011, and stamped
approved on December 23, 2011.
The Permittee is required to provide evidence that a copy of this Trustee permit
condition has been recorded with the Suffolk County Clerk's Office as a notice covenant
and deed restriction to the deed of the subject parcel; and as per Chapter 275-10 of the
Town Code-Wetlands and Shorelines.
Any other activity within 100' of the wetland boundary requires a permit from this office.
This is not a determination from any other agency.

Dear Ms. Hertel:
The Department of Environmental Conservation (DEC) has reviewed your request to modify the above
referenced permit in accordance with the Uniform Procedures Regulations (6NYCRR Part 621). It has been
determined that the proposed modifications will not substantially change the scope of the permitted actions or
the existing permit conditions. Therefore, the permit is hereby modified to authorize:
Increase in the size of the proposed first floor addition and reconfiguration of the existing
brick walkways. All work must be done according to the plan prepared by Garrett A. Strang
last revised 11/18/11 and stamped NYSDEC approved on 12/8/11.
Condition 13 has been modified and condition 18 has been added as follows:
13-Work Area Limits: All work (except for mitigation planting), disturbance, and or
storage of construction materials shall be confined to within the limit of clearing and ground
disturbance as described in the original permit.
18-Miti.qation P!antinq Requirement: Six native weft&nd shrubs, a minimum of 3 feet in height,
shall be planted adjacent to the "Line of Existing Natural Vegetation-Approximate Location Of
Freshwater Wetland-8/17/10" as shown on the approved plans.
The intention of the planting is to increase the natural buffer to the wetland. The shrubs shall
be planted between 4 and 6 feet apart and planted within 4 feet of the existing line of natural
vegetation. There shall be no cleadng of vegetation or mowing between the new shrubs or
between the new shrubs and existing vegetation (except to remove vegetation directly adjacent
to the new shrubs, 1 foot radius, that threaten to harm the new shrubs). Eventually, as native
vegetation grows in, the edge of the buffer will equal the newly planted shrub line. Suggested
shrubs: highbush blueberry, swamp azalea/pussy willow, sweet pepperbush, spicebush-no
hybrids or cuitivars.

Dear Ms. Doherty and Members of the Board:
I have enclosed herewith Five (5) copies of an amended Site Plan dated November 18, 2011 for your
review and records in the above referenced matter, which will replace the map upon which your permit #
7330 was granted. In addition, I have included a check in the amount of $50.00 as payment of the fee for
the amendment.
The reason for the modification is due to a change in the family needs necessitating an additional
bedroom be constructed as well as an existing bathroom be modified. Due to the existing floor plan of the
house, this is the only practical area for the purpose of bedroom addition and bath modification.
The extent of the modification is as follows:
Increase in the size of the proposed first floor addition and reconfiguration of the existing brick
walkways. Please note that the majority of the proposed addition is below an existing second floor
deck. As part of the work, this deck will be reconstructed and become the roof of the addition as
well as function as a roof deck. The new setbacks have been shown on the Site Plan.

Pursuant to the provisions of Chapter 275 and/or Chapter 111 of the Town Code of the Town of
Southold and in accordance with the Resolution of the Board of Trustees adopted at the meeting l~eld on

IN WITNESS WHEREOF, the said Board of Trustees hereby causes its Corporate Seal to be affixed,

TERMS AND CONDITIONS
The Permittec Renate Hertel, residing at 205 Cedar Point Drive West, Southold, New York as
part of the consideration for the issuance of the Permit does understand and prescribe to the
following:
That the said Board of Trustees and the Town of Southold are released fi.om any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto~ to the complete exclusion of the Board of
Trustees of the Town of Southold.
That this Permit is valid for a period of 24 months, which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved, to provide evidence to anyone concerned that
authorization was originally obtained.
That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
That there shall be no interference with the fight of the public to pass and repass along the
beach between high and low water marks.
That if future operations of the Town of Southold require the removal and/or alterations in
the location of the work herein authorized, or if, in the opinion of the Board of Trustees,
the work shall cause unreasonable obstruction to free navigation, the said Permittec will be
required, upon due notice, to remove or alter this work project herein stated without
expenses to the Town of Southold.
That the said Board will be notified by the Permittec of the completion of the-work
authorized.
That the Pcrmittee will obtain ail other permits and consents that may be required
supplemental tO this permit, which may be subject to revoke upon failure to obtain same.

Dear Mr. Strang:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, June 16, 2010 regarding the above matter:
WHEREAS, Garrett A. Strang, Architect on behalf of RENATE HERTEL applied to the
Southold Town Trustees for a permit under the provisions of Chapter 275 of the
Southold Town Code, the Wetland Ordinance of the Town of Southold, application
dated May 24, 2010, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator issued a recommendation that the application be
found Consistent with the Local Waterfront Revitalization Program policy standards,
and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on June 16, 2010, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,

WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees have found the applica{ion to be Consistent
with the Local Waterfront Revitalization Program, and,
RESOLVED, that the Board of Trustees approve the application of RENATE HERTEL
to construct a 5'x12' addition on the first floor underneath existing second-floor deck;

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment
Form submitted to this department, as well as the records available to me, it is my
recommendation that the proposed action is CONSISTENT with the Policy Standards and
therefore is CONSISTENT with the LWRP.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in
preparing its written determination regarding the consistency of the proposed action.

proposed actions that are subject to the Town of Southold Water~ont Consistency Review Law. This
