The portion of the property that is landward of the existing bulkhead greater than 100 feet in length and constructed prior to 8/20/77, as verified on NYSDEC Tidal Wetlands Map # 716-550 and shown on the survey prepared by Roderick Van Tuhl on 9/28/79, is beyond the jurisdiction of Article 25 Tidal Wetlands. Therefore, in accordance with the current Tidal Wetlands Land Use Regulations (6 NYCRR Part 661) no permit is required under the Tidal Wetlands Act. Please be advised, however, that no construction, sedimentation, or disturbance of any kind may take place seaward of the tidal wetlands jurisdictional boundary~ as indicated above, without a permit. DEVELOPED COAST POLICIES Policy 1 Foster a pattern of development in the Town of Southold that enhances community character, preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location, and minimizes adverse effects of development. The existing staircase is in poor condition due to the bulkhead falling. The owner is trying to maintain the integrity of the stalmase to ensure that is safe for his family to use to access the water. Our proposal will not have any effect on the community character or preservation of open space. Policy 2 Preserve historic resources of the Town of Southold. This property has no significant historic resources. Policy 3 Enhance visual quality and protect scenic resources throughout the Town of Southoid. The present condition of this staircase is unstable. Repairing the staircase is just an attempt of the upland property owner to maintain his property. So the visual quality and scenic resources will be restored to when the area was stable. NATURAL COAST POLICIES Policy 4 Minimize loss of life, structures, and natural resources from flooding and erosion.
