The Planning Board received the SEQR Report from our consultant NPV and it was reviewed with staff at the April 27, 2009 Planning Board work session. It was determined that based on the information provided, there could be a basis to conclude that one or more potentially significant adverse impacts may result from this project. Subsequently, on April 28, 2009 a letter was sent to the applicant requesting additional information necessary to reach a Determination of Significance. At this point, there has been no further submission by the applicant and the Planning Board has not made a SEQR determination. SCTM#1000-97-3-3.1 ZBA# 6224 The Planning Board received your request for comments regarding the above referenced application for a special exception permit for a contractors yard in the Limited Business Zoning District. The application has been reviewed for site development and the following comments are for the Zoning Board, s consideration. Special Exception - contractors yard in the LB Zoning District The subject parcel is located on the Main Road in Cutchogue totaling 63,338 sq. feet where 80,000 sq. ft is required and is surrounded by Residential (R-80) Zoning. The applicant is proposing three principal buildings for the purposes of multiple contractor businesses located in the Limited Business Zoning District. After careful review of the plan submitted, it appears that the proposed application is not in keeping with the intent of the Limited Business Zone. As per Town Code Section 280-40 the purpose of the Limited Business District is to provide the oppommity for limited business activity along highway corridors that is consistent with the rural surrounding areas and uses. The site design, as proposed, does not appear to meet the intent of this zoning district. The applicant is proposing three large buildings on a substandard parcel requiring over 221% relaxation of lot area. We expect that noise and visual intrusion into neighboring residential development from multiple businesses at this site will be unacceptably ZBA # 6224 - Romanelll Realty high. The Zoning Board should also consider the traffic generated from the proposed use as well as the proposed design features that will impact the surrounding residential property and rural character of the area. Setbacks for proposed buildings: In addition to the request for a special exception and a 21% relaxation of the code for the lot area mentioned above, the applicant is requesting several variances for the three proposed buildings on site. They are as follows: Building # 1 (16,000sq. ft.) Section 280-43c states: "a project shall be divided into separate structures so that no single structure shall have more than 60 linear feet of frontage on one street". Building #1 is proposed to be 6,000 s.f. and have 100 linear feet along Route 25. The proposed construction will require a 40 % relaxation of the code and not be in keeping with the nature and character of this residential / rural area. Based on preliminary discussions with the applicant's representative, the location and size of the building is proposed as to screen trucks and equipment to the rear. However, the Planning Board would recommend a substantial landscape treatment along the street frontage to screen parking areas rather a building of this size requiring a variance and be out of character for the area. Building # 2 (2, 800sq. ft.) Section 280-42a refers to the bulk schedule requirement. The Bulk schedule requires a minimum rear yard setback of 75 feet. The proposed construction for building # 2 will have a rear yard of 40 feet requiring a 47 % relaxation of the code. If the applicant places the building in a different location, the applicant can meet the minimum requirements of the ordinance. Building # 3 (3,600sq.ft.) Section 280- 42a refers to the bulk schedule requirement. The bulk schedule requires a minimum side yard setback of 20 feet. The building is proposed as having only a 10-foot side yard, a 50 % relaxation of the code closest to residences that would be most affected by the proposed use. It should be noted that although there is currently a building to be removed, building # 3 is proposed as having 80 linear feet of wall facing residential prope~y versus the much smaller existing storal ,~ll~ng'of-~0-&.f.~is should be taken into consideration. ~t,~ ocr 2 ZBA # 6224 - Romanelli RealO~ Number of uses/buildings The bulk schedule requirement for this zoning district is 80,000 s.f. per use/building, thus, Buildings # 2 & 3 require a 200% relaxation of the code, in addition to the 21% relaxation for the first building. Summary: The most significant issues are the following: 1) The intent of the Limited Business Zoning District is not being met by the proposed intensive commercial use of the property. 2) The subject parcel is substandard in size. 3) The application is for new construction that should be designed to fit the lot size. 4) The proposed project requires substantial area variances and any hardships claimed are self-created.. 5) The applicant can easily comply with the Code, Zoning and Bulk Schedule requirements thereby eliminating the need for variances. Based upon the above, the Planning Board would recommend that the area variances be denied, and the Special Exception be tabled until a site design that is in keeping with intent of the Code and does not require substantial relief from the Zoning Board is proposed. We received an incomplete site plan application for this project on October 24, 2007, under a Notice of Disapproval from the Building Department dated March 14, 2007 and last revised November 19, 2007. · At our December 3, 2007 work session, the Planning Board requested revisions to the site plan, and a complete site plan application be submitted. The most current drawing in the Planning Board's file is dated May 18, 2007, last revised September 24, 2007. The applicant has not yet submitted a complete application. · The proposed project is adjacent to residential zones and residences. Town code states the intent of the Limited Business District is to allow commercial activity "designed to protect the residential and rural character of the area." (Section 280-40). Romanelli Realty Page Two December 3, 2007 Adhering to the landscaped buffer recommendations, especially where the property is adjacent to residential zones, will be necessary to properly screen uses on this site from residential neighbors. The purpose of the 60' restriction on building width is to prevent long buildings from lining the roadways outside the hamlet centers. Long buildings lining the road can create a suburban/urban effect that is undesirable in an area where the character is largely rural or residential, as it is at this location. · Section 280-40 of the Town Code states that development in the Limited Business District should accomplish the following: -- be "consistent with the rural and historic character of the surrounding uses"; and -- "protect the residential and rural character of the area." · The same section of Town Code also states the following: -- "Emphasis will be placed on review of design features so that existing and future uses will not detract from surrounding uses." It is absolutely not in keeping with the character of this pa~icular area / part of the North Fork. This would, however, be befitting of an industrial area, such as places on Rte 48, but certainly not in the currently planned location. Our property would bear the brunt of this contractors yard proposal. We would be looking directly at two large buildings with a third larger one in view as well with many, many parking spaces; trucks coming in and out at all hours, lights and noise and smells (i.e diesel) at all hours, and no amount of fence or screening would take away the inevitable.(Please also note as previously mentioned at prior meetings, there is no longer a natural buffer on that site-you are all welcome to come see for yourselves at any time). We have also had dealings with Mr. Romanelli once before when he parked his Warner's oil trucks very close to our property line. This blocked our view of Bedell's vines and the sunsets and we neighborly called to ask him to please move them (he owns plenty of other "commercial" property in this Town). To our surprise he became outraged and said, why should he have to move his trucks to where everyone else would have to look at "ugly old oil trucks" and he hung up. In other words, hey it's OK for us to have to look at them, but not the rest of the "public". So this is what we suppose we would be in store for should this proposal be allowed. He is more concerned about what the from of the property looks like than he is on the abutting sides that just the neighbors would have to deal with. Not very neighborly. Again, this is why an industrial contractors yard should not be allowed, in addition to there being a $16,000+ sq. ft. difference between what is allowed and what is not (80,000 vs. 63,338). We invite and would very much welcome all members of this Board, the Planning Board, and various Town officials to come to our home and take a good long look at what we, as well as abutting neighbors, would be looking at should this project have approval. It is not a pretty picture at all and it is an extremely disturbing prospect. During the early 1900's structures on the property were used as a general store and blacksmith shop. At about the time of the First World War, the blacksmith shop closed. The general store continued to operate. Greenhouses were erected and Mr. Midgely's grandfather grew and sold flowers such as dahlias, gladiolas and peonies from the sit6. The flowers were planted, harvested and sold and the bulbs were dug up in the fall, then stored for re-planting in the spring as well as offered for sale. In 1928 Mr. Midgely's grandfather died and his grandmother continued to operate the flower business. Because the operation was quite labor intensive, she scaled back the operation and leased a portion of the land (that fronted on Skunk Lane) to a vegetable farmer, but continued the greenhouse business on the land that is the subject of the application. After WVVl, Mr. Midgely's father constructed a carpenter shop from which he conducted a business. The greenhouses and general store continued to operate. After WWll, Mr. Midgely's father was a caretaker for an estate in Nassau Point and upon retiring, sold off a lot from the original parcel to fund construction of a home for himself that was constructed by Mr. Midgely and his business partner on a portion of the original property and is located to the east of the subject site. Two other lots were deeded to Mr. Midgely and his sister as wedding gifts. What remained of the original site is the subject property. In 1956 Mr. Midgely and his partner, Frank B. Rogers Jr. purchased the remaining property from Mr. Midgely's father and operated their contracting business from the site. By this time the general store and greenhouse businesses had ceased, but the contracting business was active. There ware 7 buildings on the property and they were used in conjunction with the contracting business for offices, custom woodworking shop, retail and storage/warehouse and Mr. Rogers monument business. In 1976, Mr. Midgely bought out his partner's interest in the property and the varied uses of the property continued until 2004 when he sold the property to Mr. Romanelli. It should also be noted that at the time that the Zoning Code was originally implemented in Southold Town, preliminary maps had shown the subject site to be located in a "B" Business zone. However, when the zoning maps were formally adopted there appeared to he a number of errors and/or omissions, the land of Midgely & Horton being incorrectly designated. Shortly thereafter, a petition wes made by Midgely & Horton to the Southold Town Board requesting a change of zone to the subject property from "A" Residential & Agriculture to "B" Business to correct the error. The rezoning was approved on 8/12/1958, (See attached documentation) The 1965 Zoning Ordinance added "B-l" as a category and it appears that the zoning then changed from "B" to "B-l". Historically, the site has been a multi-use commercial property for over 100 years. The specific uses changed over time according to the conditions .warranted during any particular era, but the site has been continually used for multiple purposes by one or more individuals or entities at any given time. Coincidentally, the past uses cited all fall within the parameters of Bpermitted uses" and "accessory uses" as set forth in the Southold Town Code Chapter 280- 41 Use regulations. The proposed use as set forth in our application is consistent with the prior utilization of the site over the past +100 years. Further, the proposed use of the site is consistent with the permitted uses and accessory uses listed in Chapter 280-41.
