SCTM# 1000- 68.-1-15.1 Zoning District: R-80
This proposal is to subdivide a 12.03-acre parcel into 2 parcels where Lot 1 totals 80,285 sq. ft.
and Lot 2 totals 127,686 sq. ft. with an existing single-family residence and associated accessory
structures in the R-80 Zoning District. The remaining acreage will remain as open space.
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, the proposed action is CONSISTENT with the LWRP, provided
that the below recommendations are required in the subdivision approval.
To further Policy 3.1, "Enhance visual quality and protect scenic resources throughout the Town
of Southold. "
E. Preserve existing vegetation and establish new indigenous vegetation to enhance
scenic quality:
It is recommended that the Board require the all trees greater than 18" DBH outside of
the building envelope be retained and preserved into perpetuity.
In addition it is recommended that the existing vegetation on each lot be incorporated within the
required clearing limits pursuant to § 240-49 Clearing of the Southold Town Code. The clearing
limits are required to be shown on the final plat.
It is recommended that the Board establish a 30' natural buffer along the southern property line
along Sound View Avenue for a length of 215 feet. The type and maintenance activities
permitted within the buffer should be included within the covenant and restrictions. An example
definition follows:
NATURAL VEGETATED BUFFER -- a land area of a certain length (INSERT) and width
(INSERT) where existing vegetation occurs prior to the commencement of any grading or
clearing activity. Vegetation shall be maintained to achieve a minimum percent ground cover of
ninety-five (95) percent. To achieve the percent ground cover indigenous, drought tolerant
vegetation may be planted. Survival of planted vegetation shall be (ninety) 90 percent for a
period of three (3)years. Maintenance activities within the buffer are limited to removing
vegetation which are hazardous to life and property, and replanting of vegetation.
To further Policy 5, "Protect and improve water quality and supply in the Town of Southold" and
protect and improve the water quality and supply in the area, it is recommended that the
following best management practices be required:
1. Require the use of gutters, leaders and subsurface drywells to retain surface rtmoff for all
new structures.
2. Require the use of native plants and encourage the use of disease-resistant and drought-
tolerant plants in site landscaping.
3. Prohibit the residential application and use of synthetic pesticides and fertilizers capable
of entering the potable water supply.

Tamara,
Owen called. Here's a summary of my conversation.
He feels that John Ehlers used the arbitrary deer fence line as the secondary dune line, instead of finding out exactly where the line
is, and that this has cost him some 'buildable' land.
Owen said he had Ehlers speak to Mark about the ERSAP map and the secondary dune line, and Mark gave him the name of the
DEC person to help them identify the correct line.
DEC told them that they won't do anything or look at anything landward of the CEHA line.
Owen suggests Mark goes out there - when the snow disappears - walk the line with Owen
He doesn't want to "get away" with anything, he just believes that the secondary dune line was not depicted correctly by his
surveyor. He isn't upset or anything, he just wants to have the line confirmed by someone who knows.
Please have Mark arrange to meet Owen at the site - he said it would only take ten minutes to walk the line and show you where it
is now, and where he thinks it should be.
He said this has to wait until the snow is gone.

Whenever the Code calls for a public hearing this section shall apply. Upon determining that an
application or petition is complete, the board or commission reviewing the same shall fix a time
and place for a public hearing thereon. Notice relating to a public hearing on an application or
petition shall be provided as follows:
A. Town responsibility for publication of notice. The reviewing board or commission shall cause
a notice giving the time, date, place and nature of the hearing to be published in the official
newspaper within the period prescribed by law.
B. Applicant or petitioner responsibility for posting and mailing notice. An application or
petition, initiated, proposed or requested by an applicant or petitioner, other than a Town
board or commission, shall also be subject to additional notice requirements set forth below:
(1)
The applicant or petitioner is required to erect the sign provided by the Town, which
shall be prominently displayed on the premises facing each public or private street which
the property involved in the application or petition abuts, giving notice of the application
or petition, the nature of the approval sought thereby and the time and place of the public
heating thereon. The sign shall be set back not more than 10 feet from the property line.
The sign shall be displayed for a period of not less than seven days immediately
preceding the date of the public hearing. The applicant, petitioner or his/her agent shall
file an affidavit that s/he has complied with this provision prior to commencement of the

As per a request from your office, I have reviewed the Standard Subdivision for the
above referenced project. This map has been prepared bythe office of John C. Ehlers and
has been dated July& 2009. Please consider the following:
1. Lot #: 1 is shown on the map as the proposed new lot. This lot will be set off from
the odginal parcel leaving a narrow "flag" or strip of land for continued access to Lot #: 2.
This flag portion scales out to be 30' wide. This width should be vedfied and noted on the
map.
2. The South Easterly corner of Lot #:1 indicates an asphalt drive crossing over the
comer of this property for access to the adjacent home. Does the Planning Board intend to
officially recognize this encroachment or does this driveway need to be moved?
3. Masonry Pillars are indicated at the beginning of the driveway to lot #:2. These
Masonry structures are not entirely located within the flag portion of Lot #:2. Will the
Planning Board restrict access from Sound View Ave by requiring Lot #:1 to use the flag
portion of Lot #:2? Will the Planning Board require Lot #:1 to use and share the existing
curb cut referenced in item #2 above? In general, the fewer curb cut access points out to
Sound View Ave the better.
4. Contours on the map indicate that Storm Water is currently directed down the
existing driveway of lot #: 2 in a southerly direction headed for Sound View Avenue. Due to
the size of the watershed, it is recommended that this applicant prepare a pollution
prevention control plan to meet the minimum requirements of chapter 236 for storm water
runoff.
5. Due to the irregular configuration of the new lot and in an effort to be consistent
throughout Town, it is recommended that the Building Department have the opportunity to
review the proposed front, side and rear yard set backs of Lot #:1. Depending on the access
point approved by the Planning Board, there may be some confusion as to how the setbacks
could and/or should be established.

The Southold Town Planning Board adopted the following resolution at a meeting held
on Monday, July 13, 2009:
WHEREAS, this proposal is to subdivide a 12.03 acre parcel into 2 parcels where Lot 1
totals 80,285 sq. ft. and Lot 2 totals 127,686 sq. ft. with an existing single-family
residence and associated accessory structures in the R-80 Zoning District; and
WHEREAS, an application for Sketch Approval was submitted on April 10, 2007,
including the Sketch Plan prepared by John C. Ehlers, L.S., dated February 11, 2004;
and
WHEREAS on May 23, 2007, the applicant was advised that the application was
incomplete pending the submission of a completed Environmental Assessment Form
Part 1 and LWRP Consistency Assessment Form along with a revised ERSAP
indicating the Coastal Erosion Hazard (CEHA) Line, top of bluff and 30-foot Right-of-
Way to determine the amount of buildable lands; and
WHEREAS, on June 6, 2007, the applicant submitted an LWRP Consistency
Assessment Form and a Full Environmental Assessment Form; and
WHEREAS, on August 2, 2007, the Southold Town Trustees requested that the
applicant submit a survey depicting the top of bluff line at which time a site inspection
would be conducted by the SoUthold Town Trustees; and

WHEREAS, on August 29, 2007, the Southold Town Trustees provided an Inspection
Report regarding the top of bluff line and dune crest and identified the beach, bluff,
primary dune, interdunal swale and secondary dune; and
WHEREAS, on September 5, 2007, the applicant was notified of the results of the
Trustee inspection and that any activity within 100-feet of the secondary dune would
require further review by the Southold Town Planning Board and Southold Town
Trustees; and
WHEREAS, on December 11, 2007, a request was sent to the applicant to submit a
revised ERSAP; and
WHEREAS, on June 24, 2008, a second request was made to the applicant to submit a
revised ERSAP; and
WHEREAS, on July 21, 2008, a letter was sent to John C. Ehlers providing information
on correctly determining yield and requesting that a Yield Plan be submitted for this
project; and
WHEREAS, on March 11, 2009, three (3) copies of a Yield Plan were submitted by the
applicant; and
WHEREAS, on Apdl 3, 2009, five (5) copies of a revised Yield Plan and three (3) copies
of an ERSAP were submitted by the applicant; and
WHEREAS, on April 13, 2009, a Title Search was submitted by the applicant for his
property; and
WHEREAS, on April 20, 2009, the Southold Town Planning Board officially accepted
the completed application submitted on April 3, 2009 consisting of the ERSAP, the Yield
Plan and the subdivision map for formal review; and
WHEREAS, on May 4, 2009, referrals for this proposed standard subdivision were sent
to the following:
· Southold Fire District
· Suffolk County Planning Commission
· Southold Town Engineer
· LWRP Coordinator; and
WHEREAS, on May 27, 2009, the Southold Fire District responded and stated that
there is adequate fire protection/emergency access for the proposed project; and
WHEREAS, on June 1, 2009, the Suffolk County Planning Commission responded with
no comment and instead requested that the project be referred back to them at either
the Preliminary or Final Stage for further comment; and

WHEREAS, on June 15, 2009, the Southold Town Planning Board reviewed the
referrals submitted to date and the application and recommended that Sketch Approval
be granted at the JulY 13, 2009 Public Meeting of the Southold Town Planning Board;
be it therefore
RESOLVED, that the Southold Town Planning Board hereby grant Sketch Approval on
the map prepared by John C. Ehlers, L.S., dated February 11, 2004 and last revised
July 8, 2009.
The applicant is advised that Covenants and Restrictions and/or design changes may
be required depending on comments received from other regulatory agencies, including
the Town LVVRP Coordinator, the Town Engineer and the Suffolk County Planning
Commission and future amendments may be necessary.
Sketch plan approval is valid for six months. Within six months of the date of this
approval, a Preliminary Plat Application must be submitted to this office unless an
extension of time is requested and granted by the Planning Board.

As per your telephone conversation with our Planning Director Heather Lanza, enclosed
please find a copy of the inspection report of the above referenced property conducted by
our office on August 27, 2007. This report references and indicates the dune area located
on the above referenced property and is accompanied by photographs highlighting the
various dune areas.
I have also enclosed a copy of Sections 240-3 and 240-10 of the Southold Town Code for
your reference. These sections define "Buildable Lands" and the Technical Requirements
needed for both an ERSAP map and a Yield Plan.
As you may recall from your telephone conversation with Ms. Lanza, in order to show
the Yield for each parcel, the total amount ofbuildable lands needs to be determined.
This determination will exclude all unbuildable lands (See §240-10(B)(2)(b)) from the
80,000 square foot minimum from each lot. You will also need to calculate the 60% open
space requirement to determine how large the new lot can be and how large the building
envelope around the existing house can be. Also, if all of the 60% open space as
discussed is included within the existing house lot and no open space is shown within the
lot line of the proposed new lot, the conservation easement which will need to be done
for that open space will be simplified.

Spring/08 Applicant submitted new map, however it was not what the Planning Board asked them to submit.
There was no yield map and no ERSAP map, just a single combination map with some of the information
requested, but not all, and not in the format we need.
7/2/08: Heather Lanza and Tamara Sadoo, Planning Department staff met with Mr. Morrell to go over
what he needs to submit to complete the application. We explained the need for a separate yield map, a separate
ERSAP map, and showed him how the map he had submitted recently did not provide the information we needed.
We explained that if he wanted to create just one mom lot and not subdivide any further in the future, a yield map
showing the unbuildable lands, the buildable lands, and two lots meeting the Town Code would suffice for the
yield map (rather than a full yield map).
We also told him that the second lot might need to be smaller than proposed, depending on the amount of
buildable land, and the 60% open space requirement. We explained that he would need to do a conservation
easement over the open space and unbuildable lands areas with us to show the land was protected from
development.
He was also told about the importance of the ERSAP and that without that done properly, we couldn't proceed
with the application at all. We suggested he might need to hire someone with skills beyond a surveyor to complete
the ERSAP that could identify trees and cover types and other natural features that are required to be shown. This
area is very sensitive, right next door to the Bittner property now owned by the Town, and needs to be portrayed
correctly on a map so the Planning Board can determine how much of the property is actually buildable land,
which in turn will help determine how large the lots may be.
We also requested a title search be done or provided to us for the Right of Way.

Dear Mr. Morrell,
Heather Cusack, the Environmental Technician of this office has relayed your inquiry on
the status of the application to subdivide your 12.03 acre property into 2 lots. I have
reviewed the file and the Planning Board is in need of the following to continue
processing the application.
In review of the plat dated February 11, 2004 and Pursuant to Article V Sketch Plan
Review § 240-10. Technical requirements. A. Existing resources and site analysis
plan(s) (ERSAP) must be prepared including the protective natural features as
indicated within the September 4, 2007, Board of Trustees letter (attached). The plat
should be labeled ERSAP Standard Subdivision of O~ven Morrell. The following is
required in addition to the information shown on the submitted plat:
(b) Topography, the contour lines of which shall be at five-foot intervals,
determined by photogrammetry (although ten-foot intervals are
permissible beyond the parcel boundaries, interpolated from published
U.S. Geological Service USGS maps). Slopes equal to or greater than 15%
shall be clearly indicated.

condition on the property according to:

2. The information on the ERSAP map should be used to produce a yield map. In order
for the Planning Board to determine a yield for the parcel, a yield plat must be produced
Pursuant to Article V Sketch Plan Review, § 240-10. The information on the plat
submitted should be revised to include:
a. Tidal wetlands or freshwater wetlands, as defined in state and local
regulations.
b. Bluffs, primary dunes and secondary dunes.
e. Areas required for utilities or public facilities, except that minor utility
easements of direct service to the subdivision may be included.
f. Areas for which the development rights have been transferred, sold or
extinguished (if applicable).
It is important to note that acreages for each natural protected feature must be calculated
and recorded on the yield plat. The yield plat must be labeled "Yield Plat for Standard
Subdivision of Owen Morrell".
Also note, that Lot 1 indicates that it will be served by a flag, therefore, the area of the
flag portion of the lot should be calculated and deducted from the total lot area. The lot
should be equal to 80,000 square feet excluding the flag portion of the lot.
Once these items are complete the application will be scheduled for consideration of
Sketch Plan Approval or Conditional Sketch Plan Approval at an upcoming Planning
Board Public Meeting. Following Sketch Plan Approval you will need to file a

I inspected the above referenced property today as per your request of August 27,
2007.
The attached survey dated February 11,2004 indicates a crest of dune line. However, I
disagree with the determination that the area is a crest of dune rather it is a bluff
pursuant to the following definition from Chapter 275:
BLUFF -- Any bank or cliff with a precipitous or steeply sloped face adjoining a beach or a body
of water. The waterward limit of a bluff is the landward limit of its waterward natural protective
feature. Where no beach is present, the waterward limit ora bluff is mean Iow water. The
landward limit is 25 feet landward of the receding edge or, in those cases where there is no
discernible line of active erosion, 25 feet landward of the point of inflection on the top of the
bluff. The point of inflection is that point along the top of the bluff where the trend of the land
slope changes to begin its descent to the shoreline
The distance from the top of the stairs to the top of bluff is 40 feet.
The site, seaward to landward, is Long Island Sound, beach, bluff, primary dune,
interdunal swale, and secondary dune. Landward of the bluff is a large dune area.
On the eastern property line there is a monument. I measured 91 feet from the
monument to the crest of the dune and 115 feet to the crest of the bluff.
Other field notes include that there is some erosion on the bluff, possibly caused by the
Bittner bulkhead to the east. I suggest a no disturbance area be specified for land ward
of the bluff and the whole dune area, except for the small existing footpath through the
dunes, to the staircase to the beach. The owner may want to obtain a current Trustee
Wetland Permit for the existing stairs in the case that they need rebuilding.
The primary dune area consists of a sand substrate, and contains predominately the
following plants:
Northern bayberry
Beach plum
Beach grass
Sea grape
Wild Black cherry
Eastern red cedar
Phragmites
In addition the survey indicates a 2 acre piece of the current total 12 acres, landward of
the existing house, and along Soundview Ave. proposed for a building lot. Due to the
nature of the land in that area I suggest that the piece of land be checked for the
presence of any freshwater wetlands or secondary dune species before the subdivision
approval process continues.

these items, the Planning Board will review the application at a work session.
Please be advised that the plan submitted does not specify the amount of unbuildable lands on

to be provided in order for staff to calculate the 60% open space requirement and to verify there
