WITNESSETH, that the party of the first part, in consideration of Four Hundred Eighty-Eight Thousand and 00/100
Dollars ($488,000.00) paid by the party of the second part, does hereby grant and release unto the party of the
second part, the heirs or successors and assigns of the party of the second pad forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying
and being at Fishers Island, Town of Southold, County of Suffolk and State of New York, known and designated
as Lot 29 as shown on the "Plan of Peninsula at Fishers Island owned by Charles W. Hedge and Frances G.
Thorp, made by Chandler & Palmer, Engineers, Norwich, Connecticut, 1913", and filed in the Office of the Clerk
of the County of Suffolk on March 11,1913, File No. 223, said plot, piece or parcel of land being more particularly
bounded and described on Schedule A hereto.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part (as to an undivided
three-fifths interest) and David C. Burnham (as to an undivided two-fifths interest) by deed from Scribner L.
Fauver, Trustee, dated January 10, 1996 and recorded in the Office of the Suffolk County Clerk on February 8,
1996 in Liber 11761 page 736, the party of the first part having acquired the other undivided two-fifths interest
in such premises by deed from the said David C. Burnham and Anne H. Burnham, dated October 6, 1997 and
recorded in the Office of the Suffolk County Clerk on October 27, 1997 in Liber 11859 page 40.
TOGETHER with all right, title and interest, if any, of the party of the first part, in and to any streets and roads
abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances, and also
all the estate which the said decedent had at the time of decedent's death in said premises, and also the estate
therein, which the party of the first part has or has power to convey or dispose of, whether individually, or by virtue
of said will or otherwise; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part,
the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby
the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first
pad will receive the consideration for this conveyance and will hold the right to receive such consideration as a
trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first
to the payment of the cost of the improvement before using any part of the total of the same for any other
purpose. The word "party" shall be .construed as if it read "parties" whenever the sense of this indenture so
requires.

All that certain plot, piece or parcel of land, with the buildings and improvements thereon
erected, situate, lying and being at Fishers Island in the Town of Southold, County of
Suffolk and State of New York, bounded and described as follows:
BEGINNING at a point in the center of an iron pipe driven into the ground on the westerly
line of a private right-of-way of Fishers Island Estates, Inc., leading northerly from the
highway sometimes called the Peninsula Road leading to Peninsula Point so-called, said
point of beginning being on the dividing line between the herein conveyed tract and Lot
No. 30 as shown on the plan hereinafter referred to;
RUNNING THENCE northerly along the westerly line of said right-of-way a distance of 150
feet more or less (passing through another iron pipe on the westerly line of said right of
way) to the shore of West Harbor;
THENCE following the meanders of said shore line of West Harbor and Great Harbor in
a general westerly, southwesterly and southerly direction 320 feet more or less to a point
on said shore marking the northwesterly corner of Lot No. 30 as shown by said plan;
THENCE easterly on a line measured at right angles to said westerly line of said right-of-
way and running along the northerly boundary of said Lot No. 30 a distance of 152 feet
more or less to the point of beginning; containing 0.56 acres more or less.
Being Lot No. 29, as shown on "Plan of Peninsula at Fishers Island owned by Charles W.
Hedge and Frances G. Thorp, By Chandler & Palmer, Engrs., Norwich, Conn. 1913", and
filed in the Office of the Clerk of the County of Suffolk on March 11, 1913, File No. 223.
TOGETHER WITH all the right, title and interest, if any, of the party of the first part in and
to the shores and land under the waters of West Harbor and Great Harbor in front of and
adjoining said premises.
TOGETHER WITH the benefits and subject to the burdens ail as set forth in covenants
and restrictions set forth in Deed dated August 18, 1955 between Fishers Island Estates,
Inc. and Bradford Burnham and which Deed was recorded in Liber 4510 page 282 in the
Office of the Suffolk County Clerk.
