between George T. Laboda, an unremmarried widower, by and through his attorney-in-fact, Thomas G.
Laboda, pursuant to the Durable Power of Attorney dated June 15, 2000,
party of the first part, and
George T. Laboda, Thomas G. Laboda, Lawrence R Laboda, Kathy J. McMahon and Richard S. Laboda,
as joint tenants with rights of survivorship}

I, F1TNESSETH, that the party of the first part, in consideration of Ten dollars ($10.00), lawful
money of the United States, paid by the party of the second part, does hereby grant and release unto the
party of the second part, the heirs or successors and assigns of the party of the second part forever,
ALL that certain parcel of land, 'with the buildings and improvements thereon erected, situate,
lying and near Mattituck, Southold Town,.Suffolk County, New York, bounded and described as follows:
BEGINNING at a point on the easterly line of Marlene Lane, 773.03 feet northerly along said
easterly line from a concrete monument set at its intersection with the northerly line of Peconic Bay
Boulevard being the northwesterly comer of land of Kruger; and running along said easterly line of
Marlene Lane, North 20° 39' 10" West 112.50 feet to land now or formerly of Martin and Stella
Weglicki; thence along the last described land, North 69° 20' 50" East 152.46 feet to the east line of land
of the party of the first part; thence along~rhe east line of said land of the party of the first part, South 19°
33' 50" East 112.51 feet to said lands conveyed to Kruger; thence along the last described land, South 69°
20' 50" West 150.32 feet to the point of BEGINNING.
TOGETHER with an easement for passage between Peconic Bay'Boulevard and Peconic Bay
over a certain 10 foot right of way, in common with all others now having such right of way and those to
whom hereafter such right of way and easement may be granted, which right of way is more particularly
described as follows: ALL that parcel of land situate near Mattituck,' Southold Town, Suffolk County,
New York, bounded and described as follows: The easterly line of subject 10 foot right of way is
described as follows: Beginning at a poirit on the southerly line of Peconic Bay Boulevard, 200.20 feet
westerly along said line from the northeasterly corner of land of Haggerty Estate; and running along said
land of Haggerty Estate on a line parallel to the easterly line of said Haggerty Estate and 200.0 feet
westerly therefrom, South 20° 23' 00" East 500 feet, more or less, to ordinary highwater mark of Gmat
Peconic Bay; the westerly line of said 10 foot right of way is parallel to and 10.0 feet westerly from the
easterly line herein described, and runs from Peconic Bay Boulevard to Great Peconic Bay.
Said easement is subject to the following covenants and conditions:
1. Said easement is for foot travel only.
2. It shall not be obstructe~t in any way and the maintenance thereof shall be the joint
responsibility of all those having a right to use said right of way for the time being.

3. Said easement shall be perpetual and shall run with the land but no easement or rights in
said right of way shall vest in the general public. It shall be a private right of way.
SUBJECT to any and all covenants and restrictions of record affecting the said premises.
SUBJECT to zoning and building regulations of the Town of Southold, New York.
BEING AND INTENDED TO BE the same premises conveyed to George T. Laboda and Ruth
Laboda, his wife, by John W. Corrigan, a.s executor of the last will and testament of Ann M. Corrigan,
deceased, by Deed dated June 27, 1969 and recorded in the Suffolk County Clerk's Office in Liber 6579
of Deeds at Page 236 on July 7, 1969.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described promises to the center lines thereof,
TOGETHER with the appurtenances and all the estate and rights of the party of the first part in
and to said premises, :
TO HA VE AND TO HOLD the premises herein granted unto the party of the second part, the
heirs or successors and assigns of the party of the second part forever.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the
party of the first part will receive the consideration for this conveyance and will hold the right to receive
such consideration as a trust fund to be applied first for the purpose of paying the costs of the
improvement and will apply the same first to the payment of the cost of the improvement before using
any part of the total of the same for any other purpose.
AND the party of the first part covenants as follows:
FIRST. That said party of the first part is seized of the said premises in fee simple, and has good
right to convey the same;
SECOND. That the party of the s~cond part shall quietly enjoy the said premises;
THIRD. That the said premises ars free from encumbrances, except as aforesaid;
FOURTH. That the party of the first part will execute or procure any further necessary assurance
of the title to said premises;
FIFTH. That said party of the first part will forever warrant the title to said premises.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
