Executor's Deed
This Indenture, made the 22nd day of May, Two Thousand and Ten,
BETWEEN
NANCY MORANTE, residing at 3120 Paddock Road, Weston, FL 33331, as Executrix
of the Last Will and Testament of the late FRANK MORANTE, deceased February 16,
2009 who resided at 381 Wild Coffee Lane. Marco Island, Florida
party of the first part, and
NANCY MORANTE residing 3120 Paddock Road, Weston, FL 33331, THOMAS F.
MORANTE residing 3120 Paddock Road, Weston, FL 33331 and JEAN MORANTE
residing at 77 Railroad Street, Greenlawn, NY 11740, as Trustees of the Frank Morante
Family Trust as to a one-third interest in the premises
party of the second part
Witnesseth, that the party of the first part, to whom Letters Testamentary
were issued by the Surrogate's Court, Suffolk County, New York on March 17,
2010 under File # 2009-2264A, and by virtue of the power and authority given in
and by said Last Will and Testament, and/or by Article 11 of Estates, Powers and
Trusts Law, and in consideration of $10.00 (Ten Dollars), paid by the party of the
second part, does hereby grant and release unto the party of the second part, the
distribntees or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements
thereon, erected, situate, lying and being at Orient, Town of Southold, County of Suffolk
and State of New York, bounded and described as follows:
BEGINNING at a point on the northerly side of King Street, where the
easterly line of land of Reckhart (formerly Frances E. Douglass) intersects the same; which
point is 666.42 feet East more or less from the corner formed by the intersection of the
northerly and easterly lines of King Street; RUNN1NG THENCE along said land of
Reckhart, the following two courses and distances: (1) North 30° 13' 20" West 105.10
feet; THENCE (2) South 67° 18' 10" West 416.56 feet to land of Holtzman (formerly
Emily Gordon); THENCE along said land of Holtzman, two courses: (1) North 25° 03'
20" West 53.63 feet; THENCE (2) North 40° 51' 00" West 241.05 feet; THENCE along
said land of he Serge V. Traube, North 41 degrees 04 minutes 40 seconds West 121.24 feet
to land of Vilna Estates, Inc. (Formerly Percy Douglass); THENCE along said land of
Vilna Estates, Inc. four courses: (l) Northeasterly about 500 feet as measured by a tie-line,
North 49° 59' 30" East 503.04 feet; THENCE (2) North 65° 14' 20" East 164.96 feet;
THENCE (3) South 28° 21' 00" East 94.70 feet; THENCE (4) North 61° 23' 20" East
512.83 feet; THENCE along said land of Vi lna Estates, Inc. and along land of Witzenburg
(formerly Percy Douglass) South 25° 18' 10" East 667.57 feet to said northerly line of
King Street; THENCE along said northerly line South 71° 46' 40" West 651.02 feet to the
point of BEGINNING.
SUBJECT TOsuch a state of facts as an accurate map may disclose.
., BEING AND INTENDED TO BE the same premises conveyed to Frank Morante
by Deed dated September 1, 1970 and recorded in the Suffolk County Clerk's
Office on September 21, 1970 in Liber 6810 page 267.
PREMISES also known as 1455 Narrow River Road, Orient, New York.
Together with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above-described premises to the center lines thereof;
Together with the appurtenances and all the estate and rights of the party of the first part in
and to said premises;
To have and to hold the premises herein granted unto the party of the second part, the heirs
or successors and assigns of the party of the second part forever.
And the party of the first part covenants that the party of the first part has not done or
suffered anything whereby the said premises have been encumbered in any way whatever,
except as aforesaid.
And the party of the first part, in compliance with Section 13 of the Lien Law, covenants
that the party of the first part will receive the consideration for this conveyance and will
hold the right to receive such consideration as a trust fund to be applied first for the
purpose of paying the cost of improvement and will apply the same first to the payment of
the cost of the improvement before using any part of the total of the same for any other
purpose. The word "party" shall be construed as if it read "parties" whenever the sense of
this indenture so requires.
