THIS INDENTURE, made the 16th day of June, 2010
BETWEEN
ELLEN HUFE, residing at 3195 Wells Avenue, Southold, New York 11971, party of the first part, and
THOMAS M. WELLS AND JEAN B. LUM,
residing at 3825 Rocky Point Road, East Marion, New York 11939, party of the second part,
WITNESSETH, that the party of the first part, in consideration of Ten and 00/100--($10.00)--Dollars, and
other good and valuable consideration paid by the party of the second part, does hereby grant and release
unto the party of the second part, the heirs or successors and assigns of the party of the second part
forever,
All that certain plot, piece or parcel of land, situate, lying and being in the Town of Southold, at Southold,
County of Suffolk and State of New York being bounded and described as follows:
BEGINNING at a point on the westerly side of a 25 foot wide right of way, said point being distant 258.00
feet northerly from the intersection of the southwesterly corner of said 25 foot wide right of way and the
northerly side of Main Road;
THENCE from said point of beginning, along land now or formerly of Warren Hufe the following three (3)
courses and distances:
1) South 85 degrees 08 minutes 00 seconds West, 51.00 feet to a point;
2) South 04 degrees 52 minutes 00 seconds East, 156.00 feet to a point;
3) South 89 degrees 15 minutes 30 seconds West, 191.31 feet to lands now or formerly of Stephen
Patterson III and Edwin Tuccio;
THENCE along said lands, North 5 degrees 17 minutes 00 seconds East, 143.68 feet to shore line of Mill
Creek;
THENCE along the tie lines at Mill Creek, the following three (3) courses and distances:
1) North 48 degrees 40 minutes 15 seconds East, 42.53 feet to a point;
2) North 22 degrees 59 minutes 33 seconds East, 41.03 feet to a point;
3) North 04 degrees 10 minutes 56 seconds East, 35.45 feet to a point and land now or formerly of
Stephen Patterson III and Edwin Tuccio;
THENCE along said land North 86 degrees 08 minutes 00 seconds East, 157.56 feet to the westerly side
of Right of Way;
THENCE along the westerly side of said Right of Way, South 04 degrees 52 minutes 00 seconds East,
93.00 feet to the point or place of BEGINNING.
BEING AND INTENDEDTO BE the same premises conveyed to the party of the first part by deed dated
12/19/2000, recorded 12/27/2000 in Liber 12092 page 772, the grantors herein being the same as the
grantees in deed recorded in Llber 12092 page 772.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the
appurtenances and all the estate and rights of the party of the first part in and to said premises.
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and
will apply the same first to the payment of the cost of the improvement before using any part of the total of
the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the
sense of this indenture so requires.
