1705 Ackerly Pond Lane, Southold, New York 11971, party of the first pad, and
GERARD H. SCHULTHEIS AND CAROLYN M. SCHULTHEIS, his wife,
residing at 1640 First Street, New Suffolk, New York 11956, party of the second part,
WITNESSETH, that the party of the first part, in consideration of Two Hundred Twenty-Five Thousand and
00/100--($225,000.00)--Dollars, and other good and valuable consideration paid by the party of the
second part, does hereby grant and release unto the party of the second part, the heirs or successors and
assigns of the party of the second part forever,
All that certain plot, piece or parcel of land, situate, lying and being at Fleets Neck, near Cutchogue, Town
of Southold, Suffolk County, New York, and bounded and described as follows:
BEGINNING at the corner formed by the intersection of the northerly side of Lone Pine Road and the
westerly side of Holden Avenue;
RUNNING THENCE along said northerly line of Lone Pine Road, South 65 degrees 40 minutes 10
seconds West, 160.03 feet to a monument and the southeasterly corner of the land now or formerly of
Susan Phipps, Jean Shepard, Carol Sykes and Nancy Wright;
THENCE along last mentioned land, North 3 degrees 56 minutes 20 seconds West, 109.54 feet to land
now or formerly of Hayes;
THENCE along land now or formerly of Hayes, North 75 degrees 31 minutes 40 seconds East, 152.58 feet
the westerly side of Holden Avenue;
THENCE along the westerly side of Holden Avenue South 3 degrees 56 minutes 20 seconds East, 81.69
to the point of BEGINNING.
BEING AND INTENDEDTO BE the same premises as described in deed made by Lucile J. Shepard
recorded May 11, 1987 in Liber 10315 page 153.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the
appurtenances and all the estate and rights of the party of the first part in and to said premises.
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and
will apply the same first to the payment of the cost of the improvement before using any part of the total of
the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the
sense of this indenture so requires.
