TOGETHER with all the right. title and interest of the parties of the
first part. if any. in and to the beach. waters. and land under water of
Richmondts Creek in front of and abutting said premises. to the center

SUBJECT. HOWEVER. TO THE FOlf'OWING COVENANTS AND RESTRICTIONS:
( 1.) Said premise s shall not be used except for residential purposes;
that the said parties of the second part covenant for themselves. their
heirs. legal'representatives and assigns. that they will not erect.
carryon. mainta:tn. su:f'fer ot' peImit on the said plot. or on any part'
thereof. any brewery. distillery. or other place l' or the manufacture or
sale of intoxicating liquors. nor for the sale of gasoline. nor any
dangerous. offensive or noxious trade. business 'or occupation. nor any
nuisance whatever. nor any trading or manufacturing business. trade or
occupation, nor shall any fowl or swine be kept: on said premises.
(2.) No residence shall'be erected uEon said premises or any part
thereof. which shall cost less than $a.ooo., nor'shall any other building
be erected or maintained thereon. excepting a private garage. and
necessary outbuildings which sliall be inoffensively located am llightly~
(3.) No building above grade shall be erected on said premises within
ten feet of any of the roads or roadways a4jacent thereto. nor within
ten feet '01' any side or rear line. nor within ten feet of the embankment

(4.) Said premises. together with the buildings. shall be kept in
wholeseme. healthful and sanitary condition by-the parties of the second

~ (5.) The foregoing special restrictions are hereby declared to be and
shall be covenants running with the lam. except that said covenants
and restrictions shall cease and expire on January 1. 2000.
(6.) The parties of the f'irst part agree to place the same restrictions
upon other property now owned by them in the vicinity of the premises
above described within a distance of six hundred (600) feet. (as measured
along' the Easterly or Southerly line of' Wells Road) of the above' described
premises, but except as to such property ,within 600 f'eet, the parties of'
