YOUNG, residing at (no #) Main Road, Laurel, NY 11948, hereinafter referred to as the "Declarant"; WHEREAS, the Declarant is the owner in fee simple of Main Road (N.Y.S. Route 25), County of Suffolk, New York, deed dated December 7, 1940, a certain parcel of land situate on the north side of Laurel, Town of Southold, being the premises described in recorded in the Suffolk County Clerk's Office in Liber 2150 at page 305, a metes and bounds description of which is shown on Schedule A attached hereto and made a part hereof, hereinafter referred to as the "premises". WHEREAS, the Declarant intends to subdivide said )remises into lots for residential purposes and desires to ~ubJect said premises to certain conditions, covenants and restrictions. NOW, THEREFORE, the Declarant does hereby declare that the aforesaid premises and every portion thereof is hereby held and shall be conveyed subject to the conditions, covenants and restrictions hereinafter set forth, and that every purchaser of said premises or any portion thereof, by the acceptance of a deed thereto, covenants and agrees that the premises so purchased shall be held subject to the covenants, conditions, and restrictions hereinafter set forth. Neither of the lots in the aforesaid subdivision shall be further subdivided or its lot lines changed in any manner at any future date without the approval of the Planning Board of the Town of Southold. TI~__T~_C_~___I~: Any subdivision of any part of this tract in the future shall have a map of the subdivision filed in in the Office of the Suffolk County Clerk. A~_!_Q_~_~_I_~: All new or reconstructed driveways on Main Road shall make an angle of at least 70° and )referably 90° with the Main Road. ARTICLE IV: All new or reconstructed driveways )n Main Road shall have a turnaround provision, such as a T- shaped shunt, so that a vehicle leaving a lot will not have to back out into the traffic stream on the road. ARTICLE V: All stormwater runoff resulting from the development and improvement of this subdivision or any of its lots shall be retained on the site by adequate drainage structures so that it will not flow onto the right- of-way of Main Road. ARTIC~VI: No sanitary disposal facility shall me constructed or be otherwise located within 100 feet of =he upland edge of the wetlands and the shoreline of Laurel Lake. ~: No stormwater runoff resulting from =he development and improvement of the subdivision or any of .ts lots shall be discharged directly into Laurel Lake or :he freshwater wetlands within and adjacent to the property. 10 , 52 ABT_~: A conservation or scenic easement Laving a minimum width of 50feet shall be established along the shoreline of Laurel Lake and the upland edge of the freshwater wetlands within and adjacent to the property to insure that no development adverse to the aesthetic quality of the shoreline will take place adjacent to these features. The conservation or scenic easement shall also cover the wetland areas within the property as well as the abutting 50 feet of upland.
