(631) 765-1809 · Fax (631) 765-9064 Ut. 2 2 2010 wn Cleft FINDINGS, DELIBERATIONS AND DETERMINATION MEETING OF JULY 13, 2010 ZBA FILE: 6381 NAME OF APPLICANT: Bellmart Properties, LLC (Charles Mattina) PROPERTY LOCATION: 545 Koke Drive Southold, NY SCTM#1000-87-5-14 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated June 15, 2010 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP: This application is not subject to review under Chapter 268 because the variance relief requested does not involve features that relate to a regulated natural feature or a bulkhead or other shoreline. PROPERTY FACTS/DESCRIPTION: Subject property is a non-conforming 15, 371 square foot lot in the R-40 zone. It contains a single-family dwelling currently under construction. It has 130.69 feet of frontage on Koke Drive, 112.90 feet along the westerly lot line, 116.86 feet along the northern lot line and 150.28 along the easterly lot line. There also is shown on the survey dated Feb. 17, 2010, by Peconic Surveyors, a fifteen foot wide easement along the eastern property line. BASIS OF APPLICATION: Request for Variance from Code Section 280-124, based on an application for building permit and the Building Inspector's March 1, 2010, Notice of Disapproval concerning deck additions at less than the code required front yard setback of 35 feet at; 545 Koke Dr., Southold, NY. SCTM# 1000-87-5-14. RELIEF REQUESTED: The applicant proposes to construct a deck addition to the front of their home with a setback from the road of 25 feet where 35 feet is required. AMENDED APPLICATION: During the hearing, the applicant was asked if they would accept alternative relief and to reduce the size of the deck to make it conform more to the code. The Board asked the agent to submit a copy of the building plans submitted to the building department in conjunction with the permit for the house. On July 8, 2010, the Board received the requested plans. ADDITIONAL INFORMATION: The Board received six letters from neighbors in support of the application and one e-mail from a neighbor against the application. Page 2 - July 13, 2010 ZBA File#6381 - Bellmart Properties, LLC (Mattina) CTM: 1000-87-5-14 FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on June 30 2010, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Town Law §267-b(3~(b)(1). Grant of the variance with alternate relief of will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Open decks to take advantage of water views are not uncommon and with a reduced depth, the proposed open deck in the front yard will improve the appearance of the house, which now includes by code a landing and large set of steps from the existing bedroom sliding doors to grade. These steps will be removed and replaced with a shallow elevated deck that will only be 5 feet less than the code required front yard setback. 2. Town Law §267-b(3)(b){2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The dwelling has a sliding door in front that accesses the master bedroom, Applicant stated at the public hearing that his mother, who is wheel chair bound, would be utilizing the deck "to enjoy the bay views and the sunshine." While the existing 10 by 13.8" covered front porch area which is located directly to the north east of the proposed deck, would provide nearly the same view of the bay, it would not be open to the sky. Because the house is setback at the conforming 35.3' from the road, any construction on the front of this dwelling would require a variance. 3. Town Law §267-b(3)(b)(3). The variance requested herein is substantial. The request is for 71% relief from the code. When considered in the context that the applicant had full knowledge of the need for a variance when he placed his house on the lot, as evidenced in testimony given at the hearing, granting a variance as applied for would be substantial. 4. Town Law $267-b(3)(b~(4} No evidence has been submitted to suggest that alternate relief in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The granting of a reduced variance will further mitigate any impacts that this proposed nonconforming deck structure may have on the visual character of the neighborhood and the environment. The deck will cause no drainage issues. 5. Town Law §267-b(3){b)(5). The difficulty has been self-created. The applicant testified that a survey showing the proposed deck was submitted to the building inspector as part of the original permit process for the dwelling. Further testimony indicated that the building inspector informed the applicant that the inclusion of the proposed deck would result in a disapproval of the building permit and the need for a variance. The applicant chose to build the house without the deck and apply for a variance after the fact. 6. Town Law §267-b. Grant of alternative relief is the minimum action necessary and to enable the applicant to enjoy the benefit of a deck with a view of the Bay while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Weisman (Chairperson), seconded by Member Goehringer, and duly carried, to DENY, the variance as applied for, as shown on the survey from Peconic Surveyors PC, updated Feb. 17, 2010, and GRANT ALTERNATIVE RELIEF as noted below: 1. The deck shall be constructed no closer then 30 feet to the front property line with railings per code. Page 3 - July 13, 2010 ZBA File#6381 - Bellman Properties, LLC (Mattina) 2. The deck shall run along the 30 foot front yard setback no more then 13 feet 8 ½ inches in the proposed location. Conditions: 1. The deck must remain open to the sky. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Before applying for a building oermit, the applicant or agent must submit to the Board of Appeals for approval and filing, two sets of the final survey and architectural drawingst conforming to the alternative relief granted herein. The ZBA will forward one set of approved, stamped drawings to the Building Department. Failure to follow this procedure may result in the delay or denial of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. The proposed deck is approximately 14' x I0'... or 140 sq ft... which is modest in comparison to other deck sizes in the neighborhood and is therefore should not be deemed as excessive. With respect to the proposed stairs.., a 6x6 landing is requested for ease of getting furniture into the house from the driveway. The stairs will allow ease of access to the front of the house since the sloping elevation is such that the front of the house is above ground. We are seeking a variance on both fronts because of the small nature of the building envelope.., while the house fits comfortably within the allowable envelope, unfortunately these two small items do not. 2) ...with respect to the Deck: the topography of the property will not allow for a patio, necessitating the need for a deck to allow us to enjoy the Bay views which we fell in love with when showed the property by the Realtor. With respect to the landing and stairs: the natural slope oftbe property necessitates this configuration. 3) ... I have some questions. 1. The cesspool is not located on the survey I received. ~ know it is located in the northeast corner of the property. Does the applicant have the required permits from the health department? My concern is that there is less than 150' distance between it and the well located on the McPartland property to the east and the Johnson property to the west. 2. There is a shed located on the northwest corner of the property. It is not located on the survey I received. It has been there prior to the beginning of construction. It is generously speaking 3' off my propery line. Does the applicant have the required permits and is it set back at the proper distance from my property line? I am planning on attending the hearing and objecting to the variance being granted, however, in the event that I am unable to attend I would like my comments written here to be made part of the public record. Background: Prior to construction the applicant approached my neighbor to my east (Zakarin) and I to talk with us about his plans. He said he wanted to be a good neighbor and was building a house for his elderly mother and retiring sister and brother in law. He said he was going to do everything by code and had no intentions of seeking variances. My oppostion to granting the variance is based on the following: The request for a variance is based on a self created hardship. The applicant had a vacant lot. He could have designed, sited and built a house that met all code requirements. Yet he chose to build a 45'x55', 2,475 square foot on three levels house on a 15,000 square foot lot. He knew the code requirements yet he chose to build the oversized house. If he liked the house design than he should have bought a lot on which it would fit. he liked the lot than he should have built a house that fit the lot. If Koke Drive is a private gravel road approximately a car width wide. The house overwhelms the road and stands out like a sore thumb. The proposed deck will front the road and add to the mass of the structure as seen from the road. Since the "basement" is at street level the deck will actually be at the second story only 25' from the road. Interestingly, if you look at the front of the house as indicated on the survey, the applicant could have had his deck if he simply extended the porch westward toward the end of the house. Note that the porch has the same dimensions as the proposed deck. It would have alleviated the need for a variance and yet have the same results. I believe people have the right to use their property as they desire providing that they do so within the confines of existing codes. The applicant could have built his house and had a deck he wanted all within existing codes. He CHOSE not to do that. He should be denied the varience. Thank You, Richard L.
