Sykes CTM 1000-15-3-1.1 PROPERTY LOCATION: 1995 Ryder Farm Road, (adj. to Long Island Sound) Orient, NY SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A14-14 to 23, and the Suffolk County Department of Planning issued its reply dated December 15, 2009 stating, that this application is considered a matter for local determination as there appears to be no significant county wide or inter-community impact. LWRP: This application was referred for reviewed under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued his reply dated December 1, 2009. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to us, it is our recommendation that the proposed action is EXEMPT from Coastal Consistency Review. PROPERTY FACTS/DESCRIPTION: The subject property is a 73,758 square foot waterfront parcel located in an R-40 zone. The northern lot line measures 158.43 feet along Long Island Sound. The irregular, eastern lot line measures 243.44 feet heading south from Long Island Sound, then makes a right angle turn and heads westerly for 100 feet, and makes another right angle turn and continues south for an additional 98 feet. The southern lot line measures 200 feet; and the western lot line measures 257.75 feet. The parcel is improved with a single-family residence, an accessory shed, a swimming pool, and an accessory garage with pre-existing non-conforming full bathroom and artist's studio on the second floor, as shown on the site survey drawn by Samuels & Steelman, Architects, and dated April 29, 2010. BASIS OF APPLICATION: Requests for Variances under Code Sections 280-123 and 280-15, based on the September 24, 2009 Building Inspector's Notice of Disapproval Amended November 4, 2009, and an application for a building permit concerning proposed new additions and alterations to a nonconforming accessory structure disapproved for the following reasons: (1) a nonconforming building containing a nonconforming use shall not be enlarged, reconstructed or structurally altered or moved, unless use of such building is changed to a conforming use, and, (2) proposed new construction is proposed at: (a) less than the code required 50 foot minimum front yard setback, (b) less than the minimum side yard setback of 20 feet, and (c) greater than the code limitation of 22 feet maximum height, at 1995 Ryder Farm Lane, (adj. to Long Island Sound) Orient. CTM: 15-3-1.1. RELIEF REQUESTED: The applicant proposes to make interior and exterior alterations to a pre-existing non- conforming accessory garage with full bathroom and artist's studio, to convert the first floor use into a pool Page 2- June. 30, 2010 ZI~A Fileg6349 Gwyneth M Ketterer and Mary B Sykes CTM: 1000-15-3-11 cabafia/recreation room, including the re-design of a portion of the roof, an increase in building height to 23 feet, the addition of an attached outdoor shower area, the addition ora mechanical equipment room to be located on the first floor, the re-location of an existing second floor bathroom, and the addition of a half bathroom on the first floor. The Applicant proposes to maintain existing, non-conforming front and side yard setbacks. AMENDED APPLICATION: During the Jan. 21, 2010 public hearing, the Applicant was requested to bring the plan into more conformity with the code. The Applicant then submitted a revised plan for the consideration of the Board at the May 20, 2010 hearing. The new plan shows a modified roof design on the northern end of the building, which in some aspects, brings the plan into more conformity with the code by reducing the increase in the proposed new building size. The new plan also shows a proposed re-location of the existing second floor bathroom and interior stairway, the addition of a new half bathroom on the first floor, and the addition of a utility mechanical room for the purpose of the installation of a central heating and cooling system. ADDITIONAL INFORMATION: The Applicant initially submitted an application to the Southold Building Department for a permit to make structural alterations which included a 12.5 fl .x 20ft. [250sq.ft.] expansion of the second floor. The proposed plan indicates a one foot increase in the building height and a +38% overall increase in the size of the second floor of this non-conforming accessory structure. The Building Department's original Notice of Disapproval dated Sept. 24, 2009 was based upon the site survey submitted by Samuels & Steelman, Architects, dated Oct. 8, 2009. Subsequently, the Applicant developed a new plan, as shown on the site survey, dated April 29, 2010, and consequently, the Applicant received an amended Notice of Disapproval from the Building Department, dated Nov. 4, 2009. It is the amended Notice of Disapproval, and the revised architectural plan dated April 29, 2010, which is the subject of this decision by the Zoning Board of Appeals. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on Jan. 21, 2010, and on May 20, 2010, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Town Law §267-b(3)(b){1}. Grant of altemative relief, with the accompanying conditions, will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. A recreational pool structure is a customary use for an accessory building in the R-40 zone. The non-conforming accessory garage has been on the subject property for many years and only minimal changes on the exterior are proposed. 2. Town Law §267-b(31(b)(2~. The benefit sought by the applicant, and the benefit obtained by the granting of alterative relief cannot be achieved by some method, feasible for the applicant to pursue, other than with an area variance. The proposed exterior structural alterations to this accessory building, including the increase in building height to 23 feet, and the addition of the enclosed outdoor shower do require area variance relief since the code allows for a maximum building height of 22 feet, and the existing front and side yard setbacks are also non- conforming to Town Code. 3. Town Law §267-b(3)(b){3). The variances granted in this alternative relief decision are not substantial. There will be no significant increase in the non-conformity of this pre-existing accessory building by the granting of the alterative relief offered herein, and with the conditions described within this decision. The existing front and side yard setbacks will remain intact. The building size will not increase substantially with the renovations. The status as an accessory pool structure, designed primarily for seasonal use, and with no habitable space, will not substantially change the use of the building as it existed prior to proposed renovations. 4. Town Law §267-b(3){b}{4} No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The pre-existing non-conforming building is proposed to be altered, keeping the non-conforming use. Applicant could have proposed a conforming use. 6. Town Law §267-b. Grant of alternative relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a renovated accessory pool/recreation structure with outdoor shower, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Homing, seconded by Member Goehringer, and duly carried, to DENY as applied for, and GRANT ALTERNATIVE RELIEF as noted below: Conditions: 1. The outdoor shower will have either a self-contained waste water disposal system, or be attached to the existing septic system of the accessory building. 2. Existing front and side yard setbacks will be maintained with the addition of the outdoor shower. 3. Building height will not exceed 23 feet as shown on the site plan dated April 29, 2010. 4. One half bathroom (no bathtub or shower) is permitted in this building. [It may be on either the first or second floor.] 5. No central heating/cooling system will be added to this accessory building. 6. There will be no habitable space created in this accessory building. 7. There will be no kitchen facilities added to this accessory building. 8. Before applying for a building permit, the applicant or agent must submit to the Board of Appeals for approval and filing, TWO sets of the final: site plan and architectural drawings conforming to the alternative relief granted herein. The ZBA will forward one set of approved, stamped drawings to the Building Department. Failure to follow this procedure may result in the delay or denial of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. The studio has a c.o. and the only alterations proposed to the studio space is to reduce the size of the existing bathroom (toilet, sink and tub/shower) and relocate it to the corner with a toilet, sink and shower stall. The outside second staircase is being removed and interior staircase relocated to the corner. The staircase does not currently comply with NY State code. The pool house area on the first floor has original submission, except the roof of the one structure is a shed roof. not changed from our story portion of the The building is currently heated and has window air conditioning units. The building will continue to be heated and since the space has been reduced from the original plans my client would also like air conditioning. The air conditioning takes the humidity out of the air, drys wet towels and wet clothes, controls mold growth, and in the studio the air conditioning keeps the papers and art supplies from absorbing the summer humidity. Sykes ZBA File # REASONS FOR APPEAL (additional sheets may be used with preparer's signature}: AREA VARIANCE REASONS: (1) An undesirable change will not be produced in the CHARACTER of the neighborhood or a detriment to nearby properties if granted, because: The owners wish to renovate the existing building and improve the architectural style of the existing building. The renovations include converting the first floor storage space to pool house. The existing accessory building with a studio and full bathroom on the second floor has a certificate of occupancy and the existing structure predates the accessory building regulations. As shown on the plans, within the existing second floor studio space the existing stairs and bathroom are being repositioned. The owner is removing the existing tub in the bathroom but retaining the shower. This change improves the function of the space. The additional second floor space improves the exterior architectural style of the accessory building and provides additional storage which is lost by the conversion of the storage area to a pool house. The accessory building is screened by mature vegetation and close to the existing in-ground pool. We do not believe that a "use variance" is required. In 1992 the prior owner, Janet Swanson, obtained a building permit to make alterations to the existing garage. According to the as of right building permit she moved the existing garage closer to the property line and converted the second floor space of the existing garage from storage to "photo studio~ with a full bathroom. The setbacks were conforming, at the time, and the "studio" (noncommercial) was also conforming. This space, as is, was issued a certificate of occupancy. My clients and their children purchased the property with CO's for all the structures. They continue to use the space. The accessory building has remained unchanged. The only previous application made by my clients was a variance for an in-ground pool (Appeal 5103) This application is to make modifications to the existing garage. The architect has proposed re-arrangement of the bathroom space, remove the tub and replace it with a shower, not expansion, and improvement to the architectural design of the existing building. The architectural design from the outside will look like a small barn. The additional space on the second floor over the existing first floor provides only added storage space. Storage space is a permitted use. The main purpose of this application is to convert the first floor garage (permitted use)for pool house (permitted use). The applicants have a pool next to the proposed pool house. A conversion of existing garage to a pool house is a standard improvement which merely requires an application to the building department for a building permit. The September 24th notice of disapproval required variances, according to the building department, for the proposed additional storage space on the second floor and the conversion of the existing garage to pool house within the nonconforming setbacks of the existing structure. In review of the transcript hearing the following issues were discuss at the hearing: of the January 21, 2010 raised which I expected to You asked me for clarification of the building department records: The garage appears on a pre-co dated October 20, 1987. According to the building permit application dated February 12, 1992, the original garage was two story (22' x 20'). A building permit was issued to convert the second floor of the existing garage to a photo studio and a new 12' x 20' one story portion of the garage is shown as "proposed" in the building permit application. The plans filed with the building department show the full bathroom on the second floor of the studio and french doors on the first floor storage area. No changes have been made to the garage since 1993. The existing building was issued a certificate of occupancy dated January 29, 1993. A copy of these documents was submitted with my November 2, 2009 application. I have attached the building department records again for your convenience. The structure is currently heated and heating is proposed. The client advised us that she does not need air conditioning. Therefore, the space will contain heating but no air conditioning. At the hearing you advised us to call you when we were ready to place this back on the calender. The client is not interested in the Town Code changes proposed for accessory structures. They do not have intentions to change the use of the studio space. They want to fully enjoy their pool this summer, therefore, they are anxious to convert the first floor storage space to a pool house. They hoped to receive approval for this conversion and undertake the improvements this season. The notices of the April hearing were sent (enclosed are the receipts), we hope that the Board can keep this matter on the calender, if at all possible.
