Present Were: Absent Were: Peter Young, Chairman Jack McGreevy, Member Audrey Hodon, Member Doug Hardy, Member Beth Motschenbacher, Member Albert Krupski, Jr., Town Board member Lauren Standish, Secretary Anne Trimble, Member Greta Schiller, Member John Bredemeyer, Trustee CALL TO ORDER The meeting was called to order at 4:30 PM by Chairman Peter Young. REPORTS Member Doug Hardy attended the last Trustee meeting held on May 19, 2010 and provided the council members with feedback on a number of the agenda items. He stated that the CAC recommendations were not consistent with the Trustees' decisions and the LWRP. He also stated that there is a lack of compliance on a particular property in New Suffolk. Chairman Peter Young said he would refer the matter to Trustee John Bredemeyer. APPROVAL OF MINUTES Moved by Doug Hardy seconded by Jack McGreevy to Approve the Minutes of May 12, 2010. DISCUSSION AND RECOMMENDATION OF WETLAND PERMIT & COASTAL EROSION PERMIT APPLICATIONS W.L. LYONS BROWN III & SUSANNAH S. BROWN for the existing 4.5'X 133' timber fixed dock and to replace 11 pilings. Located: Hedge St., Fishers Island. SCTM#10-7-12 The CAC did not make an inspection, however there is insufficient information. Soundings should be provided as well as the proposed location of the pilings. There is also a concern with possible disturbance to eelgrass beds. Moved by Doug Hardy, seconded by Beth Motschenbacher, it was RESOLVED to SUPPORT the Wetland Permit application of GARY SALICE to construct a second-story addition to the existing one-story dwelling, abandon the existing cesspool and install an upgraded sanitary system. Located: 6370 Skunk Lane, Cutchogue. SCTM#104-5-2&3.1 Inspected by: Doug Hardy, Peter Young, The CAC Supports the application with the Condition hay bales are in-place during construction, a 10' non-turf is maintained landward of the wetland boundary, the driveway is permeable and proper drainage is installed in accordance with Chapter 236 of the Town Code. Vote of Council: Ayes: Doug Hardy, Beth Motschenbacher, Peter Young, Audrey Hodon Recused: Jack McGreevy MARGARET ROBBINS CHARPENTIER to construct 89 If. of 5' wide fixed batter braced wood pile and timber pier with associated rails, utilities and ladders; install five batter braced tie-off piles all waterward Of the apparent high water line. Located: East End, Fishers Island. SCTM#3-1-5 The CAC did not make an inspection, however, the CAC recommends grated decking and the dock is shortened over the wetlands. Moved by Doug Hardy, seconded by Audrey Horton, it was RESOLVED to SUPPORT the Wetland Permit application of KARNICK GARIPIAN & HACl GARIPIAN to construct an addition to the existing dwelling and does NOT SUPPORT the Wetland Permit and Coastal Erosion Permit applications to remove existing westerly beach stairs and deck, replace existing wood deck, located on the north side of the dwelling, with pavers on grade, add new pavers on grade to northeast of residence, existing plants along bluff to be removed and replanted with beach grass. Located: 54715 Route 46, Southold. SCTM#44-1-1 Inspected by: Audrey Horton, Jack McGreevy The CAC Supports the landward addition with proper drainage on the dwelling as well as the addition, and does Not Support any change to the seaward side of the dwelling and that there be no disturbance to the bluff. The CAC recommends the applicant provide the assurance that the dwelling is not going to be demolished. Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by Beth Motschenbacher, it was RESOVLED to SUPPORT the Wetland Permit application of JUDITH ULLMAN & YEHUDIT MOCH to reconstruct the foundation and renovate the existing dwelling, remove and replace the existing sanitary system, and trim the phagmites to 12" in height, as needed. Located: 7617 Soundview Ave., Southold. SCTM#59-6-9&14 Inspected by: Audrey Horton, Jack McGreevy The CAC Supports the application with the Condition of a proper drainage plan in accordance with Chapter 236 of the Town Code and the footprint is maintained in the existing location. Vote of Council: Ayes: All Motion Carried Moved by Doug Hardy, seconded by Audrey Horton, it was RESOLVED to SUPPORT the Wetland Permit application of RENATE HERTEL to construct a 5'X 10' addition on first floor underneath existing second-floor deck. Located: 205 Cedar Point Dr. West, Southold. SCTM#90-2-25 Inspected by: Audrey Horton, Jack McGreevy The CAC Supports the application with the Condition of a proper drainage in accordance with Chapter 236 of the Town Code and a 20' non-turf buffer landward of the wetland boundary. Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by Doug Hardy, it was RESOLVED to SUPPORT the Wetland Permit application of A 8, E KOEHLER to repair the existing stone rip-rap. Located: 1595 Bay Shore Rd., Greenpod. SCTM#53-4-5 Inspected by: Audrey Horton, Jack McGreevy The CAC Suppods the application with the Condition the rip-rap is landward of the mean high water and the location is in compliance with the Public Trust Doctrine. Vote of Council: Ayes: All Motion Carried Moved by Audrey Horton, seconded by Jack McGreevy, it was RESOLVED to SUPPORT the Wetland Permit application of IOANNA & DAVID MOORE to repair and/or replace sections of the existing stairway to beach as required, in-kind and in-place. Located: 21075 Soundview Ave., Southold. SCTM#51-4-17 4 Inspected by: Audrey Horton, Jack McGreevy The CAC Supports the application with the Condition the staircase is constructed with enough strength and support to accommodate erosion control devices at the base of the support posts. Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by Audrey Horton, it was RESOVLED to SUPPORT the Wetland Permit application of CONSTANTINOS MARKOTSIS to maintenance dredge a 25'X 35' area to a depth of -2.5' below mean low water removing approximately 75 cy. of spoil. Spoil to be trucked off-site to an approved location. Located: 6540 Main Bayview Rd., Southold. SCTM#78-5-12 Inspected by: Audrey Horton, Jack McGreevy The CAC Supports the application, however, has a concern with the possible eelgrass in the area. Vote of Council: Ayes: All Motion Carried Moved by Beth Motschenbacher, seconded by Peter Young, it was RESOLVED to SUPPORT the Wetland Permit application of BELVEDERE PROPERTY MANAGEMENT, LLC to backfill washed out areas with clean, well compacted, sand fill; construct an 8'X 26'6" thick reinforced concrete apron on 6" well tamped gravel base; provide C.I. catch basin and 4" drain line; and re-install existing wooden and chain link gates in-place. Located: First & Jackson St., New Suffolk. SCTM#117-8-19&20 Inspected by: Beth Motschenbacher, Peter Young Vote of Council: Ayes: All Motion Carried Moved by Doug Hardy, seconded by Peter Young, it was RESOLVED to SUPPORT the Wetland Permit application of HENRY & LINDA STEFFI=NS to remove 92' of existing offshore bulkhead and construct new bulkhead in-place; construct two new 6' returns; backfill void areas with approx. 150 cy. of clean trucked-in fill; re-vegetate area between new bulkhead and existing retaining wall with Cape American beach grass. Located: 4522 Great Peconic Bay Blvd., Laurel. SCTM#128-4-19 Inspected by: Doug Hardy, Peter Young The CAC Supports the application with the Condition the bulkhead is constructed in-place using vinyl sheathing, the damaged wood groin is removed and a railing is added to the existing deck. Vote of Council: Ayes: All Motion Carried Moved by Doug Hardy, seconded by Peter Young, it was RESOLVED to SUPPORT the Wetland Permit & Coastal Erosion Permit applications of GLENN R. MEYRAN to repair and maintain an observation deck and for the existin~ stairs from the top of bluff to the beach. Located: 175 Soundview Ave., Mattituck. SCTM#99-3-1 Inspected by: Peter Young, Doug Hardy The CAC Supports the applications with the Condition the observation deck conforms with the current codes and LWRP and the stairs are constructed with enough strength and support to accommodate erosion control devices at the base of the support posts. Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by Peter Young, it was RESOLVED to SUPPORT the Wetland Permit and Coastal Erosion Permit applications of JULIO RAMON to reconstruct approx. 221' of existing wood bulkhead in-kind and in-place. Approx. 77' of wood bulkhead will be reconstructed along the western property line; 47.7' of bulkhead will be reconstructed along the southern bulkhead line; 96.2' of bulkhead will be reconstructed along the eastern bulkhead line. Place approx. 110 cy. of fill landward of the bulkhead to meet existing grade and plant a portion of the area with beach grass. Located: 480 Rabbit Lane, East Marion. SCTM#31-18-10 Inspected by: Jack McGreevy The CAC Supports the applications, however, because of the rising sea level and north east storms, recommends the present bulkhead is elevated to a proper height with returns and the allowance for public access up and over the bulkhead. Vote of Council: Ayes: Jack McGreevy, Peter Young, Beth Motschenbacher, Audrey Horton Nay: Doug Hardy DISCUSSION AND RECOMMENDATIONS OF APPLICATIONS TO AMEND WETLAND PERMIT & COASTAL EROSION PERMITS Moved by Doug Hardy, seconded by Peter Young, it was RESOLVED to SUPPORT the application of MICHAEL O'DONNELL to Amend Wetland Permit #5648 to allow the construction of a 4'X 16' extension with a 3'X 20' "L" section at off-shore end of existing 4'X 31' fixed dock. Located: 6010 Skunk Lane, Cutchogue. SCTM#138-2-29 Inspected by: Doug Hardy The CAC Supports the application with the Condition the materials are consistent with best management practices. Vote of Council: Ayes: All Motion Carried STEPHEN LATHAM to Amend Wetland Permit #4138 to install rip-rap ½ to 1 ton stone armor in front of the existing bulkhead. Located: 845 Rogers Rd., Southold. SCTM#66-2-40 inspected by: Audrey Horton, Doug Hardy The CAC determined that there is insufficient information to make a final recommendation. There is an indication that an environmental impact statement should be developed addressing the impact of the existing jetty and public access. SCTM#66-2-44 Inspected by: Audrey Horton, Doug Hardy The CAC determined that there is insufficient information to make a final recommendation. There is an indication that an environmental impact statement should be developed addressing the impact of the existing jetty and public access. SCTM#66-2-46 Inspected by: Audrey Horton, Doug Hardy The CAC determined that there is insufficient information to make a final recommendation. There is an indication that an environmental impact statement should be developed addressing the impact of the existing jetty and public access. BRUNO ILIBASSI to Amend Wetland Permit #469 to install rip-rap ½ to I ton stone armor in front of the existing bulkhead. Located: 1728 Arshamomaque Lane, Southold. SCTM#66-2-45 Inspected by: Audrey Horton, Doug Hardy The CAC determined that there is insufficient information to make a final recommendation. There is an indication that an environmental impact statement should be developed addressing the impact of the existing jetty and public access. BEIXEDON ESTATES ASSOCIATION, INC. to Amend Wetland Permit #469B to install rip-rap ½ to 1 ton stone armor in front of the existing bulkhead. Located: Arshamomaque Lane, Southold. SCTM#66-2-47 Inspected by: Audrey Hodon, Doug Hardy The CAC determined that there is insufficient information to make a final recommendation. There is an indication that an environmental impact statement should be developed addressing the impact of the existing jetty and public access. Member Jack McGreevy will attend the next regular meeting of the Board of Trustees scheduled for Wed., June 16, 2010. The next meeting of the Conservation Advisory Council has been set for Wed., July 14, 2010 at 4:30 PM at Down's Farm Preserve.
