at Cutchogue, New York, which said map was filed in the Suffolk County Clerk's
Office at Riverhead, New York on October 29, 1928 as Map No. 856, being bounded
and described as follows:
BEGINNING at a point located at the intersection of the easterly side of
Harbor Lane and the southerly.side of Oak Street which point is the northwesterly
corner of the premises about to be described; running thence from said point of
beginning along the southerly side of Oak Street North 43° 08' 30" East 111.0
feet to a monument and land now or formerly of D. & J. Monk; running thence along
said land now or formerly of D. & J. Monk South 51° 25' 40" East 159.65 feet;
running thence South 49° 06' 19" East 11.01 feet to the mean high water mark of
East Creek (Eugene's Creek); running thence along the mean high water mark of
East Creek (Eugene's Creek) on a tie line course of South 43° 20' 08" West 124.15
feet to the easterly side of Harbor Lane; running thence along the easterly side
of Harbor Lane North 46° 51' 30" West 169.72 feet to the point or place of
BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed by deed dated November
10, 2000 and recorded in the Suffolk County Clerk's Office on November 13, 2000
in Liber 12083 Page 976 and by deed dated March 29, 2010 and recorded in the
Suffolk County Clerk's Office on April 5 , 2010 in Liber 12620 Page 985 .
TOGETHER with all fight, title and interest, if any, of the party of the first part in and to any s~eets and roads abutting the above
described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first
part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the parity of the second pa.n, the heirs or
successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises
have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive
the consideration for this conveyance and will hold the right to receive such consideration as a ~'ust fund to be applied first for the
purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before
using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the
sense of this indenture so requires.
