THIS INDENTURE, made the 14th day of April, in the year 2010,
BETWEEN CONNIE B. FROST, residing at 2 Hamilton Road, Apartment 5J,
Morristown, New Jersey, 07960, a party of the first part, and MARSHALL
FROST, residing at 2 Hamilton Road, Apartment 5J, Morristown, New Jersey
07960, a party of the first part,
and MARSHALL FROST, residing at 2 Hamilton Road, Apartment 5J, Morristown,
New Jersey 07960, party of the second part,
WITNESSETH, that in consideration often dollars and other valuable consideration, CONNIE B.
FROST, a party of the first part, does hereby grant and release unto the party of the second part, the
heirs or successors and assigns of the party of the second part, forever, her interest in the premises
described herein; and MARSHALL FROST, a party of the first part, does hereby grant, surrender and
yield to himself as party of the second part, his life estate with the intent and purpose that his life estate
shall be extinguished and wholly merged in himself, as party of the second part, in the premises
described herein.
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected,
situate, lying andbeing at Cutchogue, in the Town of Southold, County of Suffolk
and State of New York, bounded and described as follows:
~ BEGINNING at a point on the southeasterly side of West Road distant
340.09 feet southwesterly from the corner formed by the intersection of the
southeasterly side of West Road and the southwesterly side of Fleet's Neck
Road (a/k/a Pequash Ave.); said point also being where the northeasterly
corner of the premises to be described herein and the northwesterly corner
of land now or formerly of Nicholas J. Ellis and Robert J. Tapp intersects
the southeasterly side of West Road; running thence South 28° 27' 50" East,
307.55 feet to the line of apparent high water of Peconic Bay as of 12/97
as shown on a survey prepared by John Ehlers, Land Surveyor dated 12/9/97;
running thence South 63° 23' 53" West, along said apparent high water line,
99.93 feet to land now or formerly of Herbert Young and Susan Young;
running thence North 28° 27' 50" West, along the land now or formerly of
Young, 309.97 feet to the southeasterly side of West Road; running thence
North 64° 47' 00" East, along the southeasterly side of West Road, 10.00
feet to land now or formerly of Highland Properties; running thence along
the land now or formerly of Highland Properties the following three courses
and distances: (1) South 28° 27' 50" East, 75.00 feet; (2) North 64° 47'
00" East, 65.00 feet; (3) North 28° 27' 50" West, 75.00 feet, to the
southeasterly side of West Road; running thence North 64° 47' 00" East,
along the southeasterly side of West Road, 25.04 feet, to the point or
place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the party of
the first part by deed dated November 10, 2000, and recorded in the Suffolk
County Clerk's Office on November 13, 2000, in Liber 12083 page 977.
TOGETHER with all fight, title and interest, if any, of each party of the first part in and to any sweets and roads
abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all
the estate and fights of each party o[ the first part in and to said premises; TO HAVE AND TO HOLD the
premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the
second part forever.
AND each party of the first part covenants that each party of the first part has not done or suffered anything
whereby the said promises have been encumbered in any way whatever, except as aforesaid.
AND each party of the first part, in compliance with Section 13 of the Lien Law, covenants that each party of the
first part will receive the consideration for this conveyance and will hold the right to receive such consideration as
a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first
to the payment of the cost of the improvement before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
