The Board of Assessment Review for the Town of Southold, has duly met to hear
Complaints or grievances on the tentative town assessment roll for the tax year 2010/11
as prescribed by law.
The Board, having duly convened, has considered each and every complaint or grievance
on the assessments for the tax year indicated, as filed with this Board, as prescribed by
law.
A majority of the Board has determined that all the changes indicated on the attached
page(s) will be made on the assessment roll by the Assessor.

Jose Hemandez: Ok, my name is Jose Hemandez. I live at 22950 Main Road, Orient

Jonathan Wiggins: This is your property here on 200 11th Street on the Main Road?
Jose Hemandez: Yes
Jonathan Wiggins: Do you think your house is worth $450,000?
Jose Hernandez: Last time I spoke to a real estate was about 3 weeks ago and they had
told me about that area. I go in there once and a while to see what my house is worth.
They tell me they will send somebody over and they give me a quick estimate and they
told me it's worth 450.
Daniel McConlogue: Do you have some proof of the value of the property?
Jose Hernandez: I have no proof at all. All I know is that the real estate told me this.
Also I have a right-of-way to my property which I don't know if I'm allowed to give
some credit to put on that.
Gerard Schultheis: You don't have any proo~
Jose Hernandez: Not at this point, I came in thinking that I was just going to drop the
papers off. I didn't realize I had to bring all of this stuff at this moment.
Gerard Schultheis: No, the material has to be presented today.
Jose Hemandez: Right, that is what he just told me. I didn't know that. I had some of
the stuff but I just did not bring it.
Phyllis Atkinson: We meet from 7 to 9 tonight also.
Daniel McConlogue: You can get your material and come back tonight.
Jose Hernandez: Yeah, the only problem is some of the real stuffthat I need is from the
real estate and I don't think they are going to give me another paper.
Jonathan Wiggins: How long will it take to get the statement?
Jose Hernandez: The real estate statement?
Jonathan Wiggins: Yes
Jose Hernandez: It is up to them because they have to write it up. Some of them feel
funny about writing them up especially when you tell them that you are going for a
grievance.
Cara Wells: When did you add the pool?
Jose Hemandez: I added the pool...it was two years about?
Robert Scott: The pool was added in 2008.
Jose Hernandez: To be honest with you, I don't enough about this and I think what Bob
has been telling me, sometimes we see head-to-head and sometimes we don't, and I just
want to get an honest opinion from the whole Board...what you guys thought it was
worth and present it the best way I can. Basically, I have no proof so I have to go on
what you guys say. The only thing I have is what the real estate told me, that's it.
Gerard Schultheis: Well, we need actual proof.
Jose Hernandez: Ok
Phyllis Atkinson: We can't just say...well I think he is right or I think he is wrong. We
need to have this in black and white in order to make a decision.
Jose Hernandez: Ok
Phyllis Atkinson: When was the last time you had something in writing from the realtor?
Jose Hernandez: About two years.
Phyllis Atkinson: Oh, that long? Oh,oh
Jose Hernandez: Yes
Daniel McConlogue: This whole procedure revolves around market value, the
assessment is based on the market value of your house. The assessor has arrived at that
market value and unless we get something to the contrary we are almost bound to accept
what the assessor says it is. In another words, we need...the assessor is claiming the
value of the house is 547,000 and your petition claims it is 450. Now you have to give us
an issue. Market value is something that exists. It is what houses sold, comparable
houses, sold in the neighborhood of yours, adjacent to yours and arrive at a market value.
It's that simple.
Cara Wells: And to achieve market value you really have to have something from the
last 12 months. You would use comparable sales fi.om the last 12 months.
Jose Hemandez: Right, right. So there's no way I'm going to be able to do that in one
day?
Gerard Schultheis: How long will it take for you to get that?
Jose Hernandez: I don't know, I have to contact real estates to see if they can do that,
you know?
Gerard Schultheis: Is there a chance you can get back to us today and tell us when you
have that? Then we can consider it an adjoumment.
Jose Hernandez: I will try; I'll definitely give a shot at it. Yes I will get it and come
back.
Cara Wells: And what's on the Flint Street property?
Robert Scott: Can I say something here?
Gerard Schultheis: Sure
Robert Scott: While we talk about this one...Jonathan has the property record card. The
assessment at one point had been as much as $7500, last year we stipped to $5800. We
have constantly negotiated with Mr. Hemandez and that is fine, that is what we are
supposed to be doing. If there's a difference from the value from the assessment we look
at it so it was 7500 and it was reduced to 7200 in 2005, we reduced it to 6200 in 2008.
There was a pool put in there in 2008 and there were some other additions and changes
and the assessment went to 6800, he came in and asked us to look at it and we did and we
reviewed it to $5800. There has been evidence that the assessors taken a look at this
property and in trying to work with the homeowner, Mr. Hemandez, wife and family. It's
not that we haven't been trying to help but I think the market value is pretty much where
it is.
Jose Hemandez: I agree with Bob but my only question is a couple of years when we
first bought the house you had us up to $700,000. That house was never worth $700,000.
Robert Scott: And it has been changed.
Jose Hemandez: I know, but meanwhile we still paid it. I'm not trying to be mean but
we still paid that.
Robert Scott: The ratios are changed every year so...and the values have changed every
year so all I can speak to at this point is this assessment and this ratio that is on there right
now which is 1.05.
Phyllis Atkinson: When did you purchase this house?
Jose Hemandez: 9/10/02
Robert Scott: The RAR is 1.05 and the tentative equalization rate is 1.09.
Phyllis Atkinson: You paid 185,000 for the house?
Jose Hemandez: Yes
Phyllis Atkinson: Ten years ago?
Jose Hemandez: Ten years ago, yes
Daniel McConlogue: There's no issue.
Phyllis Atkinson: (inaudible)
Robert Scott: I'm not going to address that right now. I made this up before because he
came into the office and I wanted to show him why I felt the assessment was fairly
reasonable at this particular point. He lives on one side of the fire house basically, there
was another sale there awhile ago on the other side of the fire house and we made
comparables to that but there was one a little bit offthe Main Road across from Latham's
Farm Stand, I included that one that was a tiny house.
Jose Hemandez: There's another house right down the block from the fire house that's
right across the street that's going up for foreclosure because the people aren't paying
their bank loan which is 300,000 and something dollars.
Cara Wells: That is irrelevant.
Robert Scott: That is a distress sale, I can't touch that one.
Jose Hemandez: Ok
Robert Scott: I took one on Old Orchard Lane in East Marion because I wanted to get
something...I didn't want something extravagant, I want the lower end of the market to
try and justify as low of a value as I could and I couldn't come up with enough of a
difference in the value to make a change in the assessment. I suggested to him if I could
not make a change then he still has the opportunity to go to the Grievance Board. That is
what I suggested he do.
Jose Hernandez: Yes, Bob has been honest with me the whole time.
Gerard Schultheis: For us to proceed we need some kind of proof from you of what the
value is, you can get back to us today and tell us when you can come back with it.
Jose Hernandez: How much time do I have all together?
Gerard Schultheis: You can bring...
Jonathan Wiggins: How much time do they need?
Robert Scott: Can I make a suggestion? Do you think you can have somebody do
something in a week to ten days, something like that...is that reasonable?
Gerard Schultheis: Well that's the time frame we are looking at.
Robert Scott: I'm saying this is what they are asking if you can come back with
something.
Phyllis Atkinson: Yeah, don't leave it open-ended, that when you get around to it.
Robert Scott: No but I'm saying today's the 18th SO we're talking about a week from
Friday being the latest...just to give him an idea of what...
Jose Hemandez: So let's just say 5 days
Gerard Schultheis: Probably 2 weeks
Jose Hernandez: Ok
Robert Scott: I'm not trying to speak for you; I'm just trying to help.
Jose Hemandez: Ok
Jose Hemandez: But if you could get in touch with either the assessors or one of the
board members and after you speak to the realtor and say alright I spoke to the realtor and
she can fill me in 5 days, 6 days so we know that it's coming.
Jose Hernandez: Not to sound mean, but the people, everybody considers Bob as a
threat, not that he is, I don't think he is, I think he is a nice person but he is doing his job
and they consider him a threat. First thing ifI turn around and say I want to present this
to the board, the first thing they say is Bob getting this? And I'm saying...I can't lie to
them, it's hard to get a paper from the real estate, unless I put my house up on the market
again, which I had the other one up on and I got some papers.
Phyllis Atkinson: Oh okay. What is Flint Street, is that a rental?
Jose Hernandez: The other place is a rental, yes.
Gerard Schultheis: What you need to do is go to a professional appraiser and pay him to
do an appraisal of the land, get three comparables.
Jose Hernandez: Three comparables, okay.
Gerard Schultheis: And that would be a professional appraisal that could be considered
as evidence to what your value of you house is.
Jose Hemandez: Ok, I will try to do something this week and see what I can do.
Daniel McConlogue: Does Mr. Hemandez have a copy of the...
Robert Scott: I gave him a copy of this.
Daniel McConlogue: See now that's his position with the market value is, his
comparables. You have to take a look at that and see...
Jose Hernandez: Yes, I understand, like I said Bob is doing his job and he is doing a
great one.
Daniel McConlogue: The issue before us is not something that happened this year or the
year before. The only issue is that your market value of your house, as of the evaluation
date sometime in 2009...
Jose Hernandez: If I submit the paper from two years ago saying that my house was
worth 170 something thousand dollars, that is what the real estate told me to bring it
down to.
Daniel McConlogue: We will reconsider it.
Jose Hernandez: They told me that I had it up for two and a quarter and that was two
years ago and when it didn't sell they told me to bring it down...
Daniel McConlogue: The one in Orient?
Robert Scott: No this is the one on Flint Street.
Daniel McConlogue: Oh Flint.
Jose Hemandez: They told me that they could not sell it for no more than 175 which is
much higher, much lower than what you have.
Jonathan Wiggins: Do you have any paperwork on that parcel?
Jose Hernandez: No but I could get that I'm pretty sure.
Daniel McConlogue: Still the opinion of a real estate person is not a say, the only thing
that really gives you an indication of the market is market sales.
Gerard Schultheis: What you need to do is get three comparable sales, what they sold for
with the adjustments made to your particular property and that will show what the present
market value of your property is.
Jose Hemandez: Ok, alright.
Robert Scott: Can I just make a suggestion on the one on Flint Street? If you notice on
property record card which is the last page of the second appraisal which I think you have
Jonathan...2550 is the assessment and was 3000 and I did reduce it again last year. I
reviewed it and lowered it 450 which right now is indicating 242,857, about $243,000
and the house right next door sold for $350,000, right around the comer.
Jose Hemandez: That new one that was just renovated?
Jonathan Wiggins: You have him at 243 and he feels it's worth 240?
Robert Scott: No, he is saying 170.
Jonathan Wiggins: I see 240 on this.
Robert Scott: That's what he put down, I didn't put that down. The assessment should
be 2550.
Jonathan Wiggins: Oh I see, okay.
Robert Scott: It should be 2550, if you want me to change I can or if you want him to...
Jose Hernandez: We're talking about a brand new house versus my old house.
Robert Scott: We're talking comparable sales immediately in the neighborhood.
Jose Hernandez: I know but I always thought it meant by...I mean my house is built with
old street signs and then you're talking...
Robert Scott: Whatever way you want to look at it, it indicates more than what we have
on the house right now, so we are very comfortable with the lower assessment that we
reviewed last year with you in the office.
Phyllis Atkinson: So you're turning down both?
Robert Scott: I'm turning down both.
Jose Hemandez: Ok but what about the house next door that has been abandoned and
that we have to keeping cleaning all the time?
Robert Scott: If the other house wasn't here, then probably that other house around the
comer would have probably sold for even more...that reflects on your value as well. I'm
looking at the sales that were in that immediate area.
Jose Hemandez: Yeah but we still have a house that is abandoned next door.
Robert Scott: That's right but there is demonstrated sales, that's what we have to go by.
Phyllis Atkinson: So in other words that sale took place for that amount of money
regardless of the abandoned house.
Robert Scott: That's right, they sold that 7/15/09 which is 14 days after the evaluation
date July 1, 2009, right on the money. By using the comps and using the recent sales, by
using his subject house, I'm coming up with a value even greater than what the assessor
at that point came up with in 2006..
Jose Hernandez: But see, we're talking like...I don't know how you deal with it...ifI
buy a car from 1920 and you buy a car from 1990-2000, it's a better house, it's a new
house.
Robert Scott: I also took $30,000 offbecause the condition of your house.
Phyllis Atkinson: I was going to ask Mr. Hemandez if you thought that if you put
$100,000 into your house, would bring it up to par with the one Bob's talking about?
We're talking about $100,000 difference right?
Jose Hemandez: No the house that I own is nothing compared to the ones that
(inaudible) built it. Like I said, you have an old house and you have a brand new house
and you have to look at which way you think is better.
Phyllis Atkinson: Was it being that house sold for 350,000 and you think your house is
250?
Jose Hemandez: Oh no my house is worth, from the real estate, they said I can sell it for
175 when it was on the market.
Phyllis Atkinson: Ok, it's almost $200,000 less. Do you think if you put $200,000 into
your house it would bring it equal to that or in other words that house...
Jose Hemandez: My house is so old, I mean it's an old house and I paid it as best as I
could and I want to tell you that my house will never be as nice as the house next door,
never.
Phyllis Atkinson: Never?
Jose Hemandez: No, no matter how much money we pour into it.
Phyllis Atkinson: I'm looking at depreciation.
Robert Scott: One of the reasons why I changed the assessment last year was that he
demonstrated to me, and he brought the listing in and the listing I think you were asking
at that time was 225,000.
Jose Hernandez: Yes
Robert Scott: That's one reason why I changed it last year, to reflect the value that he
had.
Jose Hemandez: That was before the real estate told me...I'm trying to sell the house,
I'm telling you the troth, ifI could sell the house I would get rid of it. It's not worth it for
me to keep it. Bob take it for 175, anybody can have it. That's what I think it is worth.
Gerard Schultheis: Jose if you get the professional appraisal done, when the appraiser
goes through the values and compares it to the house, one of the things that they will do
is adjust the conditions and age so it will bring everything into equal perspective. That is
why the professional appraiser is the proper information to have.
Jose Hemandez: Ok, ok now I have to find a professional appraiser.
Robert Scott: Can I say something? Jerry I don't want him to spend $400 to $600 for an
appraisal if he can get an opinion or value or something from a real estate broker or some
comps that at least he can present. I don't want to force him to make an appraisal on two
properties if you see what I am saying.
Cara Wells: Might as well pay the taxes than the appraisals.
Robert Scott: If he wants to pay for it that's up to him; that's a suggestion but I don't
think it should be a requirement.
Jose Hernandez: I appreciate that Bob.
Robert Scott: I'm not trying to interfere with you or him but I just don't want him...

many sales and that's the width of Southold Town we do then have to extend it so we
have to...you have to go back because there is just so few sales we have to use the best
sales available. Should be go back to 07/06? We can't do 06/07 but we can...

37,400 for Senior and that includes social security.

I have one other question. My adopted mother is going to be 100 years old this week and
she has a place in Mattituek and I would like to find out about her stuff.

Peter Jauquet: Yes I do.
Gerard Schultheis: In your words do you want to tell us what your...?
Peter Jauquet: Well, you know, I got the letter and the assessment almost doubled. I
think it's because we put in an addition on the back which was an additional 638 square
feet for the house.
Gerard Schultheis: What was it?
Peter Jauquet: An additional 638 square feet for the house in the rear.
Jonthan Wiggins: How big was the original house?
Peter Jauquet: I don't know. The appraiser had it about 2300 square feet as it is now, so
less than 6.
Robert Scott: Can l just say something? That is quite not true. The appraiser and the
appraisal that he submitted shows it at 2,072 square feet. I show it as 2320. He's
adjusting on the basis of 2072, the appraiser. I say it's 2320.
Phyllis Atkinson: Where did each one of you get your data from?
Robert Scott: I got it from the architect's plans that I got from the Village of Greenport.
I got them right here.
Phyllis Atkinson: That's for the addition or the whole house?
Robert Scott: The whole house.
Phyllis Atkinson: Ok and you have...?
Robert Scott: I have 2320 square feet.
Phyllis Atkinson: Including the new addition?

Daniel McConlogue: The appraisal has 2002?
Robert Scott: 2072 square feet and when you adjust on the basis of square footage it does
make a difference on the appraisal.
Phyllis Atkinson: How much is the square footage for adjustment?
Robert Scoa: I didn't even check theirs to be honest with you. Can I borrow your
calculator and I can find out for you?
Daniel McConlogue: What is the assessor saying the market value is?
Robert Scott: To be honest with you the assessor was willing to reduce the assessment
from 6500 indicated $619,000 and when Peter came in I was willing to reduce the
assessment; I made an offer in the past; I made another offer which was refused. I think
according to what you're requesting now you are looking at the 500,000 range was it
Peter?
Peter Jauquet: Well the appraisal was for 480, I take it we are talking about full market
value. Are you talking about assessed value?
Robert Scott: We are talking assessed value.
Peter Jauquet: I was thinking 5,000, that's assessed value, and you were thinking of
what?
Robert Scott: I offered 58 and I offered 55. When I took a look at the appraisal...I stayed
late last night, he doesn't know about this because I stayed late doing appraisals, the
comps that they used in his appraisal for the most part were correct according to our
records so they must have used our records to get the square footage for the comps. One
comp was too little which is a problem because again, there is not enough of adjustment
and the subject house was wrong according to the plans as we have it. They have 2072
square feet and we have 2320. I would suggest at this point that he has some validity in
this appraisal and I would suggest it go in the range of 5200 and that would be acceptable
to me.
Peter Jauquet: Yeah it would be acceptable to me too.
Phyllis Atkinson: Oh well we'll stipulate from that.
Robert Scott: We can do that. That's not a problem.
Gerard Schultheis: Do want us to do it or what?
Robert Scott: I went and did the extra work last night and pulled the plans out. I wanted
to make sure I was correct and I dreamt last night about it. I wanted to make sure that the
comps they were using in there were the same as the comps, square footage that we have
here. If it was wrong, then I was willing to make a change.
Peter Jauquet: See the other part, what I ...the plans we've had nothing but trouble with,
measurements on the plans. That's why I preferred with what this guy had had. The
other thing, the other part of this thing is just looking at some of the other assessments of
houses in the neighborhood that are actually ground-up construction. They are all above;
they are all at 5700 that's why I was asking 5...I mean 52.
Robert Scott: Ok, 52 we will change it. We will just do a stip and we will be fine. Ok?

Chris Cyprus: My name is Chris Cyprus. My home address is actually 51 Sunset Blvd.
in Wading River. The property that I am here to address to file a grievance is on 1100
Sound Beach Drive in Mattituck. I have a few pieces of information that I want to
explain and share that has me here. The appraisal that you have in front of you; the
reason why I actually hired the appraiser was not the tax grievance. For the last 18
months I have been trying to get a building permit. I am on waterfront which requires
FEMA and I guess I learned a lot by doing this but I guess if you spread more than 29%
of the value you have to go up and therefore I needed a certified appraisal. The certified
appraisal has been in the Southold Town Building Dept. since last year and that's really
why I started with the appraisal. Of course I was looking for every dime I could get
because I'm looking to renovate and that costs a lot. So I would like you to expect where
I am coming from to see how the appraisal came about and how I got into this. So that is
the appraisal and that has it at $975,000 and that's what you're asking for. That's what
I'm asking for. Now I do have another piece of information that's not as clear and cut
forward but I do have all the documentation with me. My brother and I had inherited this
property from my parents. Back in 2008 1 bought my brother out and the buying out was
a partition of the estate. I do have the agreement and the appraisals from the other
properties that were involved. When you go through the math on how they partition that
back in 2008 that would have had the value of this home at $987,500. I can show you
how I did that or how that came about. I guess I will start with the agreement.
Gerard Schultheis: Let me ask you a quick question. The appraisal that you have here,
that's just in the portion that you own now and that's the portion that you are grieving?
Chris Cyprus: Correct, right.
Gerard Schultheis: Ok so that ability I don't think enters into the situation.
Chris Cyprus: It does, to establish a purchase price back in 2008 but if it doesn't enter
the equation then I will leave it alone.
Gerard Schultheis: The transaction was between you and you brother?
Chris Cyprus: Correct
Gerard Schultheis: And is there an appraisal associated with that because that is not
typically considered an arms length...
Chris Cyprus: You have the most recent appraisal.

Daniel McConlogue: The difference is really not that much right? 987 as opposed to 975
Chris Cyprus: No, in 2008 the cost would have gone down but that's ok. I went with the
appraiser, I mean that's what I have been trying to work with the Town on trying to get a
building permit but that's a whole other subject.

Kevin Webster: Right now it comes out to $1,152,380 as of July 1, 2009, the valuation
date.

Cara Wells: As far as I know it's because there were so few closings you had to take
whatever you can get.
Chris Cyprus: The original appraisal was done for the building purposes back in July and
I called him up in February or something of that time frame and said can I use that
appraisal for a tax grievance and they said I have to add comps to that appraisal as well.
So I know he did it roughly in July...
Daniel McConlogue: And he adjusted those later sales to July 1.

Chris Cyprus: I've been trying to get a building permit for 18 months. I am on the water
and if you spend more than 29%...you have to go up because of FEMA so when you put
in a set of plans you also have to put in an appraisal for what the home is worth.

Chris Cyprus: Yes
Daniel McConlogue: Do you see his comparables?
Chris Cyprus: No I haven't looked at them
Kevin Webster: There is a fourth one there. Number four is actually on your street as
well.
Chris Cyprus: Number four has other things with it right...as I may...hat I know
something about...
Kevin Webster: Sure
Chris Cyprus: That's actually a 50 foot and 75 foot piece of property so it was 125 and I
as I understood it had a condition that's why it took so long to dose is that they have
building permits to put up two homes. You have two plots, a 50 foot plot and a 75 foot
plot, with a home on one of them and a permit to put a home on the other one so you're
really looking at something very different than exactly what mine looks.
Kevin Webster: The way that was written, the house sold for $800,000 which was a 896
square foot house, two bedroom and one bath house that they put down on the deed for
$800,000 so as a 75 foot lot on the sound where you only had a house of 896 square feet
with no real amenities to speak of at all, no heat, no fireplace, no basement, one
bathroom, the house looked like this. That sold for $800,000 only 75 feet of frontage on
the sound compared to the Cyprus's house which is over 3,000 square feet with five
bedrooms and four baths and 100 feet of sound front. I have listed in there the way they
wrote this they have the vacant lot next to it with 50 feet of frontage sold for $397,500 so
you can look at it as $800,000 for 896 square foot house with one bath and no other
amenities or it's 1,197,000 for 126 sound front together, however you want to break it
out.
Jonathan Wiggins: So this 99-1-38.2 is also 12.1
Kevin Webster: Yes it is also 12.1 the same people bought that together on the same
exact date.
Jonathan Wiggins: And how much was the lot?
Kevin Webster: The lot was...well they put down 397,500 is how they posted that and
they posted 800,000 for...
Jonathan Wiggins: 397 for the lot...
Kevin Webster: Right, and 800,000 for the 75 foot lot that had this house on it.
Jonathan Wiggins: And that's how you got your figure of 1,197,0007
Kevin Webster: Right, it would be hard to display that on this grid, 801 per 397 and
adjust the house to a piece of land so...
Chris Cyprus: Well I think it's important to add the (inaudible) family bought, it had
several homes, they bought it with the condition. It took well over a year before it closed.
It was two pieces of property similar to way that mine was...they went and got building
permits. They stayed this way. The people that bought it, it was one family that sold it.
They bought two building lots at 1.3 million or something of that nature.

Chris Cyprus: So basically they are going to have two homes for that 1.2. They still
have to build another home, but that's two homes.
Phyllis Atkinson: But see, vacant land on sound was 397,500? Was that arms length?
Kevin Webster: I'm not sure, but if you're paying $800,000 for a 75 foot lot with a shack
on it without any heat, no basement, no fireplace, that to me is more like it...$800,000.
The house that we are talking about here is a very very nice house; the subject is three
and a third times bigger than this cottage that sold at $800,000. It is 3,000 square feet
compared to 896 with all the other amenities it has, the five bedrooms, the four baths, of
course it has heat. You're talking about garage space that they have, almost a 1,000 feet
of porch, fireplaces...
Chris Cyprus: The house there that you are looking is original 1950...
Kevin Webster: The other house, yes.
Chris Cyprus: But the deal here is they bought the two lots, built two homes, the
comparison...you can take that all of these are valid. You can take and view that it's a
900 square foot home from 1952 on 75 foot lot that sold for x but the actual sale is two
lots, putting up two homes and that's what they are doing.
Gerard Schultheis: If I'm not mistaken, what you're saying is that the sale price for the
house plus the lot was $1,197,000?
Kevin Webster: Yes
Gerard Schultheis: Ok so for comparison purpose here, you are not including the
buildable lot. You are just saying it is a 900 square foot house on the second lot that has
a value of 200.
Kevin Webster: I added the sale price in at the top but I also added in the location on the
sound frontage being more than what the Cyprus' house.
Phyllis Atkinson: And the two lots total .53 acres?
Kevin Webster: So the difference just for the cottage alone which is a knock down is
$352,000 between the value that we have on the Cyprus' house and the value of what a
896 square foot tear down cottage sold for with 25 feet less of frontage. That is just one
other sale that I have that's in that area.
Jonathan Wiggins: Kevin, this property here is it bulk headed?
Kevin Webster: Let's see...no we do not have bulk heading on this. I don't think any of
these have bulk heading. These are low; these are not up on bluffs. If you go up on the
east side of the inlet, then you have people that are up on bluffs. There are stairs that go
down and some have bulk heading down at the bottom just to hold everything intact but
these are down low.
Daniel McConlogue: Did you ever get your building permit?
Chris Cyprus: I don't know what it takes; I'm still trying.
Kevin Webster: I have a couple of things that I want to mention about this appraisal that
Tom did. I've coached little league with him for many years and I know him personally
but number one, the number one sale on here is on Jane's Creek. It is at the top of Jane's
Creek on Ole Jule Lane when you are coming down. It is the first house there where you
start to turn and go down.
Cara Wells: Pretty much land locked.
Kevin Webster: It has a muddy creek you can go'out to. He is trying to get his dock
permit but it's .... it's 122-4-3 on your tax map. He has a 4,000 dollar square footage
estimate on that, it's actually only 2452. The owner came in last week and we went over
that together and confirmed that it's only 2452. It's 122-4-3 on your tax map. To me,
it's not a comparable...to me; I have a problem with that being comparable to the
Cyprus'. Number two is 20275 Soundview Ave; it is 51-4-8. It is 9 miles away on the
sound in Southold right up here and I found the card. It's this house right here if anybody
wants to take a look at it. It's 1200 square foot 70 year old cottage. Tom is comparing it
to their 3,000 square foot, five bedroom, 4 bathroom house and that sold for $960,000.
Phyllis Atkinson: This is not even on the water.
Kevin Webster: Yes it is. It is up on the bluff. It is $960,000, 1200 square feet
compared to 3,000, it is a 70 year old cottage, it's two and half times smaller and it's 9
miles away. It has 67 feet on the water as compared to 100. So do I think 1,152,000 is
reasonable...I do. The third one is 51-1-15 which is right here and that has 100 feet of
frontage. Now that sold for $990,000 but I have the picture of it right here; I have the
card you can pass it around. That's a 996 square foot 40 year old cottage with one
bathroom. Compare 996 compared to 3,006 that's more than three times smaller than the
house that we are talking about and it's up on a bluff again. The other thing that is very
subjective is Tom is taking off $180,000 for each of those saying that it is better to live
up high on the bluff where you can't get down to the water as opposed to living fight on
the water where you can just walk right out.
Daniel McConlogue: What was number three's sale? How much?
Kevin Webster: $990,000 and the adjustments that were made on both of those, number
two with the $180,000 comes out to $1,039,000. They are both on the bluff. The main
thing on two and three is that when you look at the picture of the subject and you look at
the size of 3,000 'compared to these at 1225 and 996, you could put these two homes
inside the other home three times. They are 9 and 7 miles away. I feel that the
assessment is fair on this house based on the evidence ! presented and based on what I am
looking at here. I don't see any room on my side.
Daniel McConlogue: The difference is square footage is mostly because the subject is 2
story. I'm looking at pictures and I...
Jonathan Wiggins: His house has been added on to...
Kevin Webster: Those are the comparables.
Daniel McConlogue: I'm comparing the comparables to the subject and there's a big
difference in square footage.
Kevin Webster: Yes, the Cyprus' main level square footage is 2,070. So the first floor of
the Cyprus' house is 2,070. The first floor to these homes are 1225 and 996, that is just
the first floor, so even on the first floor it's double and then you tact on the second floor
that's there. Like I said, even Tom said that they are cottages.
Jonathan Wiggins: Those are in a very nice neighborhood. Soundview is one of the
nicest sections around.
Kevin Webster: These homes are on top...Yeah they are right across from Burgundy
Estates is by Chablis Path there along the humpty dumpty mad.
Phyllis Atkinson: Oh Chardonnay, ok
Kevin Webster: Yes, fight along there. That is right where these two cottages sold.
Chris Cyprus: I always understood that Southold beach is a lot more, a lot nicer than
Mattituck beaches. (inaudible)

Gerard Schultheis: So you submitted a grievance basically to get a rough estimate on
what you think the market value of the property is.
Gary Zaremba: The house was purchased two years ago for $630,000. I have a copy of
the last listing at that time period; it was listed at 795. So the sale was for 630...
Jonathan Wiggins: What's the date on that?
Gary Zaremba: I'd say June of '08. The market listing of the house at that time was 795,
which was the market value from MLS. The asking price was 795. So it was about a
20% discount offofthe asking price. When it came time from the bank to give me a
mortgage they came up with the value of 700 at that time.
Gerard Schultheis: What is the date of the appraisal?
Gary Zaremba: 5/08. I bought in 6/08; the appraisal is for 5/08 because that is the time I
got the mortgage and the MLS listing which was dated for 08 so I really don't know
when it went on the market. I don't remember.
Jonathan Wiggins: What is the appraisal price?
Gary Zaremba: 700,000

gone down and that's why I didn't get a new appraisal.
Daniel McConlogue: What does he claim on his petition is the market value?

assessment adjustment last August?
Gary Zaremba: Yeah based on the conversation I had with Mr. Webster. I didn't really
don't know this process. I was new to the area and I didn't want to argue with the Town.
Then when I came in this year I said, ok time has passed let's...
Gerard Schultheis: What has changed since August of last year that requires a reduction?
Gary Zaremba: Nothing, the only reason I stipped to it was because I didn't fully
understand that this process was available to me. The only thing that has changed for me
was the (inaudible). IfI knew that I would have just said 630.
Phyllis Atkinson: This is the whole appraisal? Oh oh ok Is this the only appraisal you
had?
Daniel McConlogue: Subject's sale was two years ago fight?
Kevin Webster: Yes
Gary Zaremba: We dropped it fi.om 92 to 81
Jonathan Wiggins: It is still at 770,000 and he paid 630,000 for it.
Kevin Webster: Yes. Gary and I talked about this many times on a friendly basis.
Daniel McConlogue: Is there something wrong with the sale, do you have a problem
with it?
Kevin Webster: Well I feel that the size of the house and the size of the land for this area
I feel that the value we have on it is fair. I feel the 770 on there is more indicative market
value for July 1, 2009 than the subject sale.
Phyllis Atkinson: Is this living area over the garage?
Gary Zaremba: Yes
Cara Wells: Basically this went onto the market at a very (inaudible) where there was a
reluctant seller. It's been on the market for a long time. It was on for over a million; it
was overpriced. I think by the time you purchased it you got a pretty good deal
considering that the farm house fight across from you is now on the market for over a
million. It's fight across the street from the subject property. It is just a little further
west.
Daniel McConlogu¢: Ok so you say that the subject sale doesn't necessarily reflect the
market value, what do you base that on, do you have some other sales?
Kevin Webster: I will be back. I don't have anything on me now I just have the property
card and the grievance. Gary just came in and I came down here.
Jonathan Wiggins: What do you have to say about the sales that he used here in the
comp?
Kevin Webster: I have not seen those today, maybe a few months back but not today. Is
there a copy of the appraisal that I could look at briefly and comment?
Phyllis Atkinson: Uh Jonathan has the only copy. Do you want to make another copy?.
Kevin Webster: I will have them make a couple of copies.
Phyllis Atkinson: It's a pretty water tower.
Cara Wells: The house was originally a barn. It's a unique house.
Kevin Webster: Let's see here. Bob made two more copies of this appraisal. I'll pass
these around; this is something I had put together. To comment on the appraisal it would
be this: first is that the assessment at 8100 shows a taxable value of $771,000 this the
first time I really looked into this appraisal. If you look at the adjusted values without
even looking at the square footage, the adjusted values of this appraisal... Number one is
at $638,000, number two is at $851,000, over $70,000 higher than the taxable value that
the Town has on the parcel and number three has a taxable value of 766 on the appraisal
that we have, not the work up I gave you, it's on the appraisal.
Phyllis Atkinson: What is the net and gross on the bottom?
Kevin Webster: The net and the gross...the net adjuslxnents for number is a positive
80,000
Phyllis Atkinson: Not percentage?
Kevin Webster: Yes, 14% net 25% gross. Number two is very good. The total
adjustment is a negative $34,000 but the net is only 3.8% and the gross is under 8% and
that adjusted to $851,000 and we only have it at 771. Number three the total adjustments
is a positive $26,000 adjustment with a net of 3.5% and the gross is 15% and that's at 766
and again we only have it at 771. Two of the three comparables that the petitioner has, in
my opinion, show that the taxable value is more than fair on this. If you look at number
one sale, it is a May 30th 2007 close date keeping in mind July 1st of 2009 so it's a full 24
months before the valuation date. The subject is a 3800 square foot house, that's a 2200
square foot house, again, some major differences there. The number two sale on Harbor
View is actually only 2722 square feet; there is a round number estimated there by this
appraiser of 3850 so there is a major difference there. Obviously in looking over these
appraisals, when you have a higher number on the square footage for the comparable you
are not going to add as much there because if you look at the real number of 2722 you get
a positive adjustment worth about $53,000 additionally what's on there.
Phyllis Atkinson: You used the same one, huh?
Kevin Webster: I did, yes. I, with taking off for time, just to say that the market had
gone down from July of '08 to July of '09, although I really don't like to do time
adjustments, even ifI took off the percent, I'm still at $800,000 and his appraisal is at 850
for the same comparable so he's higher than what I am at. The Sound Avenue house sold
for $740,000 that is actually only 1843 square feet from the Town records. The appraiser
estimated it and he estimated it at 2500 square feet, it is not 2500 it's only 1843.
Phyllis Atkinson: Let me figure out what he used for the gross living area adjustment...
Kevin Webster: I can do that for you.
Daniel McConlogue: Did you say something about an adjustment for time...percentage?
Kevin Webster: I made a 10% drop across the board just to be fair to see ifI could come
up with something, if that was going to be an argument for a time adjustment if
somebody said "Well the market has dropped tremendously down," I just took 10%
across the board and I'm still above the 771.
Daniel McConlogue: Using the 10% adjustment for time, how do you deal with the
subject sale?
Kevin Webster: I don't believe it's an arms length...I don't believe it is indicative to the
market. The petitioner's own appraisal is at $700,000.
Daniel McConlogue: I understand that but it is market that is a market sale.
Kevin Webster: The appraiser shows that it is not in my work up because it's below
market.
Daniel McConlogue: The actual sale of the subject property in the marketplace...
Kevin Webster: One sale doesn't make a market.
Daniel McConlogue: That's correct.
Kevin Webster: Yes and the appraiser is adjusting, Phyllis, $35 a square foot and again I
think that is below what I've seen for many...
Phyllis Atkinson: Yeah, last time that I used $35 was...
Kevin Webster: But that of course that keeps the positive adjustment down so instead of
adding what would be normal, let's say 60 on that, you would be adding 1299 times 60;
you would be adding 78,000 as opposed to 45,000...
Phyllis Atkinson: double
Kevin Webster: Yeah right, you would almost be doubling if you went to 70 which is
reasonable for this size house. There is a few things here that the estimates of the square
footage bother me because they are not accurate.
Jonathan Wiggins: You did not add for the swimming pool on the card?
Kevin Webster: I did not. Thank you for that. That was a rush by me. We could add
another 15,000 for that which would bring me up to almost 900,000.
Cara Wells: So you are giving the swimming pool how much?
Kevin Webster: 15,000
Phyllis Atkinson: Oh so that's 899
Kevin Webster: So again I feel that the 770 that we have on there is more than justified
by my work up and the petitioner's appraisal. When you really look at the...two of them
being 850 and 760 and for this appraiser to pick 700 is just unreasonable.
Jonathan Wiggins: Now he's got a paa'lal basement, you did adjust for full basement but
you didn't adjust anything for the half basements. How big is your basement?
Kevin Webster: They say 600 square feet of basement. I think that is comparable to
what a half basement would be on a one story house, half basements on these houses here
are probably the same.
Jonathan Wiggins: You have four full baths in the house?
Phyllis Atkinson: You don't have central air?
Gary Zaremba: No
Kevin Webster: Another thing I want to mention on this appraisal is that they're
adjusting, the appraiser is adjusting $5,000 a bath, $5,000 for one bathroom, I mean that's
half of what I see normally for a full bathroom. I don't see appraisers that use $5,000 for
one bathroom, it's at least 10 if not 12 and on the higher end homes it's 15. I think that
positive adjustment of only $10,000 for two full bathrooms, market bears out more than
that only $10,000 for a house with four baths as opposed to two when you do a fair sales
analysis.
Jonathan Wiggins: On comp three, you adjusted 74,000 for the busy street, in comp two
you did not for the busy street. You did not do any adjustment over there.
Kevin Webster: I did not. Yes I did not make a positive adjustment because New
Suffolk is not as busy as Sound Avenue obviously. Sound Avenue has a ton of traffic;
that's the North Road.
Phyllis Atkinson: Is this Sound Avenue in Mattituck or...?
Kevin Webster: Yes, Sound Avenue in Mattituck before ours. The Koloski's own that
house.
Phyllis Atkinson: Oh, right at the end of Aldrich
Kevin Webster: Right, it had similar land and it was close. The New Suffolk Avenue is
the one before you get to the Norris' Estate on that right that it sold.
Phyllis Atkinson: Uh huh
Kevin Webster: That gets traffic but it's not...I just put down that it gets busy just to
make a point of reference.
Jonathan Wiggins: On comp three you also have acreage; you have 1.7 in the subject
property and you have two acres in comp one, and one acre for comp two and comp three
is almost 2 acres also you did not adjust there.
Kevin Webster: Yup, that could be another 80,000 taken offthere if we do that.
Jonathan Wiggins: It's almost two acres...
Kevin Webster: Yeah that would bring that one down too.

807, fight, 807 for number three. That is with these generous time adjustments that I
made in the petitioner's favor that his own appraiser did not make.

after all said and done all taxes paid, whatever I do have to pay out, ifI went home...I'm

perfectly honest I think that the bottom has fallen out no matter where you are.

Christine Piacente: I don't even want to say what my assessed value is and I'm trying
not to think about it.
Jonathan Wiggins: Kevin did you make a copy of the property data cards?
Kevin Webster: Copies of the property card?

Kevin Webster: No I did not make copies of it. I do have an additional copy of the
property card, if you need a few others we can make it.
Gerard Schultheis: Ok I also see it looks like you had a reduction by the Small Claims
court jus.t this year in your assessed value?
Christine Piacente: No I didn't have any reduction. I had a reduction many many years
ago...
Gerard Schultheis: It was 6/22/2000.

Daniel McConlogue: Ok so your position is...everything is based on the market value,
the assessment is based on the market value and that's what we are looking for...what is
the tree market value. Your position is 925,000?
Christine Piacente: If I have to agree with the appraisal then I will agree with the
appraisal, it's certainly not more.
Daniel McConlogue: And the assessor's market value from the assessment indicates that
you say the market value is one million...
Kevin Webster: $1,276,000
Gerard Schultheis: All of them are based on sales in your appraisal.
Christine Piacente: But the sale that Mr. Webster keeps citing was...when was the
Bauer's farm sold...four years or five years ago? That what he keeps citing and also I
would like to say that there is no comparison to my home and the Bauer home. That was
a beautiful colonial, I have an austere ranch. I don't have any amenities or anything; I
have an austere house. I have the smallest house in the whole area.
Jonathan Wiggins: Well they make adjustments for that but do you have any other sales
in the Wolf Pit section?
Christine Piacente: Only the one from the Bauer home, I believe it was...what was it
Mr. Webster...four years of five years ago?
Kevin Webster: I think it was in the middle of 2006 there was a house south of the
Piacente home that sold for a million...
Christine Piacente: I think it was before 2006 myself
Cara Wells: No it was at the height at the market
Christine Piacente: Again another consideration, it was theheight of the market.
Kevin Webster: It sold for $1,600,000 in 2006. The appraiser that did the appraisal for
the Piacentes is not using that house and I am not using that as evidence either.
Christine Piacente: No but every time I speak to Mr. Webster on the phone, let's be
honest I've called you every year I get my tax bill, he cites the Bauer farm as a
justification and I keep answering there is no justification...
Jonathan Wiggins: He is not going to use that'home today so we will work around it.

Phyllis Atkinson: I'm looking at it right now. I don't understand this, under sales when
it's in concession the appraiser put C.D. 5/09, C.D. 6/09, C.D. 3/08

Kevin Webster: If you are requesting it I will. I'm here to talk about the appraisal, if you
would like me to do something...I'm not pushing that out there on anybody. If you are
asking for that I will do that. I will be happy to address the assessment and the appraisal.
Jonathan Wiggins: There's an awful amount of garage space on here.
Gerard Schultheis: Do you have something to say about that?
Kevin Webster: Yes
Jonathan Wiggins: Fifteen car garage, ok, are these just any kind garage that you have on
your property?
Kevin Webster: If I may, one thing you will notice is that the gross adjustments that are
being used on the appraisal the Piacente's have and the five comparables that I submitted
are at a high level and typically that happens when you have a 5 acre lot here, you are
going to have adjustments that are...the gross adjustments tend to be high. That is just
the way it is...38%, 42%, 38%, I have 47, 47, 46, 58, and a 23. It's hard to find sales of
this size in Mattituck. We have some that are on 2 acres and we both have used some
that are less than an acre for~a 5 acre lot. That is not what we are trying to do, I put five
comparables on here to look at a range of sales and adjusted values. As I said, the taxable
value for this house as of July 1st 2009 is $1,276,000. I have five comparables in the
Mattituck/Cutchogue area that just one to a 1,495,000, that house sold for 1,215,000 in
November of '09 contract date probably September of '09, it's 2880 square feet without a
finished basement and it's not on the water on a half acre with central air, it has a garage
of only 576 square feet attached as opposed to the 950 that the subject has and the subject
also has an additional 4752,that alone is over 1,215,000 on a half acre and the Town's
value on the Piacente's is 1,276,000. I feel that is well within the range ofvaiue. If they
received 1,215,000 for only a half acre they have four and a half acres more with a
finished basement space that the appraiser said it's 50% finished, they are saying that it is
about 1100 square feet of finished space and we have about 1615. Either way you can
say 1100 square feet that house did not have any finished basement space and it has 4752
square feet of garage as well as additional 400 square feet that is attached.
Cara Wells: Is the garage heated?
Christine Piacente: Only the attached.
Jonathan Wiggins: I see that you used Meadow Lane and I'm just curios why this
Meadow Lane house sold for 845, you comped it down to bring it up to 1.1. and you did
not use the other Meadow Lane...is this the same house?
Kevin Webster: Yes
Jonathan Wiggins: Oh ok
Kevin Webster: It sold for 845
Jonathan Wiggins: and she is coming out with 953,000
Kevin Webster: Right, well I feel that 4 acres of land is worth more than $115,000 for
the North Fork of Long Island, that would come out to be only $28,000 an acre. I think if
you compared sales analysis, in my opinion, it is going to be worth more like $275,000.
For 4 acres of land to have a difference of only 150,000, I think that is excessively low.
Christine Piacente: But the land is restricted, it can't be developed, I can't put up another
house, I can't sell offthe back lot. I only use the frontage...see what had happened is
when we purchased the land it was so inexpensive but we didn't realize over 15 years that
everything was going to fall forward and that's really what is going on now. I can't sell
offthe back lot, I can't put another house, I can't develop it in any way. Let's just say
roughly there's two and a half acres that sits (inaudible) I can't even sell the rights back
to the Town. I can't do anything with the land. It's restricted.
Phyllis Atkinson: This is in your covenants and restrictions that go along with the deed?
Christine Piacente: Correct
Phyllis Atkinson: Ok so when you bought the property you knew this.
Christine Piacente: Right but we didn't think, like I had said, that everything was going
to turn far forward, that's what happened here and that's why I am here because it's so
extensive.
Phyllis Atkinson: Let me ask you another question. What does the finished basement
consist of...is it heated?
Christine Piacente: Yes
Phyllis Atkinson: Is it air conditioned?
Christine Piacente: No. I'm just asking, isn't it on the appraisal?
Phyllis Atkinson: I don't have the appraisal all I see is finished basement.
Christine Piacente: It's one big utility...one big open room...
Phyllis Atkinson: Rec room
Christine Piacente: and a bedroom with one bathroom with one shower stall and then
there's the laundry area which is completely unfinished and the boiler room
Phyllis Atkinson: So you have a rec mom, bedroom, full bath, laundry room and a utility
room
Phyllis Atkinson: Do you have any idea of what the square footage is for the basement?
Christine Piacente: Again, my house is austere. At the time the whole basement cost
maybe $12,000 that was about it. I have no luxury fixtures, my kitchen stove, I'm not
making this up, I have the $400 Magic Chef stove in the kitchen. I have no amenities, no
Jacuzzi...nothing, I don't like it. I wanted a fancier home but my husband and I didn't
have the money.
Jonathan Wiggins: I'll tell you what's affecting the appraisal work up sheet here is the 15
car garage.
Christine Piacente: Correct
Jonathan Wiggins: That's throwing things off
Christine Piacente: What I would like to say is that my husband is a mechanic and what
he did was when he could purchase the cars inexpensively in the '70s...
Jonathan Wiggins: Alright, everyone likes their toys
Christine Piacente: Right but what I want to say to you is that he restored them himself,
he didn't go and purchase them, he did all of the work himself. It's not like he is a rich
man who just went and bought antique cars.
Jonathan Wiggins: That's not the point; the point is that you have the space there.
Christine Piacente: Ok I agree with you but the other point of the story is we are not
running a business at all; it is personal use. Many people including my neighbor
immediately to the south are running a business fi.om their house. I'm not running a
business; I'm not storing other people's cars. I'm not running a business; I'm not making
money fi.om my property.
Gerard Schultheis: Does anybody else have any other questions?
Phyllis Atkinson: 800 Ruth Road, is that the spec house?
Kevin Webster: Yes
Phyllis Atkinson: ...that's across from the water?
Kevin Webster: Yes that is
Phyllis Atkinson: That was on the market for a long long time
Kevin Webster: Yes it was and they still got 1,215,000 for it. I went through a range
here now number five you will recognize as the...now that is a 5 acre lot, number five on
this is the Pilossof house which is the one that is on the way down to Laurel Lake on the 1
let~. Now that was a 5 acre lot that sold for 1,375,000 with only 746 square feet garage.
It is a lot bigger, yes.
Phyllis Atkinson: 5,000 square feet?
Kevin Webster: Yes, we made adjustments. I'm just giving you a range on what's
selling fi.om 5170 to 2400, no finished basement on that one, did not have the extra 4700
square feet of garage but it did have 4.72 acres of land.
Christine Piacente: But the house was 5,000 square feet fight?
Kevin Webster: Yes, we adjusted that.
Phyllis Atkinson: What was the square footage adjustments?
Christine Piacente: Was the 5 acre lot restricted like mine?
Kevin Webster: Yes that was part of the subdivision. I adjusted $50 per square foot and
I adjusted 30 per square foot for the finished basement. If you look at what the adjusted
values are here I have 1,495,000, 1,324,000, I have 1,143,000, 1,187,000, and 1,316,000.
Jonathan Wiggins: Yup, and those are beautiful homes too. Some of these houses are
very nice.
Kevin Webster: I feel that Wolf Pit Pond Estates is one of our nicer areas in Mattituck
when you go up Mill Lane everybody has a 5 acre lot and a beautiful setting so I think the
Piacente's area is one of our nicer areas in Mattituck. These other homes that I have here
are individual homes in individual areas if you look at that Meadow Lane house is in
Mattituck Estates but it is in the middle ora lot of ranches that are on half acres that are
1100 square feet.
Jonathan Wiggins: What do you have as the assessment in the land of the Mattituck
Meadow Lane house?
Kevin Webster: The land assessment I do not know what it is offhand but I would
probably say that the land assessment based on 1600 an acre is about $1300 for the land
assessment on that.
Cara Wells: Meadow Lane also has farm land behind it.
Kevin Webster: It does, to the west. That's where Bladicus' house sold in there for 500
and there's somebody trying to sell a house in there for 470 in there. Henry Raynor's
house was listed in there.
Cara Wells: Right, I know the area
Kevin Webster: It's not one of our high high end areas; it's not country club estate but
again it is less than eight tenths of an acre, there are 5 acre lots up there so again I feel the
assessment, which has been the same for ten years is still a valid assessment because it is
2128 square feet of living space with even with what the appraiser says now is over 1000
square feet of finished basement and 5700 square feet of garage on 5 acres and the house
is 12/13 years old.
Christine Piacente: But again I have the smallest house if you take the time to drive
down the road, I have the most austere house...
Cara Wells: We understand.
Christine Piacente: I don't have a luxury home.
Jonathan Wiggins: Kevin, one other point here getting back to the Meadow Lane house I
am just trying to make some sense out of this. You have the property valued at, on the
subject property at 323,000, and you added $275,000 to the Meadow Lane address to
come up with your comp; are you saying that the Meadow Lane house is worth only
$50,000 in property?
Kevin Webster: You're talking about the site adjustment of 2757
Jonathan Wiggins: Yeah
Kevin Webster: I didn't understand the question.
Jonathan Wiggins: Ok...the property value on the card here is $3400 and that comes out
to 323,000 or 324,000, you added $275,000 to the adjustment on the Meadow Lane house
which is on eight tenths of an acre. You're saying that is like $50,000 for the property on
the Meadow Lane house?
Kevin Webster: Well what I am saying on the adjustment here is that the site between 5
acres and .795 get the price that these houses.., on that line it is worth $275,000 more
than the Meadow Lane for the additional 4.2 acres that it has. I'm not talking about the
assessment at all here; I am talking about market value.
Jonathan Wiggins: Yeah alright. I'm trying to put the appraisals together.
Gerard Schultheis: I see that there are three building permits here. The first building
(inaudible), the second building permit was to construct two access buildings...that's two
garages?
Christine Piacente: They are like full (inaudible) two separate little buildings.
Gerard Schultheis: Those are two buildings and that building permit was replaced by
another building permit in the same work...ok. What was the additional assessed value
for those two garages that were built?
Kevin Webster: It was two 48 by 42 garages and a 24 by 30. The additional assessment
was $1500 for each 48 by 42 and $540 for the 24 by 30. It was assessed at $.75 per
square foot for those detached structures and we're not talking about the attached garage
that is the 25 by 38 which is at $1.25 per square foot which is standard but it appears the
assessment at the time gave them a deep discount because it is additional space they only
assessed at $.75 per square foot as opposed to additional $1.25 so they...
Gerard Schultheis: Those are just metal buildings?
Christine Piacente: Yes
Kevin Webster: Yes, they put it at 60% of what a normal attached garage would be
assessed at in the Town of Southold, sensitive for the fact that it is 47...4800 square feet
of detached garage.
Gerard Schultheis: Anybody have any further questions?

Jonathan Wiggins: There is a $30,000 adjustment for that fact that it was built in 1979
and it looks like it has been maintained beautifully opposed to her house that is a 100
years old.
Darline Duffy: Well how much do you want to adjust it... 100,0007 I don't have 100
year old houses to compare it to.
Jonathan Wiggins: I understand, so it's $30,000 for the age of the house?
Darline Duffy: Yes. I find that appraisers really just pick number when they make those
kind of adjustments and I still don't see adjustments for much more than that when like
50,000...
Phyllis Atkinson: Usually, a lot of the times what I'll do is take the age and adjust by
$500 per year difference or $1,000 per year difference depending on the house...
Jonathan Wiggins: Did you look over the appraisal that was submitted?
Darline Duffy: I did for ten seconds.
Jonathan Wiggins: Did you find any fault with the appraisal?
Darline Duffy: I didn't really look at it that carefully. I was trying to...
Phyllis Atkinson: It is a summary.
Darline Duffy: It is, it doesn't have...the really felt the purpose of this appraisal was
something different than from coming here to determine the real market value of this
house for the purpose of this board. The purpose of this is was to det~Mne how much
this property would be valued if and when Ms. Murtaugh was able to subdivide the
property.
Jonathan Wiggins: If and when?
Darline Duffy: If and when
Jonathan Wiggins: what?
Darline Duffy: If she can subdivide her property.
Jonathan Wiggins: Oh she is going to subdivide the property ok.
Daniel McConlogue: What's the likelihood? (inaudible)
Jonathan Wiggins: What are these values of these two acre zoning?
Darline Duffy: Well that was the purpose of this appraisal wasn't it?
Phyllis Atkinson: Yes, let me explain. There were several different scenarios. Ms.
Murtaugh engaged me to do some of the report with the house on the 1.7 acres as is its
value then the house on, I forget what the acreage is, but on the back lot sold offto the
neighbor behind the back lot then another value with the house on the lot on Soundview
and then a value of the house with the lot on Soundview sold offbut still having the back
lot not being sold to the neighbors or both being sold and hers staying, having her house
on .67 acres. The reason for that was the several different scenarios so she would know
which would be most reasonable for her.
Jonathan Wiggins: She is trying to make her house affordable.
Daniel McConlogue: That doesn't make much of a difference with market value.
Phyllis Atkinson: Well see...if she decided to split her rear lot and sell it to the neighbor
who's behind her, that lot had limited (inaudible) bemuse it would be land locked and
would be valuable to the neighbor behind her who wanted to enlarge their property. If
she sold it somebody else they would have to do work and...With that in mind there were
very few comparables so I sort of paged with what was available and I think I found two
comparables and they were spread quite wide and I did the best I could.
Darline Duffy: The purpose with this appraisal really was different than what the
purpose of this meeting is
Phyllis Atkinson: It was to give Ms. Murtaugh several different scenarios on which she
may proceed.
Jonathan Wiggins: We are looking at her house as it is right now on Soundview Avenue,
110 years old in relatively in poor condition and you feel the property is $180,000.
Darline Duffy: I think the lot is worth substantial amount of money even if they don't
stip.
Jonathan Wiggins: What would an acre and half lot sell?
Cara Wells: It would be anywhere from...I would have to agree with Darline that the lot
is worth $380,000, I know exactly where the property is, at least for 300.
Jonathan Wiggins: The lot is currently appraised for $180,000, that is for the land alone
so we are currently talking about a $200,000 figure for the house.
Darline Duffy: No you're not
Jonathan Wiggins: Land plus improvements
Darline Duffy: What are you talking about Jonathan?
Jonathan Wiggins: Where is the property data card?
Mary Anne Murtaugh: Last July I was working in office of(inaudible) in Cutchogue and
while I was there in June I used their program to determine a market analysis of my
house essentially. I used ten comparables and I came up with a number of $325,000 now
I can't find it, I don't even work there anymore but that was last June that I got that so I
think 350 is high I don't think it is low.
Daniel McConlogue: The assessment throws offa market value of 380, is that correct?
Darline Duffy: Correct
Daniel McConlogue: And you claim it's 350, so we are 30,000 a part between two
appraisals.
Darline Duffy: Yes, I don't feel very strongly about this.
Jonathan Wiggins: You have the land which has been this way for a long time at $1900.
Darline Duffy: Right
Jonathan Wiggins: That is a land value of $180,952 and we have the total figure for
$4000 and that comes out to 380 so we are talking $200,000 for the house
Darline Dully: These two number put together is how we arrive at a value; it's not
necessarily what I think her home is worth. I certainly don't think an acre and a half is
worth $180,000, that's not what I think but that's the system that we use, but for the
purposes of this hearing is to look at the full market value for the taxes.
Jonathan Wiggins: Ok I understand but the house is in such poor condition that I'm just
trying to justify that somehow.
Darline Duffy: It's not in great condition but I told you that I don't feel strongly about
this.
Jonathan Wiggins: It is old to begin with, it was moved there in 1939 and it's not the Taj
Mahal so we have to...a little account.
Darline Duffy: Well just in my defense you can see that I lowered the assessment on this
house l, 2, 3 times so you know I am cognoscente on what's happening there. It was
lowered in '01, lowered in '08 and lowered in 2010. I lowered it this year but I told Ms.
Mutaugh that if she wanted to come to the Board I will be...because everybody should
have the opportunity.
Cara Wells: Absolutely

Joseph Finora: Oh, I can't compare it to any other assessments. My complaint centers
about the fact that the area has changed dramatically since the house was constructed in
the past 5-6 years since the Town has permitted a residential street to become very
commercialized and immediately across the way from me on the other side of the street
there has been a lot of commercial activity and many people have (inaudible). We were
very surprised what takes place with commercial activity that is going on. It used to be...
Cara Wells: It is the marine?
Joseph Finora: No, no...yeah next to the marine but the marina has always been there
before the house was built but these things happened after the house was built. There
was a structure across the street that had no entrance from Bay Avenue, it was just a
storage shed that was converted to a garage for fuel oil trucks and to the north of that
piece of property was the...it used to be a residential dwelling which is now a parking lot
which in itself which was not too bad but when they switched these high intensity lights
they lit my whole house sort to speak and through these years that I think these activities
have stayed there and I think they've had a detrimental effect on my property. I don't
know of any sales that have taken place recently in the area...
Gerard Schultheis: Have you gotten a recent appraisal of the property?.
Joseph Finora: Not recently, no
Gerard Schultheis: Well you have to give us some proof of what you believe the value of
that property is.
Daniel McConlogue: What is the value that the assessed value throws off?.
Kevin Webster: It shows about $728,000.
Jonathan Wiggins: Do you feel that is a fair market value for that property in that
neighborhood with everything he is talking about?
Kevin Webster: Yes I do.
Daniel McConogue: Do you feel that because of the increased commercial use that's
developed around your property the market value has decreased to what?
Joseph Finora: Well I had estimated about $600,000
Gerard Schultheis: Has the building changed since you had bought the house?
Joseph Finora: No but there was a residential home across the street which...I don't
know I am going back...that was owned by Mr. Clark and he had a ranch type house and
the Town which I assumed let him knock it down to expand the parking lot but that was I
would say residential and commercial. I also understand that there is only a certain
number of feet fi.om the Main Road back on any side street that's permitted for
commercial use and this exceeds that amount. If I'm not mistaken I think it's about 300
feet but the commercial activities that are going on there exceed that amount if that's the
correct number. I think (inaudible) other people that have had other similar situations,
having side streets off the Main Road like particularly up in (inaudible) which is now the
spa, that side street there keeps expanding out into residential areas and that is what
happened to me. The same thing happened to the people in Southold who live right
around from the comer of Mullen Motors, same situation there. There always seems to
be an increasing amount by commercial activities in residential areas.
Daniel McConlogue: You have no sales that indicate...
Joseph Finora: No I do not have any sales in the area. I did not do research.
Daniel McConlogue: Don't you want to find out what the true the market value is, the
only way we can do it is what the actual sales are. Does the assessor have any sales or
any indication of market value?
Kevin Webster: I do not have any sales with me right now.
Joseph Finora: I did mention in the last paragraph of my statement that the Town
supervisor remarked on what's going on in that area that he suggested a development
moratorium because the area is getting...real dumpy looking.
Gerard Schultheis: Just to reiterate what I said before we need to see from you some
proof of what your land value is and that can best be done with an appraisal and I need a
completed application form.
Joseph Finora: Yeah, I went through those hurriedly. I didn't think those sections
applied.
Jonathan Wiggins: You're welcome to take it back now and check offone of the boxes
